Said Ground Lease was required pursuant to the requirements of a Lease Purchase Agreement and Mortgage and Indenture of Trust (the "Indenture"), both dated June 1, 2003, and recorded at Book 1340, Reception Number 02292895, and Book 1340, Reception Number 02292896, respectively. The Trustee in the transaction was The Bank of Cherry Creek,N.A.
