Dear Mr. Anderson:
We have reviewed the above referenced proposal to subdivide a 28.9-acre
parcel into 7 single-family residential lots. The proposed water source is the Left Hand
Water District (District). Paragraph E of the summary memo from the applicant to your
office dated May 24, 2001 claimed to have attached a letter from the District pre-
approving the water taps for six (instead of seven) new lots, however, our package of
information contained no such letter. The application also did not include a Water
Supply Information Summary.
The District's normal mode of operation is to charge fees for the water supply on
a per tap basis payable prior to activation of the tap. Based on current records on file in
this office, the District currently has an adequate uncommitted water supply to provide
the water associated with this project.
Pursuant to Section 30-28-136(1)(h)(II), C.R.S., the State Engineer offers the
opinion that on the condition the Left Hand Water District is, in fact, committed to supply
the subdivision with water, the proposed water supply can be provided without causing
material injury to existing water rights and expects the supply will be adequate.

Dear Mr. Anderson:
Colorado Geological Survey has completed its site visit and review of the above-referenced project.
I visited the site on June 28, 2001. I understand the developer plans to subdivide this 28.59-acre
parcel into 7 residential lots of 3 to 3.5 acres with 4.75 acres of open space. Individual sewage
disposal systems (ISDS) are planned.
I reviewed the Preliminary Geotechnical Engineering Report prepared by Terracon, dated March 20,
2001. The report evaluates potential site development constraints and makes general construction
and septic system recommendations. While I concur with the recommendations in the report, I have
several comments:
1. Lignite Lignite lenses were observed in claystone samples collected from two of the borings.
Lignite and its associated gases are flammable,and therefore potentially very hazardous. If
basements are founded in lignite-bearing formations,gases can seep into the living space and create
a health hazard. The depth and thickness of lignite-containing units should be identified and
overexcavated during grading.
2. Oil and Gas Well(s). An oil/gas well is located on proposed lot 6. A setback of 150 feet from all
wells,tanks and production facilities will need to be incorporated into the building envelope.
The surrounding neighborhood should be evaluated, using the proposed final density of homes at
build-out,to determine if it meets the Colorado Oil and Gas Conservation Commission's
definition of a high-density area. The oil/gas well(s), pump(s), processing facilities and tank •
batteries would then need to be fenced and locked,with warning signs posted to protect residents
from hazards associated with the machinery and potentially tainted soils. Prospective residents
should be advised and a plat note should be included informing buyers that the oil/gas well
pumps and related equipment may be loud, may pose a visual nuisance, and will require ongoing
servicing and maintenance. Potential buyers of this lot should be made aware that access must
be provided to the operator of the well(s).
3. Groundwater Groundwater was observed at depths of 11 to 16 feet in three of the borings
drilled by Terracon. Since groundwater levels tend to rise seasonally and perched water can
form as a result of landscape irrigation and increased runoff, foundation drains will be necessary

around all basement areas. I agree with the drain system recommendations presented on page 9
of Terracon's report.
4. Foundation and ISDS Design The site soils exhibit varying strengths, water contents, relative
densities and percolation rates. Laboratory testing indicates that the soils possess low to
moderate collapse/settlement potential, and the underlying bedrock is low to moderately
expansive. Given the variability in soil thickness and soil and bedrock engineering properties, I
agree with Terracon's statement(page 1)that"a design level geotechnical exploration will be
required on each building site in order to provide specific design and construction
recommendations for foundations, floor slabs and septic systems."

1. Building permits shall be obtained prior to any construction. A separate permit will be
required for each structure. Structures shall be separated from each other in accordance with
the provisions of Chapter 5 of the 1997 Uniform Building Code.
2. A plan review will be required for each building. Two complete sets of plans are required
i—. when applying for the permit.
3. Buildings shall conform to the requirements of the 1997 UBC, 1998 IMC, 1997 IPC, 1999
NEC and Chapter 29 of the Weld County Code.
4. Each building will require an engineered foundation based on a site-specific geotechnical
report or an open hole inspection performed by a Colorado registered engineer. Engineered
foundations shall be designed by a Colorado registered engineer.

