Attached is a copy of my May 18,2001 letter regarding concerns expressed by the Railroad regarding this same property Please be advised that those same concerns apply to this project. I r.ion Pacific is very concerned about unsolicited use of its property by the proposed development. We strongly urge that the developers be required to fence this project to protect our property from trespassing. Also,please be advised that the Railroad objects to having its property included within the boundaries of this development when we are in fact NOT participating in this endeavor. Sheets 2 of 6, 4 of 6 and 6 of 6 should be revised to exclude the Railroad's property from the project. In addition, sheet 4 of 6 shows a conveyor extending across the Railroad's property in Section 5. Please be advised that this use of the Railroad's property has NOT and will NOT be permitted. Therefore, it should be stricken from die plans. And finally, any existing private farm crossing(s) on the Railroad's property are just that. These crossing have been allowed and installed for agricultural use only and are NOT intended for heavy equipment, commercial or industrial use. For many years Union Pacific Railroad had entered into lease arrangements with the Kammerzell family to use the outer portions of the Railroad's property for farming, namely row crops, alfalfa or grazing. Over the years as the family ownership to the property proposed to be split has changed, those leases have been cancelled or not renewed. Yet,the family has refused to stop fanning the Railroad's property, refused to move the fences they have either installed along the Railroad or that they moved in from the common property lines to utilize the Railroad's property. The Railroad has had a number of conversations with the Kammerzells regarding its continued unauthorized use of the Railroad's property to no avail. Short of avoidable legal action, which will only tie up the County Court's valuable time,the Railroad has deemed the Kammerzell as hostile holdover tenants from these past leases. Therefore, please be advised that the Railroad is adamantly opposed to any sort of lot split which will perpetuate the unauthorized use of the Railroad's property through the sale of parcels formed by such a lot split. Environmental Health Services has reviewed this proposal for an open pit mining and materials processing, including a concrete and asphalt batch plant. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. Submit an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application to the Air Pollution Control Division, Colorado Department of Health and Environment for emissions of criteria, hazardous or odorous air pollutants. 2. If applicable, a NPDES Permit shall be obtained from the Water Quality Control Division of the Colorado Department of Health for any proposed discharge into State Waterways. 3. In accordance with the Above Ground Storage Tank Regulations (7 CCR 1101-14) a spillage retention berm shall be constructed around the tank battery. The volume retained by the spillage berm should be greater than the volume of the largest tank inside the berm. Alternative protective measures may be allowed provided they comply with the Above Ground Storage Tank Regulations. 4. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed(including the facility name, address, and phone number). The Environmental Health Division of the Weld County Department of Public Health and Environment was unable to locate a septic permit for the existing buildings represented on the submitted plan. Any existing septic system(s) located within the USR boundary that is not currently permitted through the Weld County Department of Public Health and Environment will require and I.S.D.S. Evaluation prior to issuance of the required septic permit(s). In the event the system(s)is found to be inadequate, the system(s)must be brought into compliance with I.S.D.S. regulations. 6. The applicant shall provide evidence that the facility has an adequate water supply. We recommend that the following requirements be incorporated into the permit as "development standards": 1. The facility shall operate in accordance with the approved dust control plan. The facility shall have sufficient equipment available to implement appropriate dust control. Additional control measures shall be implemented as required by the Weld County Health Officer. 2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 3. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a "solid waste" in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 4. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 5. Fugitive dust shall be controlled on this site. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in 25-12-103 C.R.S., as amended. 7. The applicant shall remove, handle, and stockpile overburden, soil, sand and gravel from the facility area in a manner that will prevent nuisance conditions. 8. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. 9. The operation shall comply with all applicable rules and regulations of the Colorado Division of Minerals and Geology. 