(Department of Planning Services) 10) Section 26-2-70.O.2, states "that portion of a lot in any zone district which abuts a public or private road right-of-way shall be landscaped with a minimum two-and-one- half-inch caliper shade tree or six-foot minimum height coniferous tree at a distance of ten (10)feet, measured at a right angle from the lot line towards the interior of the lot, for every forty (40) linear feet of street frontage. Trees may be grouped with a maximum distance of one hundred (100) feet between trees or groupings, with exceptions made at entrance drives." Further, refer to Section 19-3-340.F of the Weld County Code. (Department of Planning Services) 11) Section 26-2-70.D.2.g states "there shall be a minimum twenty-foot-wide landscape setback measured from the existing or planned future right-of-way to any parking lot, fencing, storage area or structure. Required landscaping and screening within the landscape setback and other portions of the property shall be governed by the landscape standards contained within Section 26-2-70 of the Weld County Code." (Department of Planning Services) 12) Section 26-2-70.8 3.c.5 states "All landscapes shall strive to maximize the use of native species. Where native material is not appropriate for the intended use or appearance, plant species that are regionally adapted and noninvasive shall be used.". (Department of Planning Services) 13) Section 26-2-70.8 3.c.6 states"fescue,brome/fescue or other turf types shall be used in lieu of bluegrass where heavy foot traffic is not anticipated. Seeding versus sodding of all turf types is preferred when the growing season allows for adequate germination and establishment of the turf to sufficiently control erosion." Required parking for the Lucht's Concrete facility shall be fourteen (14) parking spaces plus one van accessible handicapped, parking space,further, per Appendix 23-A of the Weld County Code,parking spaces with a degree angle of 90 degrees shall be at a minimum of nine (9) feet wide by nineteen (19)feet long with a twenty-four(24) foot wide travel aisle. Parking for the outdoor storage facility has not been addressed. (Department of Planning Services) 16) This site will be required to meet all requirements of the Americans with Disabilities Act. ADA parking spaces are twenty (20)feet in length by eight(8)feet in width with five (5)foot aisles. One of the ADA spaces shall be van accessible with dimension at twenty (20) feet in length by eight (8) feet in width with eight (8) foot aisles. An • accessible path will be required from the building to the public right-of-way. The ADA spaces delineated on the Site Plan are acceptable. As delineated in SPR 274, two spaces are required for the condo style building and one for the Lucht's Concrete facility. Staff observed the following: The perimeter opaque fence has been constructed on the east side of the property, although the point of ingress and egress lack the rolling gate with opaque fence material. There is no opaque fence along the south property line, and there is not an approved fence west of the structure meeting the standard of screening the outdoor storage areas associated with this Site Plan Review. Additionally, the service yard has a semi trailer, plates not visible, a white goods machine, likely a washing machine, miscellaneous metals, wood and general components of a non-commercial junkyard as defined in the Weld County Code. A trash roll-off dumpster, Recreational Vehicle and numerous passenger vehicles, some of older vintage parked immediately south of this structure. The appearance of noxious weeds over 12 inches in height, predominately Canadian Thistle punctuate the property. Also, a large banner sign placed over the windows of the adjacent structure on this same property apparently advertising space for lease. Review of the case file does not indicate any new leases were submitted for the property, although new tenants appear to be located on-site. Photographs of this site visit are attached. Review of Case File: Plat is unable to be recorded until a new Improvements Agreement for public and private improvements to the property, as well as, replacement collateral has also not been submitted for review, approval and acceptance by Weld County Government. Outstanding issues remain with the Department of Public Works specific to drainage and construction of 1/2 street improvements to Turner Boulevard, including the internal improvements. She indicated that I still had outstanding issues with the weeds and Health and Safety, Char Davis. I have contacted the Fence company again and have a contract for them to finish the fence and build an opaque gate as soon as possible. Finally, Turner Boulevard must be constructed at this time, given the recommendation of stormwater / drainage retention on site for each property. Public Works suggests that properties adjacent to the west side of Turner Boulevard coordinate retention ponds to accommodate stormwater that may negatively impact the roadway. I met Von Honnecke at his request and several property owners in the vicinity to discuss and investigate the drainage(or lack thereof). From our discussions it was my understanding that HISTORIC drainage would make its way to a "ditch" on the east side of Turn Blvd and flow north, eventually thru what is NOW the Comfort Inn property (and I am guessing towards 1-25 and finally the St. Vrain River). I had the opportunity to meet Mr. Darrel Turner(of which Turner Blvd. is named), who is a property owner along Turner Blvd. HE stated that when the Comfort Inn was constructed (sometime in the recent past)the 'outfall'drainage ditch that crossed that property was eliminated. From visual inspection the Comfort Inn site appears to be in filled and there is no drainage path thru th property. In essence the property appears to block any drainage waters at its perimeter, which I believe has been in filled, because there is approximately one-foot of fill material retained against the adjacent property owner's chain-link fence. Regardless of the circumstances, if the HISTORIC drainage did flow to the north along the the Turner Blvd. 