The Weld County Health Department has reviewed this proposal. The applicant proposes a 7 lot PUD on 28.6
acres. The minimum lot size is 3.2 acres with an overall density of one septic system per 4.1 acres does meet
current Department policy.
The application has satisfied Chapter 27 of the Weld County Code in regard to water service. Water will be
provided by Left Hand Water District and sewer will be provided by individual sewage disposal systems. A
letter of agreement from Left Hand Water District was provided in the application materials.
The application has satisfied Chapter 27 of the Weld County Code in regard to sewer service. Sewer is
proposed to be provided by individual sewage disposal systems. Preliminary percolation data included in the
sketch plan application indicates the area in the vicinity of Lot 5 will require an engineered system due to
unsuitable percolation rates. The preliminary data indicates that the other sites will be suitable for
conventional septic systems.
The Department recommends approval with the following conditions:
1. Water service shall be obtained from the Left Hand Water District.
2. A Weld County Septic Permit is required for each proposed septic system and shall be installed
according to the Weld County Individual Sewage Disposal System Regulations. Each septic
system shall be designed for site-specific conditions, including but not limited to maximum seasonal
high groundwater, poor soils, and shallow bedrock.
3. Stormwater from and/or through the equestrian center must be contained on the equestrian center
lot. Management of manure and stormwater must comply with Best Management Practices
(BMP=s) in the Confined Animal Feeding Operations Control Regulations.
4. The applicant shall obtain a storm water discharge permit from the Water Quality Control
Division of the Colorado Department of Public Health and the Environment, if required. Silt
fences shall be maintained on the down gradient portion of the site during all parts of the
construction phase of the project.
5. During development of the site, all land disturbances shall be conducted so that nuisance
conditions are not created. If dust emissions create nuisance conditions,at the request of the
Weld County Health Department, a fugitive dust control plan must be submitted.
6. In accordance with the Regulations of the Colorado Air Quality Control Commission any
development that disturbs more than 5 acres of land must incorporate all available and
practical methods which are technologically feasible and economically reasonable in order to
minimize dust emissions.
7. If land development creates more than a 25-acre contiguous disturbance, or exceeds 6
months in duration, the responsible party shall prepare a fugitive dust control plan,submit an
air pollution emissions notice, and apply for a permit from the Colorado Department of Public m Health and Environment. _ aa

The Public Works Department has reviewed this Change of Zone application. Comments made
during this phase of the subdivision review process may not be all-inclusive, as other concerns or
issues may arise during the remaining application processes.
COMMENTS:
Roadways:
The Summit at Mountain View development will be accessed through Carmacar Ranchettes. All
the streets in Carmacar are unpaved. Weld County Public Works has received numerous
complaints about road conditions and dust for many years from the residents of Carmacar. When
the Peaks at Mountain View (a five lot development south of and adjacent to the Summit at
Mountain View) was approved by the Board of Weld County Commissioners, a Road
Maintenance and Improvements Agreement was required. It made the applicant responsible for
providing dust suppression chemicals during the time the development is under construction. A
copy of the Agreement is attached. The applicant for the Summit at Mountain View should be
required to do the same.
All PUD roadways require paving. A letter dated October 10, 2001, by John Myers, P.E.,
requests an exception to the requirement. As stated above, current residents of the area complain
about dust and road surface conditions. At their request, I have worked with residents of
Carmacar and the Peaks at Mountain View in an effort to form an improvement district to pave
their roads. The initial effort was not successful; however, I am certain it is only a matter of time
until a district is formed because the majority of residents are not satisfied with the level of
service a gravel road provides. This portion of the County is rapidly growing with residential
development being the major influence that is determining the character of the area. The request
to wave the paving requirement should be denied and Summit Way should be paved. The
Typical Street Section shown on the Change of Zone Plat is acceptable. The paving cross section
and a road construction plan can be submitted at the final plat stage.