10. All fuel tanks, septic tanks, temporary buildings, and any other hazardous items that USR-1354 Aggregate Industries We., entral Page 3 might wash away during flooding shall be securely anchored and adequately flood proofed to avoid creation of a health hazard. 11. Adequate toilet facilities shall be provided for employees. 12. Portable toilets may be utilized on sites that are temporary locations of the working face and portable processing equipment, etc. for up to six months at each location. 13. The facility shall provide an adequate water supply for drinking and sanitary purposes. 14. The operation shall comply with the Occupational Safety and Health Act (OSHA). 15. The operation shall comply with the Mine Safety and Health Act (MSHA). (USR-1354). Mike Sherman, Field Habitat biologist for the Division of Wildlife and I have reviewed the proposal and made a field visit to the project site on August 28, 2001. Mike Sherman and I reviewed and submitted comments to Norm Roche(Aggregate Industries) on a portion of this same proposal on October 11, 2000. The present plan consists of 12 Areas(225 acres)to be mined for gravel compared to the 3 areas(84 acres)that Mr. Sherman and I reviewed in September of 2000. The area within the project proposal lies adjacent to and north of the South Platte River and also includes a small section of the Big Thompson River. These waterways contain a significant amount of wetland and riparian habitat. This type of habitat is extremely important in terms of diversity and abundance of wildlife. Preble's Meadow Jumping Mouse habitat has been identified, along with the capture of this species on the property within this proposal. Ute Ladies-tresses Orchid also has the potential to exist on the riparian areas of this property. Both of these species are federally protected and the developer must contact the U. S. Fish and Wildlife Service(303-275-2370)for coordination of both species. t M DEPARTMENT OF NATURAL RESOURCES,Greg E.Welcher,Executive Director K WILDLIFE COMMISSION,Rick Enatrom,Chair•Robert Shoemaker,Vice-Char•Mina Raltopoulos,Secretary W JUNIOR Many other species including white tail deer and mule deer, waterfowl, shorebirds, raptors(including Bald Eagles),turkey, pheasant, coyote, cottontail rabbit, red fox, raccoon, beaver, fish and herptiles are directly dependent on wetland-riparian habitat. The cottonwood canopy not only provides nesting, perching and roosting cover for numerous avian species, but it also provides valuable travel corridors for terrestrial wildlife as well. Although the proposed gravel mining plan appears to avoid much the river bottom- riparian habitat, and subsequent ponds will provide new habitat for a variety of aquatic wildlife, the Division of Wildlife has several areas of concern. The first area of concern lies in gravel mining Area 2, adjacent to highway#60. The proposal recommends that the `southern finger' of this Area extend into the cottonwood canopy almost to the South Platte River. This would have a negative impact on wildlife by destroying many cottonwoods at that location and would also narrow down the travel corridor for wildlife along the South Platte River. Division of Wildlife selected a compromise southern boundary for Area 2 mining as indicated on the attached map. This would allow limited mining within the 100-year floodplain of Area 2 and at the same time would provide adequate cottonwood canopy and travel corridor for wildlife. A second area of concern is mining Area 10 of the proposal, which lies adjacent to and east of Two Rivers Parkway, along the Big Thompson River. The map does not truly depict the cottonwood canopy at this location and mining this Area would destroy a significant number of cottonwoods and negatively impact avian nesting,perching and roosting in addition to restricting the travel corridor for wildlife along the river. The Division of Wildlife recommends that mining in Area 10 be minimized (eliminated?)to protect the cottonwood trees in this area. The proposal map shows a 100 foot setback between the Big Thompson River and the area to be mined in Area 10 and a 125 foot setback between mining Area 5 and the South Platte River. The Division of Wildlife highly recommends that a minimum setback of 200 feet be imposed if mining is allowed near the riverbanks, thus minimizing disturbance to resting waterfowl, eagles, shorebirds and other wildlife along these waterways. We also recommend at least a 100 foot setback between mining Area 6 and 7 and the wetland that lies just to the south of those two proposed gravel pit mines. This wetland provides a resting area for numerous waterfowl and shorebirds, especially during high winds and freeze up on the South Platte River. Another area of concern within this proposal is a winter roosting site for Bald Eagles. This roosting area lies just downstream from the railroad trestle, along the South Platte River on the east side of the project proposal. This is the same area where the Preble's Meadow Jumping Mouse was reportedly captured in June of 2001. Regarding the Bald Eagle winter roost,we strongly recommend that mining operations be allowed to proceed