Approved with Conditions
The Weld County Department of Planning Services has determined through administrative review that the
standards of Section 24-8-40.B.1 through 24-8-40.B.6 of the Weld County Code have been met. This
Recorded Exemption is approved with the following conditions in accordance with information submitted in
the application and the policies of Weld County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed
according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. Topographic or physical features of the proposed Lot A, such as ravines, ditches, streams etc. may
limit the area available for a new or replacement septic system. Prior to recording the plat, the Weld
County Department of Public Health and Environment recommends that the applicant review the Weld
County Code pertaining to septic systems to assure that any installed septic system will comply with
all setback requirements found in the Code. In the event the proposed lot is not of sufficient size to
allow the installation of a septic system, the lot may need to be enlarged.

3. Prior to recording the plat:
The plat shall be titled: Recorded Exemption No. 1061-14-3 RE-3271.
t\ \B. An area for a septic system replacement envelope for Lot A shall be indicated on the plat in
accordance with the Weld County Department of Public Health and Environment
recommendation.
�C. In accordance with Chapter 8, Article II of the Weld County Code, Lot A shall be granted one
residential access. Direct access from a public road shall be limited to one access per legal
parcel for residential use,no circle drives or additional accesses shall be granted.The road shall
be graded and drained to provide all weather access. Accesses shall be placed in such a
location as to have adequate sight distance in both directions, shall not be placed below the
crest of a hill or where physical obstructions are present.
—, D. Lot B shall use the existing residential/agricultural access points as no additional accesses shall
be granted.
All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld
County Department of Public Works to determine if a culvert is necessary at any approved road
access point. If a drainage culvert is required,a 15 inch Corrugated Metal Pipe(CMP)is Weld
County's minimum size. If the applicant chooses to place a larger culvert please contact the
Weld County Department of Public Works to adequately size the culvert.
S /F. Weld County Road 44 is designated on the Weld County Transportation Plan Map as a collector
7J status road,which requires 80 feet of right-of-way at full build out.There is presently 60 feet of
right-of-way. A total of 40 feet from the centerline of Weld County Road 44 shall be delineated
on the plat as right-of-way reservation for future expansion of Weld County Road 44. This road
is maintained by Weld County.
+"') G. The applicant shall attempt to address the requirements (concerns) of the Division of Wildlife,
as stated in the referral response received March 14, 2002. Evidence of such shall be
submitted in writing to the Weld County Department of Planning Services.
J The applicant shall address the requirements of Weld County School District RE-5J as stated
in the referral response received February 26, 2002. Evidence of such shall be submitted in
writing to the Weld County Department of Planning Services.
( I. The applicant shall provide the Weld County Department of Planning Services with a certificate
from the Weld County Treasurer showing no delinquent taxes exist for the original parcel.
/ J. The applicant shall complete and submit the appropriate zoning and building permit applications
and pay the appropriate fees to the Weld County Department of Planning Services for the
mobile home and semi-trailers located on Lot B.
K. The following notes shall be placed on the plat:
All proposed or existing structures will or do meet the minimum setback and offset
requirements for the zone district in which the property is located. Pursuant to the
definition of setback in the Weld County Code, the required setback is measured from
the future right-of-way line.
No building or structure as defined and limited to those occupancies listed as Groups A,
B, E, H, I, M and R in Table 3-A of the 1997 Uniform Building Code, shall be constructed
within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead.
Any construction within a 200-foot radius of any tank battery or 150-foot radius of any
wellhead shall require a variance from the terms of the Section 23-6-10 of the Weld
County Code.
,2) Any future structures or uses on site must obtain the appropriate zoning and building
permits.
v 3) All construction or improvements occurring in the flood plain as delineated on Federal
Emergency Management Agency FIRM Community Panel Map 080266 0750 C dated
September 28, 1982, shall comply with the Flood Hazard Overlay District requirements
of Chapter 23, Article V, Division 3 of the Weld County Code.
N4) The installation of any septic system within the 100-year flood plain shall comply with the
Weld County I.S.D.S.flood plain policy.In accordance with the State of Colorado I.S.D.S.
Regulations, no septic system shall be installed with in the floodway.
5) Prior to the release of building permits, the applicant shall submit a recorded deed
describing the Lot upon which the building permit is requested with the building permit
applications. The legal description on such deed shall include the Lot designation and
Recorded Exemption number.
\6) Prior to the release of building permits, the applicant shall submit evidence to the
