HomeMy WebLinkAbout20260044 Record of Proceedings Minutes Board of County Commissioners Weld County, Colorado Wednesday, January 14, 2026 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado 80631 , on January 14, 2026, at the hour of 9:00 a.m. Roll Call: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Scott K. James, Chair Commissioner Jason S. Maxey, Pro-Tem Commissioner Perry L. Buck Commissioner Lynette Peppler Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Houstan Aragon County Attorney, Bruce Barker Minutes: Commissioner Ross moved to approve the below listed Minutes of the Board of County Commissioners meeting, as printed. Commissioner Buck seconded the motion and it carried unanimously. 1 . Minutes from December 31 , 2025 Amendments to Agenda: There were no amendments to the Agenda. Consent Agenda: There being no request for public testimony concerning the following items, as listed under 'Consent Agenda — Miscellaneous', Commissioner Maxey moved to approve the Consent Agenda, as printed. Commissioner Peppier seconded the motion and it carried unanimously. 1. Vacation, VAC25-0030, of Amended Recorded Exemption, 1AMRECX19-00-2645 — Stanley Gingerich 2. Partial Vacation, VAC25-0031 , of Two-Lot Recorded Exemption, RE-1790, for Removal of Lot B — Stanley Gingerich 2026-0044 BC0016 Page 2 Wednesday, January 14, 2026 www.weld.gov Warrants: 1 . General Warrants: Commissioner Ross moved to approve the General Warrants, as printed. Commissioner Peppler seconded the motion and it carried unanimously. 2. Commissioner Warrants — Kevin D. Ross: Commissioner Maxey moved to approve the Warrant for Commissioner Ross, as printed. Commissioner Buck seconded the motion, and upon a roll call vote of four (4) to zero (0), the motion carried with Commissioner Ross abstaining. New Business — Planning: 1 . Consider Request to Extend Time to Record Map for Use by Special Review Permit, USR23-0034— Barry James Reider Living Trust and Julie Ann Nelson Living Trust, c/o CBEP Solar 17, LLC: Lindsay Oliver, Department of Planning Services, stated the applicants, Barry James Reider Living Trust and Julie Ann Nelson Living Trust, c/o CBEP Solar 17, LLC, requested an extension until February 28, 2026, to record the map for USR23-0034, as a result of Xcel Energy project delays. Brysen Daughton, CBEP representative, indicated each of the requests today are the result of Xcel Energy's project delays and explained he is confident the extension of time will allow them to complete the necessary Conditions of Approval for recording the map. Commissioner Maxey moved to approve said Resolution. The motion was seconded by Commissioner Ross and it carried unanimously. 2. Consider Acceptance of Request to Withdraw Application for Use by Special Review Permit, USR23-0033, for a 1.5 MW Solar Energy Facility (SEF) in the A (Agricultural) Zone District, and Rescind Resolution #2023-3147, Dated November 8, 2023 — John Scott Byrnes Trust, c/o CBEP Solar 28, LLC: Ms. Oliver stated staff received a letter from the applicant on December 17, 2025, requesting to withdraw their application for Use by Special Review Permit, USR23-0033, after receiving the review of the interconnection study results from Xcel Energy. She indicated the applicant determined the project is no longer feasible, for a 1.5 MW Solar Energy Facility (SEF) in the A (Agricultural) Zone District; therefore, staff requests the acceptance of withdraw and to rescind Resolution #2023-3147, dated November 8, 2023. Mr. Daughton confirmed there are extreme costs associated with the necessary upgrades dictated by Xcel Energy for the distribution processes, which would dramatically restrict the size of the project, thus it has been determined no longer worth pursuing. Commissioner Ross moved to accept said withdrawal and rescind Resolution #2023-3147. The motion was seconded by Commissioner Buck and it carried unanimously. 2026-0044 BC0016 Page 3 Wednesday, January 14, 2026 www.weld.gov Public Comment: 1 . Steve Teets, City of Greeley resident, offered his comments to the Board. Let the Minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board. There being no further business, this meeting was adjourned at 9:14 a.m. The Board of County Commissioners of Weld County, Colorado, approved the above and foregoing Minutes, on motion duly made and seconded, by the following vote on the 28th day of January, A.D., 2026: Scott K.
