RESOLUTION
RE: APPROVAL OF SPECIAL USE PERMIT FOR A BORROW PIT FOR THE
COLORADO DIVISION OF HIGHWAYS, P. O. BOX 850 , GREELEY,
COLORADO 80632
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado held a public hearing on the 7th day of May, 1980 at the
hour of 2 : 00 o'clock p.m. in the Chambers of the Board of County
Commissioners for the purpose of hearing the application of the
Colorado Division of Highways, P. O. Box 850, Greeley, Colorado
80632, for a Special Use Permit for a borrow pit on the fol-
lowing described real estate, to-wit:
That part of the Southwest Quarter, Sec-
tion 3 and of the Northwest Quarter, Sec-
tion 10, Township 4 North, Range 63 West
of the 6th Principal Meridian, Weld County,
Colorado being more particularly described
below:
Beginning at the Southwest corner of Sec-
tion 3 , proceed easterly along the south
line of said Section 3 a distance of 1110
feet to the true point of beginning: thence
North 00°00 ' 00" West a distance of 600 feet;
thence North 90°00 ' 00" East a distance of
400 feet; thence South 30°45' 00" East, a
distance of 700 feet; thence South 11°10 ' 00"
West a distance of 840 feet; thence North
57°28 ' 00" West a distance of 1000 feet;
thence North 40°43 ' 32" East a distance of
379. 89 feet more or less to the true point
of beginning.
WHEREAS, evidence was presented in support of the granting
of the Special Use Permit for a borrow pit on the above described
real estate, and
WHEREAS, Section . 3. 3 (E) (2) of the Weld County Zoning Resolu-
tion authorizes such a use in an Agricultural District upon appro-
val by the Board of County Commissioners, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado heard all of the testimony and statements of those pre-
sent, has studied the request of the petitioner and the recommenda-

tions of the Weld County Planning Commission and all of the
exhibits and evidence presented in this matter, and having been
fully informed, is satisfied that the request for a Special Use
Permit for a borrow pit on the hereinabove described real
estate, conforms to the purposes of Section 3 . 3 (E) (2) of the
Weld County Zoning Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the application of the
Colorado Division of Highways for a Special Use Permit for a
borrow pit on the hereinabove described tract of land be, and
hereby is, granted subject to the Development Standards contained
in the Special Use Permit, and further subject to the condi-
tions as recommended by the Weld County Planning Commission.
BE IT FURTHER RESOLVED by the Board that the reasons for
approval contained in the Weld County Planning Commission recom-
mendations dated March 18, 1980 be, and hereby are, adopted as
the findings of fact of the Board of County Commissioners in this
matter.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 7th day of

The following business was transacted:
I hereby certify that pursuant to a notice dated March 31, 1980 and
duly published April 3 and 24 , 1980 in the Johnstown Breeze a public
hearing was held on a request for a SUP, BORROW PIT BY THE COLORADO
DIVISION OF HIGHWAYS.
Mr. Anson reviewed for the Board the criteria to be used in making their
decision regarding this request.
Mr. Honn read the Planning Commission' s favorable recommendation and
related development standards.
Virgil Harper was present representing the applicant. Mr. Harper
elaborated on this request and stated that no county roads would be
involved in hauling operations from the pit. Egress and ingress would
be directly onto a State Highway.
John Hall, Weld County Health Department Enviromental Health Division,
was present and questioned Mr. Harper regarding the cubic yards of
material to be removed. Mr. Hall stated they would need an emmission
permit.
There was no one in opposition to this request in attendance.
Commissioner Dunbar made a motion to approve the SUP request for
the Colorado Divsion of Highways with the Planning Commission' s
recommendations and development standards. Commissioner Carlson
seconded the motion and it carried unanimously.

PLANNING COMMISSION RECOMMENDATION
March 18, 1980
This determination is based in part upon a review of the information
submitted by the applicant, other relevant information regarding the
request and the responses of the referral entities which have reviewed
this request.
The Planning Commission recommendation for approval is conditional upon
the following:
1. The attached Operations Standards being recommended and approved
for this request.
2. The following note being placed on the Special Use Permit plat:
Note: The Mined Land Reclamation Board has the authority
to issue permits for mining and reclamation activities.
Activities related to mining and reclamation are
therefore under the jurisdiction of the Mined Land
Reclamation Board, however, Weld County has jurisdiction
of those matters outlined in the Operations Standards.
3. The Operations Standards being laced on the Special Use Permit plat.
The Special Use Permit plat shall be delivered to the Department of
Planning Services office for inspection prior to recordation at the
Weld County Clerk and�j er' s Office.