Department of Planning Services that Lot A has an adequate water supply of sufficient
quality, quantity and dependability.
. 37) Prior to the release of building permits for any structure exceeding 3,600 square feet,the
applicant must comply with the requirements of Appendix III-A of the Uniform Fire Code.
\\.,,:f) Should noxious weeds exist on the property or become established as a result of the
proposed development the applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code.
V 9) Any disturbance of wetlands shall require the applicant to contact the Army Corps of
Engineers for permits pursuant to Section 404 of the Clean Water Act.
�10) Prior to the release of building permits on Lot A, the Lot owner shall verify with the
nearest Town/City or Sanitation District to determine the location of the nearest sanitary
sewer line. In accordance with the Weld County Code, if a sewer line exists within four
hundred (400) feet of the property line and the sewer provider is willing to serve the
proposed structure,a septic permit cannot be granted by the Weld County Department
of Public Health and Environment. Evidence of such shall be submitted in writing to the
Weld County Department of Planning Services.
\\i11) WELD COUNTY'S RIGHT TO FARM Weld County is one of the most productive
agricultural counties in the United States, ranking fifth in total market value of
agricultural products sold. The rural areas of Weld County may be open and spacious,
but they are intensively used for agriculture. Persons moving into a rural area must
recognize and accept there are drawbacks, including conflicts with longstanding
agricultural practices and a lower level of services than in town. Along with the
drawbacks come the incentives which attract urban dwellers to relocate to rural area:
open views, spaciousness, wildlife, lack of city noise and congestion, and the rural
atmosphere and way of life. Without neighboring farms, those features which attract
urban dwellers to rural Weld County would quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area.
Well run agricultural activities will generate off-site impacts, including noise from
tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal
pens,field work, harvest, and gravel roads;odor from animal confinement,silage, and
manure;smoke from ditch burning;flies and mosquitoes;and the use of pesticides and
fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs
cannot simply be moved out of the way of residential development without threatening
the efficient delivery of irrigation to fields which is essential to farm production.
Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found
to be a public or private nuisance if the agricultural operation alleged to be a nuisance
employs methods or practices that are commonly or reasonably associated with
agricultural production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of
Delaware) with more than 3,700 miles of state and county roads outside of
municipalities. The sheer magnitude of the area to be served stretches available
resources. Law enforcement is based on responses to complaints more than on patrols
of the county and the distances which must be traveled may delay all emergency
responses, including law enforcement, ambulance, and fire. Fire protection is usually
provided by volunteers who must leave their jobs and families to respond to
emergencies. County gravel roads, no matter how often they are bladed, will not
provide the same kind of surface expected from a paved road. Snow removal priorities
mean that roads from subdivisions to arterials may not be cleared for several days after
a major snowstorm. Snow removal for roads within subdivisions are of the lowest
priority for public works or may be the private responsibility of the homeowners.
Services in rural areas, in many cases, will not be equivalent to municipal services.
Rural dwellers must, by necessity, be more self-sufficient than urban dwellers.
Children are exposed to different hazards in the county than in an urban or suburban
setting. Farm equipment and oil field equipment,ponds and irrigation ditches,electrical
power for pumps and center pivot operations, high speed traffic, sand burs, puncture
vines, territorial farm dogs, and livestock present real threats to children. Controlling
children's activities is important, not only for their safety, but also for the protection of
the farmer's livelihood. Parents are responsible for their children.
4. The applicant shall submit two paper copies of the plat for preliminary approval to the Weld County
Department of Planning Services.Upon approval of the paper copies the applicant shall submit a Mylar
plat along with all other documentation required as conditions of approval. The Mylar plat shall be
recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services'
Staff. The plat shall be prepared in accordance with the requirements of Section 24-8-70 of the Weld
County Code. The Mylar plat and additional requirements shall be submitted within sixty(60)days
from the date the Administrative Review was signed. The applicant shall be responsible for paying
the recording fee.
5. The Department of Planning Services respectfully requests the surveyor provide a digital copy of this
Recorded Exemption. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable
GIS formats are ArcView shapefiles,Arclnfo Coverages and Arclnfo Export files format type is .e00.
The preferred format for Images is .tif(Group 4). (Group 6 is not acceptable). This digital file may be
sent to mapsco.weld.co.us.