In the Road Improvements agreement, the applicant should be required to participate in a
Carmacar improvement district to pave Fir Avenue and Mountain View Street between Summit
Way and WCR 5, which would provide a paved access to Summit Way. The amount of
participation should be based on the traffic generated by the Summit at Mountain View
proportionally with the background traffic on Mountain View Street.
All landscaping in the intersection sight triangles must be less than 3.5 feet above the road level
at maturity.
The right-of-way for Summit Way is shown correctly and should be dedicated to Weld County
on the final plat.
Storm Water:
A drainage report was submitted by Foothills Engineering, dated October 12, 2001. The basic
drainage concept is acceptable; however, more detailed information will be required at the final
plat submittal. That information entails delineating offsite and onsite basins with specific
historic and proposed runoff data for each, routing to the detention pond, detention pond
construction detailing including dimensioning of the outlet structures, and routing of detention
pond discharge to existing drainage features.
RECOMMENDATION:
I recommend approval with the following conditions:
1. A Road Maintenance and Improvements Agreement be submitted that addresses dust control
and participation in a Carmacar improvement district for paving.
2. Summit Way shall be paved in accordance with PUD requirements.

This proposal specifically indicates that the access road and the road within the
subdivision will remain private. If the road remains private, everyone should be informed that
the Sheriffs Office has significant limitations regarding traffic enforcement on private roads in
the event speeding or other use which may not conform to traffic laws on public roads. Private
roads are require specific provisions for maintenance, particularly from heavy snowfall and/or
drifting, which is not described in this proposal.
All individual addresses must be prominently displayed at the individual residence's
access to aid emergency responders particularly during the hours of darkness.
The Sheriffs Office is very supportive of homeowner's associations that require annual
fees in order to maintain, develop, and enforce covenants. We are better able to address
neighborhood issues that may develop with an existing neighborhood governing body. There is
no mention of this issue in this proposal. There is an oil well and tank battery within this
development. These need to be fenced off in order to mitigate the potential for tampering. These
facilities are known to create an attractive nuisance for young people. Tampering not only
creates significant danger to the safety but also environmental damage with extensive litigation
and clean-up costs.
No lighting is shown on the street named Summit Way. The Sheriffs Office requests that
lighting be brought up to county standards so that the road be well lit. The Sheriffs Office lacks
the ability to absorb any additional service demand without the resources recommended in the
multi-year plan provided to the Board of County Commissioners or as indicated by growth not
considered at the time the plan was developed. I have no other comments on this proposal.

Dear Trudy:
Thank you for referring Summit at Mountain View Change of Zone to the School District. The District has
reviewed the development proposal in terms of future student impacts and available school capacity and has
the following RECOMMENDATION: the District is OPPOSED to the approval of this application due to this
development's impact on already overcrowded school facilities.
The Board of Education has established a district-wide policy of opposing new developments that add to the
student enrollment of schools projected to be at or above 125% of their capacity. This particular application,
which is currently located in the Erie Elementary and Erie Middle/Senior High feeder, will add 6 new single-
family dwelling units with a potential impact of 4 additional students in this feeder. The District opposes this
development because, as indicated in the chart below, Erie Elementary and Erie Middle/Senior High schools
will exceed 125% of their capacity with the addition of students from this development. The District may
reconsider this opposition should the developer wish to discuss how the development can be better timed to
coincide with the District's construction of new facilities, or if other mitigation measures can be taken to
accommodate this development's contribution of new students in light of school capacity shortfalls.

The recommendation of the District noted above applies to the attendance boundaries current as of the date of
this letter. Residential growth and new school facilities could affect the projects attendance area in the future.
As of this time, there are no anticipated boundary changes or facility expansions that would warrant a change
in the current attendance areas.
Should the County decide to recommend approval of this development proposal, the School District's cash-in-
lieu and/or land dedication requirement would still need to be satisfied. This requirement involves the
dedication of land with the adjacent infrastructure or payment of an equivalent cash-in-lieu fee based on the
student yield of the development. . Although cash-in-lieu fees are insufficient to help provide for construction of
schools and resolving capacity shortages, it does assist in the purchase of land for future school sites. Since
this property is not a likely future school site, the fee would be assessed per the attached chart. Also,
transportation would most likely be provided for this site. Please let me know of any further questions.