OPERATIONS STANDARDS
1. The uses permitted on this site shall be the extraction of borrow
material as described in the application materials and all other
uses permitted by right under Section 3. 3B of the Weld County
Zoning Resolution.
2. No excavation or processing of materials shall be permitted nearer
than 10 feet to the boundary of adjacent property, easement or
irrigation ditch or right-of-way, nor nearer than 125 feet to any
existing residence, unless by written agreement the owner or owners
of such adjacent property consent to a lesser distance and the
Planning Commission approves such lesser distance.
3. All extraction operations shall be conducted during the hours of
daylight except in the case of public or private emergency or to
make necessary repairs to equipment. This restriction shall not
apply to operation of administrative and executive offices or
repair facilities located on the property.
4. The Special Use Permit area shall be maintained in such a manner so
as to prevent soil erosion, fugitive dust and growth of noxious
weeds. The site shall be maintained in such a manner as to present
a neat and well kept appearance.
5. Existing trees and ground cover along public road frontage and
drainageways shall be preserved, maintained and supplemented if
necessary, for the depth of the setback in order to protect against
and/or reduce noise, dust and erosion.
6. Where topsoil is removed, sufficient arable soil shall be set aside,
for respreading over the excavated area.
_ 7. Insurance - The operator shall furnish evidence he is insured to
the extent of not less than $100, 000. 00 against liability for any
negligent act or omission by the operator from the operation or
maintenance of the sand and gravel pit and the extraction and
production of sand and gravel and all activities connected with or
incidental thereto.
8. All phases of the borrow pit operation shall comply with all
applicable County, State and Federal Health Standards and Regulations
and other applicable rules and regulations of governmental bodies
having jurisdiction on the premises.
9. All accesses shall have the approval of the State Highway Department.
All accesses shall be constructed in accordance with the
recommendations and/or requirements of the State Highway Department,
10. No diking or berming shall be allowed on the Special Use Permit area
which would cause damage to adjacent properties by altering the
historic drainage pattern.
11. The Special Use Permit shall be limited to the plans shown hereon
and governed by the Operations Standards stated above and all
applicable Weld County Regulations. Any material deviations from the
plans and/or Operations Standards as shown or stated above shall
require the approval of an amendment to the Special Use Permit by
the Planning Commission and the Board of County Commissioners before
such changes from the plans and/or Operations Standards shall be
permitted. Any other changes from the plans and/or Operations
Standards shall be filed in the office of the Department of Planning
Services.
12. The property owner and/or operator of this operation shall be
responsible for complying with all of the above stated Development
Standards. Noncompliance with any of the above stated Development
Standards shall be reason for revocation of the Special Use Permit
by the Board of County Commissioners.

March 18, 1980, in the Weld County Centennial Center County Commissioners
Hearing Room, first floor, 915 10th Street, Greeley, Colorado.

As a quorum was present Chairman Carlson called the meeting to order and
call for a motion to approve the minutes of March 4, 1980. Fred Otis made
a motion to approved the minutes as submitted. His motion was seconded by
Bette Kountz. A unanimous vote was cast to approve the minutes.

Consider and formulate a recommendation to the Board of County Commissioners
on a proposal to repeal Section 6 . 5 , Special Areas Subject to Flooding,
Supplementary Regulations of the Official Weld County Zoning Resolution
DISCUSSION: Tom Honn stated that the current regulations were recently
adopted by the Board of County Commissioners and these new regulations
are promulagated as a result of the Federal Insurance Administration.
Because of their adoption this section needs to be repealed. He also stated
that this was an oversite that was not included in the initial action regard-
ing the Floodplain regulations, but since they were not yet formally
adopted, it was reasonable to keep them in until the new regulations were
adopted.
MOTION: Be it therefore resolved to recommend approval based on the
Planning Staff ' s recommendation to the Board of County Commissioners.
Motion by Fred Otis, seconded by Irma White. A vote of "aye" was cast by
Don Billings, Bob Ehrlich, Fred Otis, Irma White, Bette Kountz, and
Chuck Carlson.

