Box 758 Greeley, CO 80632 RED,"._,'S✓ RE: Violation of Intergovernmental Agreement Dear Commissioners: It is my understanding that the Town of Milliken annexed the majority of S27-T4N-R67W sometime last year— I do not know the exact date of that annexation. After reading the Intergovernmental Agreement (IGA) between Milliken and Weld County that was in effect at the time of that particular annexation and after talking to Weld County Attorney Bruce Barker, I also understand that before Milliken could annex that property, Milliken, in conjunction with Weld County, had to amend their IGA and Milliken's Urban Growth Area(UGA) boundary to include that particular property— S27-T4N-R67W. When I downloaded Chapter 19 of the Weld County Code, which includes the IGAs and the accompanying IGA maps, it is very clear that Milliken's UGA did not include S27-T4N-R67W, now known as Somerset Ranch. When I re-contacted your attorney today, Mr. Barker could not remember any amendment to Milliken's UGA since the IGA was entered into by Milliken and Weld County. Therefore, it appears that Milliken violated their IGA with Weld County. Milliken's violation of their IGA with Weld County in the above mentioned improper annexation has far-reaching effects. The Platte Trust (property owned by Tom Sharkey and !Crystal (Hoffschneider) McCoy) has applied to Milliken for annexation and conservancy district rezoning in order to circumvent the Weld County Commissioner's denial of a gravel mining permit on October 10, 2001. The improper annexation of S27-T4N-R67W by Milliken, gives the Platte Trust property enough adjacent perimeter to claim that the Platte Trust property has 1/6 contiguity to Milliken's city limits in order for the Platte Trust property to qualify for annexation when, according to the provisions of the IGA, the Platte Trust does not have 1/6 contiguity. Because Milliken's improper annexation of S27-T4N-R67W violated their IGA with Weld County, I respectfully request that the Weld County Commissioners look into this matter, and I also request that the Weld County Commissioners overturn the improper annexation of S27- T4N-R67W. If my request needs to be submitted in the form of an appeal, I hereby appeal Milliken's improper annexation of S27-T4N-R67W. Thank you for your time and consideration in this matter.
