RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL AND ACCEPT
REPLACEMENT COLLATERAL FOR INDIANHEAD SUBDIVISION, S #97 - SCENIC
RANGE, LLC
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated January 19, 1976, the Board did approve the
application of Interladco, Inc., for a Final Plat for Indianhead Subdivision on the following
described real estate, to wit:
NE1/4 of Section 18, Township 5 North, Range 67
West of the 6th P.M., Weld County, Colorado, and
WHEREAS, on February 12, 2001, the Board of County Commissioner of Weld County,
Colorado, did approve an Improvements Agreement According to Policy Regarding Collateral
for Improvements (Public Road Maintenance) for Indianhead Subdivision, S #97, between the
County of Weld, State of Colorado, by and through the Board of County Commissioners of
Weld County, and Interladco, Inc., with terms and conditions being as stated in said agreement,
and accepted Irrevocable Letter of Credit #115, drawn on the American Bank, in the amount of
$679,500.00, and
WHEREAS, at the request of the current property owner, Scenic Range, LLC, 1542
Westshore Drive, Loveland, Colorado 80538, on May 14, 2001, the Board of County
Commissioners of Weld County did release Irrevocable Letter of Credit#115 and accepted as
replacement Irrevocable Letter of Credit#117, drawn on the American Bank, 300 East 29th
Street, Loveland, Colorado 80538, in the amount of $471,400.00, and
WHEREAS, staff from the Weld County Departments of Public Works and Planning
Services have conducted a visual inspection and recommend reduction of said collateral to the
amount of $13,000.00 to insure the completion of landscaping ($6,000.00) and a grass-lined
swale ($7,000.00), and
WHEREAS, Scenic Range, LLC, has presented Irrevocable Letter of Credit#122, drawn
on the American Bank, 300, East 29th Street, Loveland, Colorado 80538, in the amount of
$13,000.00.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Irrevocable Letter of Credit#117, drawn on the American
Bank, in the amount of $471,400.00 be, and hereby is, canceled and released.
BE IT FURTHER RESOLVED by the Board that Irrevocable Letter of Credit#122, as
described above be, and hereby is, accepted.

BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby
is, directed to return said collateral to the appropriate issuing party.

On May 14, 2002, the Department of Planning Services preformed a site investigation of the
completed improvements for the Indian Head Subdivision at the request of Leroy Gabriel and
Larry Heckel, applicants. Completed improvements include the construction of subdivision
streets, bridges, utilities, and ditch improvements.
The Department of Planning Services is holding collateral for two non-transportation items that
includes landscaping (6,000.00) and a grass lined swale (7000.00). Both of these items appear
to have not been completed. Given this circumstance, the Department of Planning Services
recommends retaining thirteen thousand (13,000.00) and no/100s dollars until the non-
transportation related items are complete.
Don Carroll, Weld County Department of Public Works completed a Final Inspection of the
transportation related items consisting of ditch improvements and two bridge crossings.
Additional items included site grading, street grading, street base, street asphalt and the storm
water facility.
The Department of Public Works recommends to release the transportation portion of the
remaining collateral for the Indian Head Subdivision.
Therefore, the Department of Planning Services and Department of Public Works recommend
that four hundred seventy-one thousand four hundred (471,400) dollars and no/100s, be
released. Staff's recommendation is to release the collateral, in the form of a Letter of Credit.
This release is conditioned on the posting of the warranty collateral by the applicant. The
applicant shall submit a new Letter of Credit for thirteen thousand (13,000.00) and no/100s
dollars for replacement collateral.

Release of Collateral
On April 16, 2002, the two bridges were completed that provide access to the remaining parcel.
I have been watching construction and receiving test results from Landmark Engineering. I
completed a final inspection on May 13, 2002. The following items have been completed to my
satisfaction.
a. Site grading
b. Street grading
c. Street base
d. Street asphalt
e. Storm water facility
f. Ditch improvements
g. Road culverts
The ditch improvement items consisted of the two bridge crossings. Completion was done and the
collateral was released on April 16, 2001.
I have notified Landmark Engineering that all the transportation items were complete except the
additional signage needed. Still missing are the street signs identifying Apache Road and Hopi
Trail, and a stop sign at both intersections. Reid Bond from Landmark Engineering indicated that
those signs would be installed.
I recommend release of the transportation portion of the remaining collateral on the Indianhead
Subdivision S-97.
All other non-transportation items shall be verified by Planning Services prior to release.

This letter of credit is automatically extended without amendment,for additional one year periods from the current expiration or any future