Consider and formulate a recommendation to the Board of County Commissioners
on a proposal to adopt the Official Weld County Flood Hazard Overlay
District Zoning Maps. These maps will be used in conjunction with the
Flood Hazard Overlay District Regulations to regulate any new buildings,
structures, and land uses within the floodprone areas as delineated on
these maps
DISCUSSION: This proposal was presented to the Planning Commission several
weeks ago at their regularly scheduled meeting. This hearing is being
held to primarily give the citizens of Weld County the opportunity to
request any changes in the maps they felt were in error. Discussion
followed regarding the boundaries of the floodplains.
MOTION: Be it therefore resolved to recommend approval based on the
Planning Staff ' s recommendation to the Board of County Commissioners.

DISCUSSION: Tom Honn stated that this is an annual request of the
Planning Commission in which the Chairman is authorized to sign the
certificate which will be placed on the original copy plus the office
copy and to further recommend that they adopt and certify the map so
that it may be placed in the records of the Clerk and Recorder' s Office.
Discussion followed.

Planning Staff' s recommendation to the Board of County Commissioners.

APPEARANCE: Lincoln Wallbank
DISCUSSION: Mr. Wallbank stated that this request is to operate a club-
house with limited membership and for a limited time during the duck
season. The house is presently existing on the property. He stated that
they may not hunt anywhere else except where the club has permission
to hunt, but have had a lot of problems with trespassers. Tom Honn then
the Planning Staff ' s recommendation for approval into the record along
with the Development Standards. Chairman Carlson then asked if there
were any objections from anyone in the audience regarding the request.
At this time Ray Peterson and Esther Howard, both surrounding property
owners, expressed their concern about trespassers on their property while
hunting who have said they were members of the club, but in fact were
not. Discussion followed regarding possible ways of dealing this. It
was suggested that perhaps club members could be issued a means of
identification which indicates they are members of this club and if they
could not present identification, they would be trespassers. It was
also suggested by Bob Lowenbach that a provision could be made in the
Development Standards which would state that the permit shall apply only
to the duck club and will expire if the property is transferred by deed,
etc. or if the duck club no longer operates or leases the Conditional
Use Permit area. Discussion followed.
MOTION: Be it therefore resolved to recommend approval with amendments
to the Development Standards regarding identification of club members
when hunting and that the permit shall apply only to the duck club to
the Board of County Commissioners based on the Planning Staff ' s
recommendation. Motion by Bob Ehrlich, seconded by Don Billings. A
vote of "aye" was cast by Don Billings, Bob Ehrlich, Fred Otis, Irma

LOCATION: 8 miles southeast of Kersey on the north side of U.S .'

APPEARANCE: Mr. Harper stated their proposal is to excavate borrow mate is
on this site for a construction project on U. S. 34 between Kersey and ,
Dearfield. This site is located on 191/2 acres . This site will be totall ,,
reclaimed when they are finished with the project. No county roads will
be involved. The area is presently dryland pasture. The Planning Staff' s
recommendation for approval was incorporated into the record and not
read into the record.
MOTION: Be it therefore resolved to recommend approval to the Board of j
County Commissioners based on the Planning Staff ' s recommendation. Motion
by Bob Ehrlich, seconded by Bette Kountz. A vote of "aye" was cast by

State Health Department Site Application - Town of Windsor
DISCUSSION: Tom Honn stated that the State Health Department under its
rules and regulations requires a site application approval for any
construction to sewage treatment facilities . In this case the Town of
Windsor is planning to modify their existing facility. The Planning
Staff has reviewed the modification and determined it would not be
enlarging or expanding which would require a Special Use Permit. However,
because of the State process this matter does come before the Planning
Commission and the Board of County Commissioners for review. The action
by the Planning Commission would be to authorize the Board of County
Commissioners to sign on the application either approval or disapproval
of the recommendation or no comments. The Planning Staff ' s recommendation
is that the Planning Commission would authorize the Chairman to make a
recommendation of approval. Mr. Takata of M & I Engineering stated that
they serve as the town ' s engineers. They propose to enlarge the treatment
capacity of the existing wastewater plant which was constructed in 1972
and is an aerated lagoon. A study was conducted which indicate that within
11 years at the present rate of growth, it would be exceeding the capacity
of the plant. Aeration will be added to the existing lagoons. Estimated
cost of the project will be approximately $230, 000 which will be financed
by the Town of Windsor. Discussion followed.
MOTION: Be it therefore resolved that the Chairman sign the application
for approval. Motion by Fred Otis, seconded by Bob Ehrlich. A vote of
"aye" was cast by Don Billings, Bob Ehrlich, Fred Otis , Irma White, Bette
Kountz, and Chuck Carlson.

