HomeMy WebLinkAbout20022772.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST THEODORE AND MARION KOOLSTRA FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Theodore and Marion Koolstra, VI #0200423, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 15th day of October, 2002, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Theodore and Marion Koolstra, property owners, were present at said hearing, and WHEREAS, the Board deems it advisable to bring legal action against those individuals named above to correct said violation. You have stated on several occasions that while you are not sure what the structure is to be utilized for,it will be used for a church building or some other type of commercial building. In order for this to occur,in either direction,a Use by Special Review permit shall be obtained. Additionally,as we have previously discussed, this structure is located within the Windsor Road Impact Fee area. Lastly,upon speaking with the City of Greeley (Water Division),water for any such use would NOT be permitted. Greeley has suggested that you contact the City of Windsor,to see if they would support such an option(they may require annexation). -Another barn. We have received complaints regarding an additional barn that has already been converted into a dwelling unit. This is not an allowed use and the barn shall be restored, for this a new building permit shall he obtained. In alternative,you could•apply for another Use by Special Review for more than I (one)dwelling unit. However,again,there would be issues with the Road impact fee. The Department of Planning Services' staff will be recommending that the Board of County Commissioners authorize the County Attorney to proceed with legal action to remedy the violation. To: Trudy Halsey August 15, 2002 COLORADO From: Jeff Reif, Building Official Crk Subject: Koolstra Stop Work I met Mr. and Mrs. Ted Koolstra in the office today. I explained the definition of an Ag Exempt building to them and told them what uses an Ag Exempt building may be used for. I also informed them that they need to have a USR approved before they could apply for a building permit in the event they wanted to convert the building to another use, such as a church. Mr. Koolstra told me that he intends to use this building as an Ag Exempt building (understanding the limitations that an Ag Exempt use imposes on him) and he asked if he could continue to install EXTERIOR materials (siding and/or brick) in order to protect the building from the weather. I told him that he could install EXTERIOR MATERIALS in order to protect the building from the weather, but he had to understand that if he tries to permit the building for another use, he runs a risk that some of the exterior material may need to be removed so the structure can be inspected. Further, I told him that the water line must be cut and/or removed since water is not allowed in an Ag Exempt building. The Board's approval was for one water tap to serve one single family dwelling, as well as a dairy operation on the property. The property owner does not have City of Greeley approval to connect any other dwellings (or apartment units) nor approval to install new water service lines to other types of buildings on this property. The property owner is currently in violation of City ordinances. The potential noncompliance with the Weld County Code is the initial construction of an "Agriculturally Exempt Structure" changed into a church. By your own statement, 2 (two)days after initial construction of the barn, the plans were changed into a church or commercial building. As a result, a new building permit and a Use by Special Review application shall be completed and submitted. For questions regarding the Use by Special Review application, I would suggest that you come to the office and speak to one of our "On-Call Planners" (Wednesday, 7:30 a.m.-4:00 p.m. or Monday or Friday, 12:00 p.m. - 4:00 p.m.) Additionally,please be advised that we have opened another location to better serve the public. Our other office is located at 4209 WCR 24.5(East of I-25 and North of Highway 119). The Southwest office is open on Tuesdays and Thursdays, 8:00 a.m. - 4:00 p.m.. No appointment is necessary at either location because individuals are seen in the order they sign in. Box 1555 Greeley, CO 80631 RE: 30126 Highway 257, Windsor, Colorado Dear Ms. Salzman: As you are aware, Mr. Ted Koolstra, owner of the property referenced above, has recently built a church/coimnercial building on approximately 6.3 acres south of Windsor. In 1982 the Greeley City Council approved the sale of a 3/4-inch water tap because of special hardship circumstances, specifying its use as agricultural; i.e., for a dairy operation and an existing residence. The City Council did not grant, nor imply, to Mr. Koolstra that he acquired the right to serve additional buildings on his property without first purchasing water taps to serve them. It is my understanding that Mr. Koolstra has not operated a dairy on this site for a number of years. When City staff first discovered that Mr. Koolstra had converted part of his barn into a residential living unit, people were already living in the unit. With the addition of the living unit in the barn, Mr. Koolstra violated our compound tap ordinance. Notwithstanding, the addition of a fourth building will become a second violation of our compound tap ordinance. Outside City water customers must also abide by Greeley's ordinances and policies, as do our customers inside the City limits The Town of Windsot may be interested in supplying Mr. Koolstra's water requirements Wind•.or has a water distribution stubout located west o; Mr. Koolstra's property between the railroad tracks and th.e concrete batch plant.