'ditch', it no longer does. I could find no outfall culvert, storm sewer or structure. The only options that I found were a VERY shallow concrete pan running south to north along the western boundary of the properties (between the Turner Blvd. properties and the mobile home park), and a 'ditch'cut thru a property(running west to eas on the east side of Turner Blvd. (which appears to drain the Turner Blvd. adjacent roadside 'ditch' into possible CDOT right-of- way). There are several wet spots along Turner Blvd. that appear to retain water as there is no outflow -thus causing the poor roadwa• conditions. The area is very flat with minimal topography change. After walking several properties along Turner Blvd investigatir the stormwater drainage with each owner, there appears to be limited options to move the water. Most likely, each property own will have to artificially create 'engineered'grading to direct stormwaters away from structures and property. It may be possible to drain a portion of the properties to the west into the shallow concrete pan. An investigation would be required to find out if the stormwater may be carried by the concrete pan (legally), so as not to adversely impact adjacent/ downstream properties. It may be possible to drain a larger portion of the(Turner Blvd.) properties towards (and onto)Turner Blvd. But the problem to solve would be passing the storm/drainage waters off the street, into a roadside'ditch' and then out of this'ditch'to some outfal Investigation would be required as to the engineering feasibility and the legal concerns with releasing stormwater. What would ti outfall of the Turner Blvd. 'ditch' be? Surely the historical background of the"developments"along Turner Blvd. and vicinity needs to be conducted. It is my understanding that a design for Turner Blvd. was conducted by Public Works in the past and that the stormwater/drainage flow( north to an outfall. From my initial investigation, this north outfall does not exist and does not occur from field observations considering the condition of Turner Blvd. For clarification of the record: I said this area does need to be studied to review the drainage and what options may be possible. I did NOT say that Public Works would "re-shoot"the area (and I am guessing Diane Honnecke meant survey). Public Works does not perform such activities with-respect-to development activities. Everyone discussed their concerns with the water drainage in this area. Peter Shs said he would have Public Works re-look at the area and re-shoot it. As soon as we get that information back, we will be able to continue on with the site plan. Approximately 1/2 of the mess is picked up and gone. The rest is supposed to be gone. Most notably lacking is the information regarding landscaping. Our original SPR had a plat with the landscaping drawn and described. There was a verbal agreement to postpone landscaping until Turner Blvd was built and the area drainage problem was solved. In the interim that drawing is no longer available from Weld County records. My architect, Tom Reck, of Tom Reck Associated, 1957 King Street, Denver, CO(303)561-4832, was contacted on March 26, 2002. He stated he had the drawing and would provide a copy. I have tried to contact him every three days since that time and he doesn't answer his phone. I have gone by his home/office and there is no answer. I do not know if he is out of town, or there is some emergency. I do not know how to proceed at this point. Lakewood, CO 80228 (303)987-2222 The following is in response to the additional information needed to complete AmSPR-274: Part A: There was a plat submitted and accepted with the original Site Plan answering all the landscaping questions a 1-22 and b 1-4. Our engineer, Tom Reck, has a copy of this plat. Weld county no longer has a copy, I have asked. I have called Mr. Reck repeatedly over the past three weeks to no success. He is apparently out of town or out of business. I have visited his home and there is no answer. Therefore, I am at a loss as to how to continue. This information was previously submitted and accepted. There was a verbal agreement to postpone the implementation until the road or the curbs are in place. Without a true elevation for the road(which is still unknown) it would be impossible to keep the landscaping alive. Our sincere hope is that we can complete this AmSPR and build the fence so that we are no longer in violation. Our longer term plan would be to implement construction of Turner Boulevard and to build two more buildings. We have had to wait until June of 2002 (due to a prepayment penalty clause in our mortgage). We are now prepared to re-finance. We will then be able to separate the 5 acres and build two new buildings. My point being, we plan to do more work in the very near future and will at that time have to re-submitted all planned landscaping including the new development. c. The following notes shall be attached to the plat: 1) In accordance with the Weld County Code, no land, building or structure shall be changed in use or type of occupancy, developed, erected, constructed, reconstructed, moved or structurally altered or operated in the commercial or industrial zone districts until a Site Plan Review has been approved by the Department of Planning Services. 