HomeMy WebLinkAbout20020317 RESOLUTION RE: APPROVE LEASE FOR ALTERNATIVE PROGRAM TO RESIDENTIAL TREATMENT CENTER AND AUTHORIZE CHAIR TO SIGN - SAVIO HOUSE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Lease for an alternative program to Residential Treatment Center between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Social Services, and Savio House, commencing February 4, 2002, and ending April 4, 2002, with further terms and conditions being as stated in said lease, and WHEREAS, after review, the Board deems it advisable to approve said lease, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Lease for an alternative program to Residential Treatment Center between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Social Services, and Savio House be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said lease. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 6th day of February, A.D., 2002. Griego, Director, Social Services _,ttetk3 a RE: Lease Between Savio House and the Board of County Commissioners of Weld County, Colorado Enclosed for Board approval is a Lease between Savio House and the Board of County Commissioners of Weld County, Colorado. Savio House has been contracted by the Weld County Department of Social Services to provide an alternative program to Residential Treatment Center care. The major provisions of the Lease are as follows: 1. The term of the Lease is February 4, 2002 through April 4, 2002. 2. The Lease allows Savio House to locate its operation in the Annex Building of the Weld County Department of Social Services. For this period, Savio House will not be charged rent. At the conclusion of the Lease, Savio House will relocate to a different location. 3. Savio House agrees to pay costs associated with utilities, trash removal, telephone, and incidentals including photo copying. If you have any questions, please telephone me at extension 6510. 2002-0317 LEASE THIS LEASE, made and entered into this 411 day of February 2002, by and between the COUNTY OF WELD, a political subdivision of the State of Colorado, whose address is 915 1011 Street, Greeley, Colorado 80631, hereinafter referred to as "Lessor," and the Savio House, 325 King Street, Denver, Colorado 80219, hereinafter referred to as "Lessee". WITNESSETH: That in consideration of the keeping and performance of the covenants and agreements by Lessee, hereinafter set forth, Lessor hereby leases unto Lessee the following described premises, situated in the County of Weld and in the State of Colorado, two cubicles, one office to-wit: located in the Weld County Department of Social Services building at 315 North 11`h Avenue, Greeley, Colorado, hereinafter referred to as "the Premises." Furthermore, the Lessee, in consideration of leasing of said premises as aforesaid, covenants and agrees as follows: a. There will be no rent charged to the Lessee by the Lessor for use of the aforesaid premises as herein provided; b. To use ordinary care when using the improvements upon the Premises; c. To sublet no part of the Premises. d. To use the Premises for no purpose other than conducting the business and duties as a CORE service provider for the Lessor. e. To keep the Premises clean, and in the sanitary condition required by the Ordinances and the Health and Police Regulations of the City of Greeley and/or the County of Weld; f. To allow Lessor at any reasonable hour of the day to enter into or upon and go improvements or equipment therein. Furthermore, the parties hereto agree as follows: 1. That all costs for utilities and trash removal shall be paid for by Lessor; 2. That no assent, express or implied, to any breach of any one or more of the covenants or agreements hereof shall be deemed or taken to be a waiver or any succeeding or other breach; 3. That Lessee agrees to indemnify, save, and hold harmless Lessor from any and all loss, injury, or damage whatsoever, incurred by Lessee as the result of fire, flood, inclement weather, or other casualty, other than by negligence of the Lessor; 4. That Lessee shall own and maintain the filing cabinets, computer systems including computers, modems, printers, and associated computer equipment. 5. That Lessee shall be responsible to keep the Premises in a clean and tidy condition. 1 00;2- G 317 6. The lessee shall pay for use of the telephones and all incidentals including photo copying. 7. That the duration of the lease agreement shall commence on February 4, 2002, and terminate on April 4, 2002. IT IS EXPRESSLY UNDERSTOOD AND AGREED by and between the parties herein, that it shall and may be lawful for the Lessor to declare said term ended and enter into the Premises, or any part thereof, either with or without process of law, to reenter, and Lessee or any person or persons occupying the same, to expel, remove, and put out, using such force as may be necessary in doing so, without being liable to prosecution or any damage therefor, and the Premises again to repossess and enjoy, is in the first and former estate of the Lessor and if at any time said term shall be ended as aforesaid or in any other way, the Lessee hereby covenants and agrees to surrender and deliver up the Premises peaceably to Lessor immediately upon the termination of said term, and if the Lessee shall remain in possession of the same after the termination thereof, Lessee shall be deemed guilty of a forcible detainer of the Premises under the statute, hereby waiving all notice, and shall be subject to eviction and removal, forcibly or otherwise, with or without process of law, as above stated. IT IS FURTHER EXPRESSLY UNDERSTOOD AND AGREED that all the covenants and agreements in this Lease contained shall extend to and be binding upon the heirs, exactors, legal representatives, and assigns of the respective parties hereto.