6. The Weld County Department of Planning Staff's approval of this Recorded Exemption Application
is based on satisfying the Conditions of Approval. Should an applicant be unwilling or unable to
meet any one of these conditions within 60 days of approval, then this case will be forwarded to the
Weld County Board of County Commissioners with a staff recommendation for denial.

This is in response to our discussion June 12,2002 about the mobile home on Mr. Betz property. You requested a
letter to change the use of the mobile home.
We would like to request a change in use for the mobile home on this property from Accessory to the Farm to
Principle Dwelling The mobile home has been there since 1994.The Certificate of Final Inspection has an approval
number#3821 as an Accessory to the Farm. At that time the applicant was not required to permit the mobile home.
Thank you for your help with this. The recorded exemption conditions of approval have been met once the use for
the mobile home use has been changed.A preliminary plat will follow soon.

Dear Lauren Light:
This is in response to the Administrative Review for RE-3271 dated April 19,2002.
Below is the required documentation required as conditions of approval:
3G. states the applicant shall attempt to address the requirements (concerns)of the Division of Wildlife. The letter
dated March 14, 2002 recommends that the riparian areas be fenced off and a buffer provided between the river and
grazing area.
This land will not be used for grazing.
To decrease the impact to the riparian area,development to the new parcel will be set back from the riparian area. It
is important to plan for wildlife before development begins to ensure that the wildlife will be there for future
generations.
3H. states the applicant chill address the requirements of the School District RE-5J. The School District requires a
fee of$750.00 to be paid at the time of the issuance of the building permit for the new created lot.
This will be paid directly to the school district prior to any building permits for the new created lot.
2I. Attached is the tax statement.
3J. states that the applicant shall complete and submit the appropriate zoning and building permit applications and
pay the appropriate fees to the WC Department of Planning Services for the mobile home and semi-trailers.
The mobile home has been there since 1994. The Certificate of Final Inspection has an approval number#3821 as an
Accessory to the Farm At that time the applicant was not required to permit the mobile home.
The semi-trailers will be on the property temporarily until an agricultural structure is built for storage of the
agricultural supplies in the semi-trailers.

The Department of Planning Services' has reviewed your application and related materials for
compliancy with the Weld County Code. We find that your proposed Recorded Exemption meets the
intent of the Code and it has been conditionally approved by staff. We have enclosed our comments for

Soil Classification #4: Aquolls and Aquepts, flooded
4—Aquolls and Aquepta, flooded. This nearly level
map unit is in depressions in smooth plains and along the
bottoms of natural drainageways throughout the survey
area. Aquolls, which have a dark colored surface layer,
make up about 55 percent of the unit. Aquepts, which
have a lighter colored surface layer, make up about 2.5
percent. About 20 percent is soils that are well drained
and soils that have sandstone or shale within 48 inches of
the surface.
These are deep, poorly drained soils that formed in
recent alluvium. No one pedon is typical. Commonly the
soils have a mottled, mildly to moderately alkaline loamy
or clayey surface layer and underlying material that ex-
tends to a depth of 60 inches or more. In places they have
a gleyed layer in the underlying material.
Most of the acreage is subject to excessive runoff. The
water table is at or near the surface in spring and during
the peak of the irrigation season.
These soils are used for rangeland and wildlife habitat.
Some small areas are irrigated pasture.
The potential native vegetation is dominated by
switchgrass, prairie cordgrass, saltgrass, alkali sacaton,
big bluestem, indiangrass, western wheatgrass, slender
wheatgrass, sedge, and rush. Cattails and bullrush grow
in the swampy spots associated with these range sites.
Potential production ranges from 4,000 pounds per acre in
favorable years to 3,000 pounds in unfavorable years. As
range condition deteriorates, the tall and mid grasses
decrease, production drops,and saltgrass,sedge,and rush
increase.The farming and irrigation in adjacent areas has
increased the amount of salts on much of the acreage.
Management of vegetation on this soil should be based
on taking half and leaving half of the total annual produc-
tion. Switchgrass, big bluestem. indiangrass, western
wheatgrass, pubescent wheatgrass, intermediate wheat-
grass, tall wheatgrass, and tall fescue are suitable for
seeding. The plants selected should met the seasonal
requirements of livestock. For successful seeding, a firm
prepared seedbed is needed. A grass drill should be used.
Seeding early in spring has proven moat successful. Til-
lage is needed to eliminate the undesirable vegetation.
Wetland wildlife,especially waterfowl, utilize this unit.
The wetland plants provide nesting and protective cover
as well as some food. The nearby irrigated cropland,
where wildlife obtain much of their food and find protec-
tive cover, makes this unit valuable to both wetland and
openland wildlife.
Openland wildlife,especially pheasant,use this unit for
cover and nesting. Deer find excellent cover in some
areas. These valuable wildlife areas should be protected
from fire and fenced to prevent encroachment and
overuse by livestock. They should not be drained. Capa-

