Hearing Certification Docket No. 2026-02 • Board of County Commissioners Weld County, Colorado Use by. Special Review Permit, USR25-0020, for an Event Facility outside of subdivisions and historic townsites in the A (Agricultural) Zone District—Jose and Susan Garcia A public hearing was conducted on January 28, 2026, at 10:00 a.m., with the following present: Commissioner Scott K. James, Chair Commissioner Jason S. Maxey, Pro-Tern Commissioner.Perry L. Buck Commissioner Lynette Peppier Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Jess Reid Deputy-County Attorney, Karin McDougal Department of Planning Services Representative, Angela Snyder Development Review Representative, Mike McRoberts The following business was transacted: I hereby certify that pursuant to a Notice dated December 17, 2025, and duly published December 19, 2025, in the Greeley Tribune, a public hearing was conducted to consider the request of Jose and Susan Garcia, for Use by Special Review Permit, USR25-0020, for an Event Facility outside of subdivisions and historic townsites in the A (Agricultural) Zone District. Karin McDougal, Deputy County Attorney, made this a matter of record. Angela Snyder, Department of Planning Services, presented a brief summary of the proposal, the general location of the site, and displayed the Site Plan, which showed the improvements on the site. She stated the applicant will host three (3) to four (4) events per month, each with up to 150 guests. She relayed the applicants recently had their well re-permitted for commercial use and explained the provisions for the use of the septic system. She discussed dust mitigation, mentioned the request is the result of a zoning violation, and stated the event center is outside of floodplain; however, the applicant had • applied for a Floodplain Permit to protect Lone Tree Creek during the improvement of the parking area. She noted a Noise Study was conducted, the noise levels at the property line are within the acceptable range, and outlined the surrounding zoning, USRs and residences. She indicated notice was sent to 11 surrounding property owners (SPOs) and no correspondence was received in return. Ms. Snyder relayed the site is in the Airport Overlay District, therefore, vertical development on the site could be referred to the cc:P4.(bE/M14/DA/AS/KR) 2026-0092 o ./iq/2-4 PL2990 Hearing Certification (USR25-0020) — Jose and Susan Garcia Page 2 airport, and the site is considered Prime Farmland; however, no farmland is being removed with the request, primarily due to the existence of the floodplain. She entered the favorable recommendation of the Planning Commission into the record, as written, and displayed images of the site and surrounding views. In response to Commissioner Maxey, Ms. Snyder clarified what constituted vertical development. Mike McRoberts, Department of Planning Services, Development Review, stated access is on County Road (CR) 49 and provided the average daily traffic counts, as well as the anticipated traffic for an event. He relayed a Road Maintenance Agreement is requested and the site meets an exception to stormwater detention. Jose and Susan Garcia, applicants, in response to Chair James, indicated they had not had contact with any of the Commissioners regarding this case. Ms. Garcia displayed a PowerPoint presentation, provided the history of the event center, and displayed images inside and outside of the event center. No public testimony was offered concerning this matter. The Board discussed the Draft Resolution and acknowledged language in Development Standard (DS) #21 (water) had been stricken, as the applicants already re-permitted their well for commercial use. Commissioner Maxey suggested deleting DS #27 (sources of light), as DS#6 (Lighting Plan) covers the issue of lighting. The Board agreed to all of the aforementioned changes. In response to Chair James, the Garcias indicated they had reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as amended. No public testimony was offered regarding changes made to the Conditions of Approval and Development Standards. Commissioner Maxey moved to approve the request of Jose and Susan Garcia for Use by Special Review Permit, USR25-0020, for an Event Facility outside of subdivisions and historic townsites in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner Buck, and it carried unanimously.
