HomeMy WebLinkAbout20020071.tiff RESOLUTION RE: ACTION OF THE BOARD CONCERNING VI #0000100 AGAINST BARBARA SCHOTTELKOTTE FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Barbara Schottelkotte, VI #0000100, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 8th day of January, 2002, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Barbara Schottelkotte was not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board deems it advisable to bring legal action against those individuals named above to correct said violation. December 20, 2001 Letter sent to property owner indicating that the violation case was re-scheduled before the Board of County Commissioners . 2002-0071 Currently, there is a violation of Chapter 23, Article III (3) , Division 1, of Sections 23-3-20, 23-3-30, 23-3-30 .I, 23-3-40 and 23-3-40.H and Chapter 29, Article XI (11) of Section 29-11-40 and the definition of a DERELICT MANUFACTURED (MOBILE) HOME of the Weld County Code. To bring the property into compliance the property owner shall remove or completely screen the Noncommercial Junkyard from all adjacent properties and all public rights-of-way. Additionally, the `derelict mobile home' shall be restored or removed. Lastly, the number of cats shall be reduced to no more than 4 or a Use by Special Review application shall be submitted for a Kennel. The Department of Planning also recommends that the County Attorney authorize legal action against any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties. She said that she is aware of the problems, and she is already in the process of purchasing another mobile home. Currently, she has alot of money tied up in litigation until around the 1st of the year. As soon as that money is freed up, she will be able to work on bringing her property up to code. She said :hat she has extensive medical problems and can't attend the violation hearings for December. She said go ahead and give her a fine and she'll add it to her bills. I suggested instead to continue this case until January 2002. I told her that it sounded like in January we would have a better idea of where we stood. She said that she would completely fence the property when her money came in. I told her that still didn't solve the problem. I mentioned the cat situation to her and she said that they were all strays. I explained that if she provides food or water, the cats belong to her. I told her to call me back at the beginning of the year. The potential noncompliance(s)with the Weld County Code are a derelict mobile home and a Noncommercial Junkyard consisting of wood, metal, trash and miscellaneous debris. Please be advised that this is also being considered a potential building violation due to the condition of the mobile home. For your convenience, I have added the appropriate definitions: DERELICT VEHICLE: A vehicle that is inoperable(unable to move under its own power);or is partially or totally dismantled;or has all or portions of its body work missing or is substantially damaged;or is not registered with the State of Colorado,as required by Section 42-3-103,CRS,or by Sections 42-3-138 or 42-12-102,CRS,and/or the number plate assigned to it is not permanently attached to the vehicle,as required by Section 42-3-123,CRS;or is lacking proper equipment to the extent that it would be unsafe or illegal to USE on public road rights-of-way or otherwise not equipped with lamps and other equipment as required in Sections 42-4-202 to 42-2-227, CRS.