rigated pasture. A suitable cropping system is 3 to 4
years of alfalfa followed by 2 years of corn and small
grain and alfalfa seeded with a nurse crop.
Close grown crops can be irrigated from closely spaced
contour ditches or sprinklers. Contour furrows or sprin-
klers should be used for new crops. Applications of
nitrogen and phosphorus help in maintaining good produc-
tion.

grass. Sideoats grams, little bluestem, western wheat-
grass,and sedge are also prominent. Potential production
ranges from 1,810 pounds per acre in favorable years to

Wildlife is an important secondary use of this soil. The
cropland areas provide wildlife habitat for ring-necked
pheasant and mourning dove. Many nongame species can
be attracted by establishing areas for nesting and escape
cover. For pheasants, undisturbed nesting cover is essen-
tial and should be included in plans for habitat develop-
ment, especially in areas of intensive agriculture. Range-
land wildlife, for example, the pronghorn antelope,can be
attracted by developing livestock watering facilities,
managing livestock grazing,and reseeding where needed.
The underlying sandstone is the moat limiting feature
of this soil. Neither septic tank absorption fields nor
sewage lagoons operate properly. Site preparation for
dwellings is more costly. Environmental and beautifica-
tion plantings of trees and shrubs may he difficult to

Lot B and a new access is proposed for Lot A. Lot B will have the uses
by right in the agricultural zone district and will continue with the
existing uses. Lot A will have the ability to remain consistent with the
uses by right in the agricultural zone district. At this time, there are no
animal units located on the site. There are no oil and gas operations
located on the property.
4. The reason for the proposed recorded exemption with an explanation how each
lot will be used.
The purpose of this application is to split a small non-productive
portion from the remaining property. As stated above, Lot A and Lot
B will continue to have the uses by right in the agricultural zone
district. The river physically separates the two lots.
5. A description of the location, size and present use of the area where the
proposed new lot(s)will be created.
Lot B will be 47.76 acres, more or less and Lot A will be 2.33 acres,
more or less. The actual acreage will be determined at the time of
the survey. As stated above, both lots are adjacent to WCR 44. Lot B
has the existing improvements and Lot A has been used for dry-land
pasture.
6. A statement describing any unique physical characteristics on the site, if
applicable.
The Little Thompson River is a unique characteristic of the site.
7. A statement indicating that all proposed or existing structures will or do meet
minimum setback and offset requirements for the zone district in which the
property is located.
All existing and proposed structures will meet the minimum setback
and offset requirements for the agricultural zone district
8. A statement indicating whether the applicant is willing to place a conservation
easement on the property to maintain farm production or open space.
A conservation easement is not applicable to this proposal.

Due to the "non-prime" nature of the property and lack of water, a
building envelope is not applicable.
10. A statement explaining how the proposal is consistent with Chapter 22 of the
Weld County Code and any adopted municipal plan, and any approved
intergovernmental agreement(s), if applicable.

This proposal is not taking any "prime" farmland out of production
and allows the property owner the ability to separate a portion of the
property based on past and existing uses. Lot B has the existing
improvements. The site is not located within any intergovernmental
agreement areas.
11. A statement explaining how the proposed uses will be compatible with existing
surrounding land uses.
The existing surrounding land uses comprise of small and large
agricultural parcels to the north, south, west and east. Interstate I-25
Frontage Road runs north and south, just west of the property. This
proposal is very compatible with the existing surrounding land uses.
12. A statement explaining how the proposal is consistent with the intent of the
district it is located within as expressed in Chapters 22 and 23 of the Weld
County Code.
This proposal is consistent with the intent of the Agricultural zone
district in the fact that the proposed split will not take any truly
"prime" agricultural land out of production. The proposed split is
based on past and existing uses and layout of the property. As stated
above, this proposal allows the property owner to split a non-
productive portion with the existing improvements from the remaining
property. The applicant believes that this proposal meets the intent of
the Agricultural zone district.
13.A statement explaining how the proposal is consistent with efficient and orderly
development as defined in the Weld County Code, Section 24-1-30.
This proposal is consistent with efficient and order/y development by
splitting the property based on the existing uses of the land and use of
an existing access to the Weld County road system. The Little
Thompson River delineates the proposed split between Lot A and Lot
B. The property has historically been used as irrigated alfalfa and will
have the ability to continue in such use. This proposal does not take
"prime" agricultural land out of production. This proposal does not
affect the future development of schools and parks to serve the
population. The approval of this proposal requires that a plat be
produced and recorded by uniform procedures and standards. This
proposal does not create erosion, sedimentation or other pollution of
surface and subsurface water. This proposal is consistent with the
existing and proposed uses of the surrounding area. The review and
conditional approval of this proposal will insure the health, safety, and
general welfare of the residents of Weld County.