DIVISION OF HIGHWAYS
The Colorado Division of Highways proposes to contract for the operation of
a 19.5-acre barrow pit in secs. 3 and 10, T4N, R63W. The site is located on
the edge of an extensive sand dune field above a terrace along the South
Platte River. Our gravel resources map of the Hardin quadrangle shows that the
deposits here exceed 50 ft in thickness, but the mining plan calls for the re-
moval of only 10 to 12 ft of sand and less than one foot of topsoil . The
excavation will lie totally above the water table, and the finished graded
site probably will be unnoticeable in this dune terrain. I see no geologic
problems involved with operation of the site.

EXHIBIT D: MINING PLAN .
This borrow site is located in an irrigated and dryland area about B
miles southeast of Kersey, Colorado. It is adjacent to and north of
U.S. Highway 34 at station 810+00. The borrow site sets above irrigated
cropland on a north facing slope.
The mining plan is to excavate the existing hill down in a uniform
manner, blending in smoothly with lower surrounding lands. As a result,
the landowner should have more useable land which could accomodate a
sprinkler irrigation system in the future.
The material in the borrow site consists of a clean, fine, sandy soil.
This material will be used for highway construction. Below is a log of
the material to be mined.

EXHIBIT D: MINING PLAN "CONTINUED"
The borrow site contains 19.5 acres. The depth of the excavation will
average from 10 to 12 feet.
Any backslopes, caused by this operation, that may be left in the affected
area will be no steeper than 8:1.
It is estimated that between 85,000 and 100,000 cubic yards could be
excavated from this area.
The methods of mining are left to the contractor. However, the following
are generally the phases and sequences in an operation similar to this:
1. Approximately 6 to 8" of topsoil shall be excavated and stockpiled.
It will be used later during reclamation of the affected area.
2. The borrow material will be excavated and hauled to the adjacent
project.
3. The following is a list of equipment that could be used in the
mining operation:
A. Earth Moving Scrapers - used for stripping, stockpiling,
and replacing the top 6 to 8" of material - can also be used
for hauling borrow to the project site.
B. Bottom Dump Trucks - used for hauling borrow to the project
site.
` C. Crawlers - Generally used for pushing scrapers while loading
and for pit maintenance.
D. Motor Graders - Used for building and maintaining haul roads.
Also used in pit maintenance.
- E. Rubber Tire Front End Loaders - Can be used for loading
trucks.
F. There are supporting fuel and service vehicles in and out
of the pit areas for the above listed equipment.
4. After the excavation is completed, the areas will be smoothed and
left in a neat condition. Unsightly humps and depressions will be
cut and/or filled.
5. The estimated time to excavate and haul the borrow material is
about 30 days. This estimate is based on past performances on
• similar projects.
The contractor is allowed some latitude on time, equipment and sequence
of operations.

EXHIBIT E: RECLAMATION PLAN
The goal of the reclamation plan is to revegetate the area for pasture,
its premining use. It will still be higher than the adjacent irrigated
land, but will be level enough to accept a sprinkler irrigation system
in the future, thereby opening it for use as irrigated crop land if the
landowner so desires.
Either of these proposed post mining uses would be consistent and
compatible with the surrounding agricultural activities.
Implementation of the reclamation plan will have no adverse affect on
the water, wildlife, air, soil or vegetation.
WATER
Surface and ground water systems will not be affected.
WILDLIFE
The Division of Wildlife stated in their letter (see Exhibit H) that
the mining impact on wildlife will be minor. The immediate revegetation
will provide a covered landscape for the smaller animals living in the
area.
AIR
The action of the mild winds blowing in the area almost daily ventilates
the area. Except for a slight increase in dust during construction
there will be no adverse affect on air quality.
SOIL
Approximately 6 to 8" of soil will be stripped and stockpiled before
the excavation of the borrow material. After the excavation is complete
it will be placed over the mined areas. It does not contain any toxic
materials and it will not come into contact with any toxic material.
Other than disturbing the soils, there will be no adverse affect.
VEGETATION
Following are the revegetation and fertilizing types and rates for the
affected area.
Before any fertilizer is placed the previously stockpiled topsoil will
be placed over the area as uniformly as possible 4 to 8" thick. Next
it will be seeded, then fertilized with heavy cow manure spread at the

rate of 20 tons per acre, and mulched. The following types and rates
will be used and have been agreed upon by the landowner, Colorado
Division of Highways and the Soil Conservation Service:

