The Weld County Public Works has reviewed this proposal; this project falls primarily under the purview of the Use
by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments
and requirements are as follows:
COMMENTS:
WCR 25.5 is designated on the Transportation Plan Map as a local gravel road, which requires a 60-foot right-of-
way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant
to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required
setback is measured from the future right-of-way line.
Parking: The existing building and concrete parking area on Lot A meets the off-street parking requirements.
Utilize the designated parking areas shown on the plat.
REQUIREMENTS:
The Weld County Public Works Department recommends approval of this application.
Off-Street Parking/Access Drive: The off-street parking spaces including the access drive shall be surfaced
with gravel, asphalt, concrete or the equivalent. It shall be graded to prevent drainage problems.
Storm Water Drainage: The existing drainage pond is adjacent to WCR 25.5 on Lot A. The applicant needs to
define this drainage pond in the field to catch and release at the historical rate.
Existing Access: The applicant shall utilize the existing access from WCR 25.5. The state has requested that
the access point be closed to US Highway 85, which the applicant has closed off with a fence. There is a residence
that utilizes the same access point. Continue to utilize this shared access.

Environmental Health Services has reviewed this proposal for a slide in truck camper sale,
indoor storage of slide in truck camper parts, embroidery/sewing of slide in slide in truck camper
cushions, hats and jackets and sales of hats and jackets. We have no objections to the proposal,
however, we do recommend that the following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be recorded:
1. The septic system serving the embroidery/sewing shop shall be reviewed by a Colorado
Registered Professional Engineer. The review shall consist of observation of the system
and a technical review describing the systems ability to handle the proposed hydraulic
load. The review shall be submitted to the Environmental Health Services Division of the
Weld County Department of Public Health and Environment. In the event the system is
found to be inadequately sized or constructed the system shall be brought into
compliance with current Regulations.
2. The applicant shall submit a waste handling plan, for approval, to the Environmental
Health Services Division of the Weld County Department of Public Health &
Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should include
expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including the
facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as development
standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities
Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a

manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not meant to
include those wastes specifically excluded from the definition of a solid waste in the
Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive
dust, blowing debris, and other potential nuisance conditions.
4. Fugitive dust shall be controlled on this site.
5. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.
6. All pesticides, fertilizer, and other potentially hazardous chemicals must be stored and
handled in a safe manner in accordance with product labeling.
7. The applicant shall operate in accordance with the approved "waste handling plan".
8. Adequate handwashing and toilet facilities shall be provided for employees and patrons
of the facility.
9. A permanent, adequate water supply shall be provided for drinking and sanitary purposes.

1. A separate building permit for each building shall be obtained for the change of use for the
building.
2. A plan review is required for each building. Plans shall bear the wet stamp of a Colorado
registered architect or engineer. Two complete sets of plans are required when applying for
each permit.
3. Buildings shall conform to the requirements of the 1997 UBC, 1998 IMC, 1997 IPC, 1999
NEC and Chapter 29 of the Weld County Code.
4. Wall and opening protection and limitations shall be in accordance with UBC Table 5-A.
Separation of buildings of mixed occupancy classifications shall be in accordance with UBC
Table 3-B and Chapter 3. Setback and offset distances shall be determined by the Zoning
Ordinance. Fire sprinkler requirements shall be in accordance with the Fire Code and Chapter
9 of the 1997 Uniform Building Code.
6. Building height shall be measured in accordance with the 1997 Uniform Building Code for the
purpose of determining the maximum building size and height for various uses and types of
construction and to determine compliance with the Bulk Requirements from Chapter 27 of the
Weld County Code. Building height shall be measured in accordance with Chapter 23 of the
Weld County Code in order to determine compliance with offset and setback requirements.
Offset and setback requirements are measured to the farthest projection from the building.
7. A Hood Hazard Development Permit shad be submitted for buildings constructer; within the
100-year flood Clain.

Dear Mr. Gathman:
We have reviewed the above referenced proposal for a site specific development
plan and special use permit for a use by right or a use by special review in the commercial
zone or industrial zone district. The State Engineer's office through a Memorandum dated
August 7, 1995 inform the counties that effective August 31, 1995, this office will no longer
respond to land use actions that do not involve the subdivision of land as defined in
Section 30-28-101(10)(a) C.R.S. (see-attached memorandum). These actions include but
are not limited to lot line adjustments, zone change request, special use land and division
by exemption. This referral does not appear to qualify as a "subdivision" therefore the
material submitted to this office is hereby returned.

This memorandum is to inform you of procedural changes in providing "an opinion regarding
material injury likely to occur to decreed water rights by virtue of diversion of water
necessary or proposed to be used to supply the proposed subdivision and the adequacy of the
proposed water supply to meet requirements of the proposed subdivision", as required under
section 30-28-136(h)(T), C.R.S. (1986 Repl, Vol.).
In June of 1992, HB92-1156, required that recommendations be made within 21 days after
the mailing by the county. No additional staff was allocated to implement this accelerated
review. I find that with the increased development activity in the state, my staff cannot
respond in a timely manner to all of the land use referrals we receive.
Therefore, in order to allow our timely comments on all SUBDIVISION OF LAND referrals
as mandated by section 30-28-136(h)(I) C.R.S., effective AUGUST 31, 1995, THIS
OFFICE WILL NO LONGER RESPOND TO LAND USE ACTIONS THAT DO NOT
INVOLVE 1'Hh SUBDIVISION OF LAND AS DEFINED IN SECTION 30-28-101-
(10)(a) C.R.S. (1986 REFL. VOL.). These actions include but are not limited to lot line
adjustments, zone change requests, special use of land, and division by exemption. After
August 31, 1995, we will not respond to or maintain records on any referral we receive that
does not address the subdivision of land as defined in section 30-28-101(10)(a) C.R.S.
Enclosed is a "Water Supply Information Summary" form which as of August 31, 1995 we
will require to be submitted along with each subdivision referral in order for us to be able to
respond in a timely manner. I ask that you provide copies of this form to all future
subdivision applicants along with your application package. The data required for this

The Sheriff's Office has no major concerns in reference to this specific development
plan and special use permit. The Sheriff's Office would, however, like to be afforded the
opportunity to meet with the applicants to discuss safety and security issues of their business.
