COLORADO The Weld County Public Works Department has reviewed this proposal; this project falls primarily under the purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS: The Department of Planning Services is not indicating that this is a major facility of a public utility; therefore, the applicant shall complete the full hearing process before the Planning Commission and the Board of County Commissioner for final determination. WCR 16 and WCR 17 are designated on the Weld County Road Classification Plan (FHU) as local gravel roads, which require a 60-foot right-of-way at full build out. Both roads presently have a 60-foot right-of-way. 'hese roads are maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County .ode, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. REQUIREMENTS: Access: The applicant is indicating on the plat drawing that the "proposed" tower site accesses from WCR 16 and the "future" tower site accesses from WCR 17. Utilize these existing access points as they are shown on the plat drawing. The access width required for emergency equipment (fire department/emergency response) is a minimum of 20 feet. The applicant needs to verify with the local emergency responder that the existing accesses and road to the facility meets their minimum requirement. DATE:SUBJECT:USR-1508 8 LONGMONT BROADCASTING 5 COLORADO Cc: Environmental Health Services has reviewed this proposal for two communications transmission towers. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be incorporated into the permit as conditions that must be met prior to operation: 1. A stormwater discharge permit may be required for a development/redevelopment/construction site where a contiguous or non- contiguous land disturbance is greater than or equal to one acre in area. The applicant shall inquire with the Water Quality Control Division (WQCD) of the Colorado Department of Public Health and Environment at www.cdphe.state.co.us/wq/PermitsUnit if they are required to obtain a stormwater discharge permit. Alternately, the applicant can provide evidence from WQCD that they are not subject to these requirements. We recommend that the following requirements be incorporated into the permit as conditions that must be met prior to the issuance of the Certificate of Occupancy: 1. An individual sewage disposal system is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. 2. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C.R.S., as amended. 6. Adequate handwashing and toilet facilities shall be provided for employees of the facility. 7. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 8. Adequate toilet facilities (port-a-potty) shall be provided during the construction of the facility. 9. The facility shall utilize the existing public water supply. (Central Weld County Water District) 10.Bottled water shall be utilized for drinking and hand washing during construction of the project. 11.If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. 12.The operation shall comply with all applicable rules and regulations of the State and Federal agencies and the Weld County Code. 2 4i; :III :' Weld County Referral March 22, 2005 "lip C. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when applying for each permit. 3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2003 International Building Code, 2003 International Mechanical Code, 2003 International Plumbing Code, 2002 National Electrical Code and Chapter 29 of the Weld County Code. 4. Each building will require an engineered foundation based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. 5 Building height, setbacks and offset distance shall be determined by the Zoning Ordinance. Separation of buildings of mixed occupancy classifications shall be in accordance with the 2003 International Building Code. Tower height shall be controlled by the Federal Aviation Administration. 6. Building heights shall be measured in accordance with the 2003 International Building Code for the purpose of determining the maximum building size and height for various uses and construction types and to determine compliance with the Bulk Requirements from Chapter 29 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. When measuring buildings to determine offset and setback requirements, buildings are measured to the farthest projection from the building. Property lines shall be clearly identified 7. This application has been reviewed and causes concern because facilities of this magnitude would not be allowed under the current Land Use Code. We appreciate the fact that the proposed towers have been located adjacent to the existing tower rather than another location. This application is within the proposed planning area for the Town of Frederick. The proposed plan is set for adoption in November 2005. The proposed land uses in this area are primarily residential. The existing Land Use Code requires that wireless communications facilities be in an industrial zoning district. Approval of the proposed towers is also contrary to the Land Use Code's limitation on height. The Code would allow a tower to be no higher than 70 feet. The proposed towers would be more than 10 times higher than this. Considering that residences are likely to surround the site, please consider requesting that the applicant provide landscape buffers around the site's perimeter. A row of trees would greatly help buffer not only the accessory building and base of the towers, but also the guy wires. Thanks again for sending the referral.
