RESOLUTION
RE: APPROVAL OF USE BY SPECIAL REVIEW FOR EXPANSION OF AIRPORT
STORAGE MAINTENANCE FACILITIES - ANDREW J. HALLER
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 27th day of October, 1982 , at the hour of 2 : 0[)
o' clock p.m. in the Chambers of the Board for the purpose of
hearing the application of Andrew J. Haller, 7507 Weld County
Road 39 , Fort Lupton, Colorado 80621 , for a Use by Special Re-
view for expansion of airport storage maintenance facilities ,
on the following described real estate, to-wit:
Part of the South Half of Section 30, Town-
ship 2 North, Range 65 West of the 6th P.M. ,
Weld County, Colorado
WHEREAS, Section 24 . 4 . 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, an
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the re-
quest of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter, and having been fully informed, finds that:
1. The submitted materials are in compliance with application
requirements of Section 24. 7 of the Weld County Zoning
Ordinance.
2. It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24. 4. 2 of the Weld County Zoning Ordinance as follows :
a) The proposal is consistent with Comprehensive Plan
policies in that the use does not appear to infringe
on the continued agricultural use in the vicinity or
County.
b) The proposal is consistent with the intent of the agri-
cultural zone district and is provided for as a Use
by Special Review.
c) The activities and improvements proposed will be com-
patible with existing and future agricultural and rural
residential uses in the neighborhood.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners that the application for a Use by Special Review for
expansion of airport storage maintenance facilities on the here-
inabove described parcel of land be, and hereby is , granted sub-
ject to the following conditions :
1. The attached Standards for Use by Special Review be
adopted.
2 . The plat for the use permit be placed of record by the
Department of Planning Services staff prior to any build-
ing permits being issued on the site.
The above and foregoing Resolution was, on motion duly mach
and seconded, adopted by the following vote on the 27th day of
October, A.D. , 1982.

1. The permitted uses on the hereon described parcel shall be an
airport operation to accomodate a maximum of eighty (80) aircraft
• with a total of eight (8) hangars and a dwelling for security
purposes as described in the application materials and plat on file
with the Department of Planning Services.
2. Design standards for Uses by Special Review, Section 24.5 et seq.
of the Weld County Zoning Ordinance shall be complied with.
3. Operations standards for uses by Special Review, Section 24.6 et
seq. of the Weld County Zoning Ordinance shall be complies with.
4. The Use by Special Review shall be limited to the plans shown applicable
hereon and governed by the Standards stated above and all app
Weld County Regulations. Any material deviations from the ptanr,
and/or Standards, as shown or stated above, sf.all require the
approval of an amendment of the Permit by the Weld County Planning
Commission and the Board of County Commissioners before such changes
from the plans and/or Standards are permitted. Any other change:-
shall he filed in the office of the Department of Planning Services.
5. The property owner and/or operator of this operation shall be
responsible for complying with all of the above stated Standards..
Noncompliance with any of the above stated standards may be reascn
for revocation. of the Permit by the Board of County Commissioner .

