HomeMy WebLinkAbout830901.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 640 - VERNON PRESTON WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , it was determined by the Board of County Commis- sioners , at a public meeting held in the Chambers of the Board, that the division into two parcels of land, as shown on the plat known as Recorded Exemption No. 640 , being the property of Vernon Preston, described as part of the South z, Southeast a, Section 7 , Township 2 North, Range 62 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A" , said plat to be recorded, does not come within the purview of the definition of the terms , "subdivision" and "subdivided land" , pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and WHEREAS , this request is to divide the property into parcels of 13 acres and 77 acres, more or less, to allow Mr. Preston to sell the smaller parcel. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the hereinabove des- cribed parcel of land owned by Vernon Preston be, and hereby is, exempt from the definition of the terms , "subdivision" and "sub- divided land" . BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the applicant submitting a mylar plat to the Department of Planning Services Office to be recorded in the office of the Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2 C. (4) of the Weld County Subdivision Regulations. The parcel of land on which this request is being made is described as Part of the South 1/2, Southeast 1/4, Section 7, Township 2 North, Range 62 West of the 6th P.M. , Weld County, Colorado. The property is located two (2) miles southeast of Roggen on Weld County Road 22. The property contains approximately 54 acres of Class IVe irrigated and 37 acres of nonirrigated soils. The request is to divide the property into parcels of 13 acres and 77 acres, more or less. This recorded exemption is a request from Mr. Preston to help alleviate his debt. Mr. Preston would like to sell the 13 acre tract. It would be used as pasture land. The remaining acreage would be retained by Mr. Preston as part of his farm operation. Based upon the submitted information and policies of the County, the Department of Planning Services staff recommends the request be approved for the following reasons: 1. The request complies with Section 9-2 C of the Weld County Subdivision Regulations submission requirements. 2. The request complies with Section 9-2 E of the Subdivision Regulations as follows: @109°1 Board of County Commissioners Page 2 October 10, 1983 - The 90 acres, more or less, under consideration will be compatible with the existing surrounding land uses. The uses under consideration are consistent with the intent of the zone district in which the uses are located. - The proposal is in compliance with Section 1-3 of the Weld County Subdivision Regulations and the proposed land division complies with the Weld County Comprehensive Plan; therefore, the proposed use is consistent with efficient and orderly development. - The proposal does not exist in an overlay district area. - The proposed lots meet minimum lot size requirements for land division. - The proposed lots are not part of a recorded exemption within the last five (5) years. - The two lots proposed will have adequate access from Weld County Road 22. The Department of Planning Services staff recommendation for approval is conditional upon the following: 1. The applicant submitting a mylar plat to the Department of Planning Services office to be recorded in the office of the Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2 C. (4) of the Weld County Subdivision Regulations. J es R. l r-eyrrer t Planner @30901 September 1 , 1983 TO WHOM IT MAY CONCERN: Having given much thought and consideration to my extended future , I have decided that it would be wise to sell the main home on my farm at Roggen, Colorado. Several reasons for this decision are as follows : First, my family needs no longer fit a house of that magnitude , as at the present time I am a single person. Second, the economics of the large home is extreme for my needs. Third, I find economically the farm would be in a much sounder position by selling the home and the ground on which it sets. Fourth, I have another building site that would be much more workable and on which a smaller home could be constructed very nicely. Fifth, this proposed adjustment would have no adverse effect on the production potential of the farm in regard to agriculture and as far as well location, should a problem arise I will hold an easement right on the sold parcel for both well and pipeline. My plans include a new venture into the marriage state and of course this appeals to both of us. I would appreciate your prompt help and approval on the matter as I have a person interested in purchasing the property described above within a very short time.
