Dear Lifestyle Homes, Inc.:
Your application for Change of Zone#569 from the R-5 (Mobile Home Residential) Zone District
to the R-2 (Duplex Residential) Zone District has been recommended unfavorably to the Board
of County Commissioners by the Planning Commission. The legal description of the property
involved is shown as Lot B in the Hill-N-Park Subdivision, located in the S1/2 of Section 26,
Township 5 North, Range 66 West of the 6th P.M., Weld County, Colorado.
If you wish to be heard by the Board of County Commissioners, it will be necessary for you to
indicate your request by signing the bottom of this letter and returning it to this office. Regular
hearing procedures will then be followed.
In order to proceed as quickly as possible, we must receive your reply by June 20, 2002. If we
are not in receipt of your request by that date, the matter will be considered closed.

SUBJECT: Request for continuance for Z-569
The subject property, Lot B in the Hill N Park subdivision is owned by Mr. John Shupe and Mr.
Elmer Lundvall of JER partnership. JER partnership has a pending contract with Clarkson
Land, LLC (Lifestyle Homes). The current owners and potential buyers are requesting a
continuance of the July 10, 2002, hearing. Mr. Shupe and Mr. Lundvall are not going to be in
town the day of the hearing but would like to be present for input with the project. I have
suggested a continuance until July 24, 2002, and the applicants are in agreement with the
date.
The applicants are considering whether they are going to continue forward with the current
standing of the case or withdraw and start over.

Dear Carla-
Pursuant to our conversation this morning, I am writing to you to inform you that
Clarkson Land, LLC wishes to continue the hearing of the rezone application for the
above referenced project by the Board of County Commissioners until the next
regularly scheduled meeting after the July 10, 2002 meeting. The reason for this
continuance is a request by the owners to be present at the meeting to speak on
behalf of the project. The owners, Mr. Shupe and Mr. Lundvall, will be out of town
next Wednesday, but still desire to be heard on this matter. Please make the
appropriate arrangements so that the Owner's may be present for the hearing of this
rezone application.

SUBJECT: Request to withdraw Z-569
The Department of Planning Services has received a letter from Elmer Lundvall and John
Shupe from J.E.R. partnership regarding Z-569. The letter states that the contract between
J.E.R. and Clarkson Land (Lifestyle Homes) is not valid. Mr. Lundvall and Mr. Shupe have
been in contact with Clarkson Land regarding this issue. Billy McDivitt from Clarkson Land has
faxed a memo formally withdrawing the pending re-zone application. The Department of
Planning Services is requesting the case be closed due to the circumstances stated above.