The following business was transacted:
I hereby certify that pursuant to a notice dated October 13, 1982, duly
published October 14 in the LaSalle Leader, a public hearing was held on the requesi
of Andrew J. Haller for a Use by Special Review for an expansion of airport s'irage
maintenance facilities. Mr. Haller was present. The Flanning Commission reconmmend'' d
that this request be approved with conditions and development standards. Mr. Halle:
stated that he is just trying to provide shelter for his customers'airplaues.
Presently he intends to construct one hangar about 100' south of the gas pump,;.
Let the record reflect that Commissioner Steinmark is now present. Mr. Halle-
stated that approximately thirty planes are using his airport. The runway rue:.
in a north south direction now, however, several years ago the runway was
designed to run in aneast west direction but was ''changed. ' Alfred Di. Palo was preset
and opposed the expansion of this airport. Mr. Di Palo is an adjacent landowner
and is operating a dairy. He stated that his family and the dairy herd .are
bothered by the noise and the dust caused by the traffic in the area. He con -ended
that if this request is approved the noise will increase and so will the traffic
in the area. Be stated that the county roads are in poor shape and that he ht:;
lived on this property for seventeen years and the roads have been graveled olee
in the seventeen years. Curtis Wood, an adjacent landowner, opposed the requ -•r,t
because of the increase of noise and traffic. He moved to the country becaust he
wanted to live in a quiet area. Mr. Haller stated that a Mr. Drawer purclaseI the
property in 1965 and he is the person who started the airport. Mr. Haller abled
that he has six employees working at the airport in the shop. Commissioner C . Car
stated that he has lived a half a mile from an airport for several years nd i.is
fed several animals over the years and they have never been disturbed by the• aoise
caused by the airplanes. The increase of traffic is occurring over the ectir coup y,
stated Commissioner C. Carlson. He added that the County Engineer attended a !neet.i. �.g
in this area and some people at the meeting complained because their sand) roads
were being graveled and others complained because they were not being graveled .
Rose Marie Di Palo, wife of Alfred Di Palo, stated that they purchased their proper y
in 1965 and since then the traffic has continued to increase. She contended goat
when the dairy is being milked and a plane goes over the barn, the cattle certni_nly
are disturbed. Commissioner Steinmark questioned the effect on this airport it
the Board does not approve this request. Mr. Allison stated that currently tits
airport has no limitations because it was grandfathered in under the zoning celinan .e.
He stated that Mr. Haller is Limiting the expansion. Commissioner C .
Carlson asked Mr. Haller to make an attempt to route the air traffic away from
the Di Palo property if possible. Mr. Haller said that he would try, however , he
does not control all the planes that land and take ofi from his property. Alter
additional discussion, Commissioner Kirby made a motion tb approve the request wit`I
the conditions and the development standards . Commissioner N. Carlson seconced tl:
motion and it carried unanimously.

LOCATION: 3.25 miles northwest of Hudson on Weld County Road 19
THE DEPARTMENT OF PLANNING SERVICE'S STAFF RECOMMENDS THAT THIS REQUEST 13E
approved FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with application requirements
of Section 24. 7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Department of Planning Services staff that
the applicant has shown compliance with Section. 24. 3.1.1 et seq. of
the Weld County Zoning Ordinance as follows :
- The proposal is consistent with comprehensive plan policies in
that the use does not appear to infringe on the continued
agricultural use in the vicinity or County.
- The proposal is consistent with the intent of the agricultural.
zone district and is provided for as a use by special rev:icw.
- The activities and improvements proposed will be compatible
with existing and future agricultural and rural residential
uses in the neighborhood.
- No Overlay Districts affect the site;
- Use by Special Review Operations and Design Standards provide
adequate protection of the health, safety and welfare to the
neighborhood and County.
The Department of Planning Services staff recommendation is based upsi
the following conditions:
1. The attached Standards for Use by Special Review be adopted;
2. The plat for the use permit be placed of record by the Department
of Planning Services staff prior to and building permits bein
issued on the site.

1. The permitted uses on the hereon described parcel shall be an.
airport operation to accomodate a maximum of eighty (80) aircraft
with a total of eight (8) hangars and a dwelling for security
purposes as described in the application materials and plat on file
with the Department of Planning Services.
2. Design standards for Uses by Special Review, Section 24. 5 et seq.
of the Weld County Zoning Ordinance shall be complied with.
3. Operations standards for uses by Special Review, Section 24.6 et
seq. of the Weld County Zoning Ordinance shall be complies with.
4. The Use by Special Review shall be limited to the plans shown
hereon and governed by the Standards stated above and all appl.icalle
Weld County Regulations. Any material deviations from tie pans
and/or Standards, as shown or stated above, shall require the
approval of an amendment of the Permit by the Weld County, Plannin}
Commission and the Board of County Commiss::-oners before such c.lianhes
from the plans and/or Standards are permitted. Any other changes
shall be filed in the office of the Department of Planning Services .
5. The property owner and/or operator of this operation shall be
responsible for complying with all of the above stated Standards.
Noncompliance with any of the above stated standards may be reason
for revocation of the Permit by the Board of County Commissioners.