As we discussed during our meeting on January 6, 2000,the Town of Berthoud has asked
the Little Thompson Water District to serve water to the two homes east of I-25 and north
of Highway 56 identified as lots 1 and 2. These homes are currently served by LTWD
the addresses are 4407 WCR 44 and 201661-25 Frontage Road.
The owners of the property Cliff Betz and Gary Baird plan to leave a portion of this back
section of the property in Weld County. As discussed there is a need for a new service
due to the owner of 20166 I-25 relocating his home to the east onto lot 1.
The Town of Berthoud will agree to serve water to lots 3 and 4 in the future. The owners
believe that they may annex this portion of the property into Berthoud and we will be
prepared to serve water these two lots as this area develops. In order to serve water to lots
3 and 4 the Town may require an extension of the water mains or improvements to the
system.

COMMENTS:
WCR 44 is designated on the Transportation Plan Map as a collector status road,which requires an 80-foot right-
of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County.
Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the
required setback is measured from the future right-of-way line.
WCR11 is designated on the Transportation Plan Map as a local paved road, which requires a 60-foot right-of-
way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County.
Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the
required setback is measured from the future right-of-way line.
REQUIREMENTS:
The Weld County Public Works Department recommends approval of this application.
Direct access from a public road shall be limited; only one access is allowed per legal residential parcel. No circle
drives will be allowed. In accordance with Chapter 8, Article II of the Weld County Code, this policy shall apply
to all new and existing accesses within the unincorporated areas of Weld County. Properties within municipalities
or other counties that access Weld County roads are also subject to this policy. (Lot A)
The applicant shall utilize the existing residential access to this parcel. (Lot B)
Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your agricultural operation.
(Lot B).
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.

Environmental Health Services has reviewed this proposal; the following conditions are
recommended to be part of any approval:
1. A Weld County Septic Permit is required for the proposed home septic system
and shall be installed according to the Weld County Individual Sewage Disposal
Regulations. Please note, the lot owners should verify with the nearest
Town/City or Sanitation District to determine the location of the nearest sewer
line. In accordance with the Weld County Code, if a sewer line exists within 400
feet of the property and the sewer provider is willing to serve the proposed
structure, a septic permit cannot be granted by the Weld County Department of
Public Health and Environment.
2. The installation of any septic system within the 100-year flood plain shall comply
with the Weld County I.S.D.S. flood plain policy (attached). In accordance with
the Colorado I.S.D.S. Regulations, no septic systems shall be installed within the
floodway.
Additionally, please note the following:
1) Our Department recommends the applicant to set aside an area for a septic
system replacement envelope for lot A.
2) Topographic or physical features of the proposed lot, such as ravines, ditches,
streams, etc. may limit the area available for a new or replacement septic
system. Prior to recording the plat the Division recommends that the applicant
review the County Code pertaining to Septic Systems to assure that any installed
septic system will comply with all setback requirements found in the Code. In the
event the proposed lot is not of sufficient size to allow the installation of a septic
system the lot may be need to be enlarged.

Thank you for referring case number RE-3271 to the School District. As stated in
previous letters, the projected student impact upon the Johnstown-Milliken School
district appears to be minimal as presented at this time. Currently our schools are above
or nearing capacity, especially at the elementary levels. Our facilities plan indicates that
we will have the need to build an additional elementary school with the next two years.
As of this date the Towns of Johnstown, Milliken and Berthoud have formally passed a
resolution and ordinance describing the land dedication or cash in lieu of land dedication
for education. At present,the cash in lieu of land dedication fee is $750. This fee is paid
at the time of the issuance of a building permit and is paid directly to the school district.
As this exemption directly effects the school district adversely, I would request that the
applicant voluntarily contribute the same fee as all other homebuilders in our
communities have done since the inception of the local IGAs.