2) The applicant would like to lease portions of the site to other parties. To this end, the applicant shall submit a copy of the lease agreement and information regarding the proposed use of the leased portion to the Weld County Attorney's office, Weld County Building Inspection Department, Mountain View Fire Protection District and the Department of Planning Services for review. Based upon the proposed use and/or impacts of the leased portion, the Department of Planning Services may require a new Site Plan Review application. The applicant will only lease to businesses that meet the guidelines of Weld County Department of Planning Services. 3)There shall be no parking or staging of trucks on Turner Blvd. The applicant has contacted Lucht's Concrete Pumping and informed them they must not park trucks on Turner. They understand the need to keep the right-of-way clear and have agreed to stop this practice. 4)All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. Lucht's Concrete Pumping has cleaned their trap and provided documentation that it is working. All waste of concrete rinsing is now flowing into their trap. Evidence attached. • • Page 2 5)No permanent disposal of wastes shall be permitted at this site. The storing of concrete blocks behind Lucht's has been terminated. 6)Waste materials shall be handled, stored and disposed of in a manner that controls fugitive dust,blowing debris and other potential nuisance conditions. The sand pile that was located behind building B has been removed and will not be replaced. Samples of the waste exhaust have been sent to the appropriate testing facilities as per Cindi Etcheverry. We are currently awaiting the results. 7)Fugitive dust shall be controlled on this site. As stated above the sand pile has been permanently removed. 8) The maximum permissible noise level shall not exceed the Commercial Zone District as delineated in 25-12-103, Colorado Revised Statutes. 9)Adequate handwashing and toilet facilities shall be proveded for the public and employees. 10) The facility shall utilized the St. Vrain Sanitation District for sewage disposal. A copy of a recent St. Vrain bill is attached. 11)The facility shall utilize the Left Hand Water District for domestic water service. A copy of a recent Left Hand Water bill is attached. 12)All pesticides, fertilizer and other potentially hazardous chemicals must be stored and handled in a safe manner. They are. 13) (Note: Check with Kim Ogle) 14) Any vehicle or equipment washing areas shall capture all effluent and prevent discharges from the washing of vehicle and/or equipment in accordance with the Weld County Code. As previously stated, a copy of certifying the effectiveness of the trap is attached. 15)Landscaping materials as indicated in the approved landscape plan shall be maintained at all times. As stated above,the landscaping will not survive without proper drainage, the drainage situation will not be improved or decisions about elevations made until Turner Blvd is built. A verbal agreement was reached to postpone landscaping until Turner Blvd is built. 16)All structures, including signs, on site must obtain the appropriate building permits. This contact shall determine if an Underground Injection Control (UIC) Class V Injection Well is required for each individual business being leased by the applicant. Adequate handwashing and toilet facilities shall be provided for employees. 7. All pesticides, fertilizer, and other potentially hazardous chemicals must be stored and handled in a safe manner. The privacy fence built along the east side of this parcel is approximately 2-3 feet from the west side of our cabinet. In order to provide safe and reliable electric service, we must have access to our equipment for routine maintenance and operations, as well as in outage or emergency situations. We need 10-12 feet clearance west of the cabinet in order to operate and maintain it. As we discussed, access to the cabinet can be accomplished by: 1. Rebuilding the fence out and around the cabinet(12 feet west) 2. Constructing a gate in the existing fence so it opens to the west 3. Rebuilding the fence along the future road right-of-way (40 feet right-of-way for Turner Blvd and 40 foot right-of-way for Weld County Road 22.5) We need to resolve this access issue as soon as possible. Please note if an outage or emergency occurs, our crews will do whatever it takes to access the equipment. This could be removal of the fence which could also cause longer power outages for the area. The correspondence requests a determination of the applicability of a CDPS permit for a lift station serving the above referenced property. It is the Division's understanding that the subject lift station is on the referenced property,receives flows from two toilets and a truck washdown area,and discharges to the Saint Vrain Sanitation District's sewer for treatment. The lift station does not qualify as a"domestic wastewater treatment works"due to the presence of industrial wastes From the truck washdown operations and that human wastes are generated incidental to the industrial process.