within a buffer around the roost, only between March 15 and November 15. Outside of these dates we strongly recommend that a buffer area around the roost site be maintained in which no mining activity and disturbance to the area takes place. We strongly recommend a buffer of no less than a 0.25 mile radius around this roost site to assure protection from disturbance of this site. Heavy vehicle traffic due to gravel mining operations in close proximity to the eagle roost during the roosting period could negatively impact use of this roost. This buffer must be enforced to prohibit disturbance over and above the normal traffic required to maintain existing farm operations and oil well facilities. I have included one of the proposal maps indicating the location of the roost and recommended buffer zone. The Division of Wildlife appreciates the opportunity to review and comment on this project proposal. Consideration for wildlife and critical wildlife habitat are essential in minimizing negative impacts on the resource. COLORADO pt The Weld County Public Works Department has reviewed this proposal; this project falls primariV the purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division ion 23. Our comments and requirements are as follows: COMMENTS: Two Rivers Parkway (WCR 27.5) is designated as an arterial road, which requires an 100-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. WCR 396 is designated on the Transportation Plan Map as a local gravel road, which requires a 60-foot right-of- way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. The average daily traffic count (ADT) for Two Rivers Parkway (WCR 27.5) is 3,672 vehicles, taken in a 24-hour period, November 5, 1998. WCR 396 has an ADT of 49 vehicles, taken October 1, 1994. REQUIREMENTS: Traffic Study: Weld County Public Works Department has reviewed your submitted traffic study, which was completed by Gene Coppola. The traffic engineer's memo will reflect any additional items that may be addressed prior to approval. Mining Sequence: The mining areas 9-12 are located on the north side of WCR 396. The applicant has indicated material will be taken across WCR 396 by conveyor. A detailed drawing of the crossing shall be required. Storm Water Drainage: All discharge points shall be designated on the plat, and the appropriate routing to the South Platte River or Big Thompson and Platte River ditch shall be indicated as well. Maintenance and Improvements Agreement: The applicant shall enter into an agreement for the upgrading, widening, and paving of WCR 396 from the pit entrance/scale house west to Two Rivers Parkway (WCR 27.5), and intersection improvements at Two Rivers Parkway (WCR 27.5) and WCR 396. Two Rivers Parkway (WCR 27.5) will be evaluated for structural adequacy by the Public Works Department. A structural overlay may be required due to the heavy hauling generated by the USR. If a structural overlay is needed, it shall be included in the agreement. The applicant shall also enter into an agreement to proportionately share, based on the traffic generated by the•USR, in the maintenance of Two Rivers Parkway and WCR 396. Internal Paving: The approach to the scale house/parking area for customer's and visitor's parking spaces shall be paved. Future Right-of-way: The applicant should reserve an additional twenty feet of property parallel to Two Rivers Parkway (WCR 27.5) for future build out. Also, the applicant should acquire and dedicate to the County any additional right-of-way needed to accommodate the intersection improvements at Two Rivers Parkway and WCR 396. The submittal materials indicate the gravel pit will be dry during mining operations, however, the proposed reclamation land use includes developed water resources including a series of ponds. Since the mining area is near the confluence of two stream systems, it appears reasonable to assume the ponds would intercept groundwater. Typically, the Colorado Division of Minerals and Geology forwards for our review and comments, referrals for proposed mining operations such as the one referenced above. Based upon the information received, it appears a water court decreed plan for augmentation or substitute water supply plan approved by this office, is necessary to prevent material injury to existing water rights. We recommend the County insure the operator to obtain all permits as required by the Colorado Division of Water Resources and Division of Minerals and Geology. Following due discussion, the Board of Trustees determined that the area of the request is currently outside of the Town's Comprehensive Plan. However, the request does have some conflicts with our interests specifically concerning traffic on Highway 60. The Board feels that the additional truck traffic created by this operation could potentially cause traffic hazards with current traffic from west Greeley, Milliken and Johnstown, as well as, local traffic that includes heavy farm equipment and implements. These potential hazards could put a strain on the local Fire and Police Departments and the Board asks that you take this into consideration during your review process.