This letter is in response to your request for water service commitment for four (4) proposed lots, in
the location described as follows:
LOT B OF S 1/2, SW 1/4,OF SEC. 14,T4N,R68W—WELD COUNTY, COLORADO
The District provides water service within its service area as defined by the District. The
provision of water service by extension of existing water lines of the District to the above property
and the installation of taps for lots is done under the terms of the Rules and Regulations of the District
established by the Board of the District from time to time. You may obtain a copy of the Rules and
Regulations from the District. This letter outlines the provisions of the Rules and Regulations,
however this letter does not change any provisions of the Rules and Regulations. The Board of the
District may alter and amend the Rules and Regulations at any time, and the provisions of this letter
are subject to alteration and amendment based on changes in the Rules and Regulations of the District.
We currently have a 2 '/2 " diameter water line located along Weld County Road 44 and along
the I-25 frontage road with no additional capacity available. The property is currently served by two
Little Thompson Water District water tap. We can commit to provide service to the above property,
subject to the limitations in this letter, for one standard residential 5/8" X 3/4" water tap per lot; and
the following additional limitations on the provision of water service are:
1. In August of 1993 the Little Thompson Board implemented a "system impact" fee of
$1050 per lot for all lots to be added to the system. This is due upon completion of the
main line extension agreement.
2. All improvements to District facilities required to provide service will be the financial
responsibility of the developer in accordance with the District Rules and Regulations.
All improvements must conform to District Specifications.
3. Little Thompson Water District requires the transfer of one share of Colorado Big
Thompson water for each lot in the commitment and then to pay for the rest of the tap
fee as the water lines are put in service. The developer then has the taps to sell with the
lots at the price that he sets.
4. In order to provide water service to the two additional taps you will need to fund the
upgrade of our pressure reducing vault located at I-25 and WCR 48. These upgrades
would allow Little Thompson Water District to serve the requested additional taps at
this location.
5. You will be required to provide the needed water lines in the proposed subdivision.
6. The design, installation and total cost of the project will be the responsibility of the
developer.
7. Little Thompson Water District will only provide service to the additional two taps for
your lots with approval from the Town of Berthoud (the lots are in the Berthoud
service area) and with the approval of the Town of Johnstown (the lots are in the
Johnstown Growth Area).
This commitment letter will expire two years from the date of this letter if the taps have not
been purchased, paid for and installed by that date of expiration. The current fee for the domestic 5/8"
X 3/4" tap is $14,000.00. YOU ARE HEREBY ADVISED THAT THE RULES, REGULATIONS
AND TARIFFS OF THE DISTRICT ARE SUBJECT TO CHANGE WITHOUT NOTICE;
AND THIS LETTER IS ISSUED WITH THE SPECIFIC LIMITATION THAT THE
DISTRICT MAY CHANGE THE RULES, REGULATIONS AND TARIFFS APPLICABLE

Dear Lauren,
I visited the site last week. While I was there I noticed the Little Thompson River that runs between the
two proposed parcels. The riparian habitat along the river is in good condition with large cottonwood
trees. I also found that the rest of the area had a distribution of grasses, mostly non-native.
While I was there, I observed a variety of songbirds along the river bottom and up in the grass areas. A
variety of ground dwelling birds and small and large mammals are also likely to occur here at different
times of the year. I would expect their associated predators, coyotes, fox and raptors to use this site also.
Riparian areas are important habitat types to many species. They act as corridors for wildlife movement
and provide excellent nesting and perching habitat for many bird species. Any development or
agricultural use within the riparian habitat can harm this habitat. If grazing is going to be used in the
future, it is recommended that the riparian areas should be fenced off and a buffer should be provided
between the river and the grazed area. These fences should also allow for the movement of wildlife from
the riparian areas to the pastures.
The grassland area is already under agricultural use. Ground-nesting birds will use the areas in the spring,
so any livestock or use of machinery on the area will disturb and may destroy these nests. Waiting until
the summer months to do some of these uses would benefit these species.
To decrease the impact to the riparian area, development to the new parcel should be set back from the
riparian area. If development is to occur within the riparian area threatened and endangered species, such
as Prebble's Meadow Jumping Mouse, should be looked for.