This seeding rate has been adjusted for a critical area planting.
Following these recommendations closely will help make a successful
seeding. Too much seed could be detrimental.
Seeding shall be done in early spring, prior to April 1st, or after
October 30th, which will allow the seed to lay dormant prior to
germination in the spring. Seed should be planted 1/2 to 3/4 inch deep.
FERTILIZER
A heavy application of larger manure chunks (60% or more in the 6 to
8 inch range) applied at the rate of 20 tons plus per acre and yielding
200 pounds of nitrogen per acre, shall be placed over the seeding to
prevent the soil from blowing.
It is estimated the seeding and fertilizing will take approximately 3
days.

Division of Wildlife, inspected the Farr borrow area. Attached is his
wildlife statement written to the Division of Highways.

Enclosed is the information that you requested by phone for the proposed pit
in the NA of Section 10, Twp. 4N, Range 63W, north of Highway 34, Weld County,
Colorado, and part of the SW4, Section 3, Twp. 4N, Range 63W.
The soil in this area is classified as Valent sand, 3 to 9 percent slopes. The
attached soils map and soil description will provide you with further information
on the soil type.
The following is a list of vegetation observed when we visited the site on
October 25th, but it does not necessarily include all plants present at the
site. The area is a Deep Sand Range Site.

OPTION TO BUY MATERIAL
THIS AGREEMENT is made and entered into this 29th day of October , 1979 , by and
between the Owner(s) : W. D. Farr

the Mortgagee: The Travelers Insurance Company
and the STATE.DEPARTMENT OF HIGHWAYS - DIVISION OF HIGHWAYS - STATE OF COLORADO,
hereinafter referred to as the Department.
WITNESS THAT: The owner(s) for the consideration of one dollar, receipt of which is
hereby acknowledged, does hereby grant to the Department an exclusive right and option
from the date of this agreement until the 31st day of December , 1981 , at 12:00
noon, to purchase, process, produce, and remove such materials located on land described
as follows: part of the S.W. 1/4 Sec. 3 and part of the N.W. 1/4 Sec, 10, T. 4 N. ,
R. 63 w. , south of Empire Ditch and north of U.S. Highway 34.
If a contract has been awarded and the subject material is being used or is to be used,
the expiration date of this Option will automatically extend until the work is completed
for that particular project.
In the event the Department desires to purchase any material located on the above
described land, the Owner will be paid a royalty fee at the following rate:
(a) Borrow Material at ten cents (10 0) per Cu. Yd.
(b) at ( 0) per
(c) at ( ¢) per
The Department shall have the right of ingress and egress to and from the subject
premises and to erect any temporary structures, such as screening, crushing, and/or
asphalt plants; to stockpile materials in an area of sufficient size; and to employ any
reasonable methods for the removal of said material. Colorado Mined Land Reclamation Rules
and Regulations will apply. This agreement and any State, County, or Municipal Permits
obtained by the Department are for the removal of material for use on Department projects
and maintenance only.
It is understood and agreed that, upon the award of a contract by the Department to a
contractor for the construction, improvement, and/or maintenance of highways, the
Department may assign to the contractor all its right, title, and interest under this
instrument, insofar as the same shall be applicable to Department projects let to the
Contractor, who may reassign such option to subcontractors working on said projects. If
the option is exercised by the contractor or any subcontractors, said contractor or
subcontractor shall have a right to extract all material needed for the projects
covered by the contract awarded by the Department, subject to all terms of the Option.

I 7 Borrow Pit
SPECIAL CONDITIONS:
1. A four strand barbed wire fence shall be placed around the pit,
stockpile area, and haul road, as staked by the engineer. The fence
will be left in place until the seeding is established. At that
time the fence will become the property of the landowner.
2. The engineer will establish the excavation boundaries and grade
stakes in the borrow area. •
3. The top 6" to 8" of overburden is to be removed and stockpiled for
use in reclamation of the affected area.
4. The excavation is to be done in such a manner that it will leave no
unsightly humps or depressions, and shall blend in with the
surrounding slopes and natural elevations.
5. Any backslopes, caused by this operation, that may be left in the
affected area will be no steeper than 8:1.
6. After borrow has been removed, the overburden will be spread
uniformly over the affected area, seeded, fertilized and mulched.
