WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 19th day of August, 1981 at the hour of 2: 00 o' clock p.m. in the Chambers of the Board of County Commissioners for the purpose of hearing the application of Amoco Production Company, c/o F. H. Dillard, P. O. Box 39200, Denver, Colorado 80239, for the granting of a Special Use Permit for a pilot waterflood project, on the following described real estate, to wit: Part of the NW4 of the NE4, Section 20, Township 2 North, Range 66 West of the 6th P.M. , Weld County, Colorado. WHEREAS, evidence was presented in support of the granting of the Special Use Permit for a pilot waterflood project, on the abovedescribed real estate, and WHEREAS, Section 3. 3 (E) (2) of the Weld County Zoning Resolution authorizes such a use in an Agricultural District upon approval by the Board of County Commissioners, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, has studied the request of the petitioner and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, is satisfied that the request for a pilot waterflood project, on the hereinabove described real estate, conforms to the purposes of Section 3. 3 (E) (2) of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners that the application of the petitioner for a Special Use Permit, on the hereinabove described tract of land be, and hereby is, granted subject to the following: 1. The Planning Commission recommendation is conditional upon the following items: 1. AMOCO Production Company shall present and the Board of County Commissioners agree to a program of maintenance and/or upgrading of Weld County Road 20. 2. AMOCO Production Company shall insure throughout the pilot operation that the integrity of the injection wells is secure so that no water is permitted to escape into any area except the producing aquifer. Results of tests to verify such secure integrety shall be forwarded to the Department of Planning Service's staff upon completion. 3. The Special Use Permit plat shall be returned to the office of the Department of Planning Services for recording with the Weld County Clerk and Recorder. The permitted us shall be for a pilot water flood injection facility averaging a capacity of 2,000 BBL per day of water. The site shall include equipment such as : A. Truck unloading facilities; B. Water settling tanks - six 1,000 BBL tanks; C. Filtering and injection pump(s) ; and D. a 1,000 gallon concrete overflow pit. 2. The facility may be in operation 24 hours per day and 365 days per year. 3. All accesses shall have the approval of the Weld County Engineering Department. All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department. Water truck stacking shall not be permitted on Weld County Road 20. A minimum of four (4) water trucks shall be able to parked within the site at any one time. 4. All construction, electrical work and fabrication will be done in accordance with the Weld County Building Code. 5. The appearance of the facility shall be maintained in a neat and orderly condition through periodic painting and maintenance. 6. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. 7. All phases of the operation shall comply with all county, state, and federal health standards and regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems. 8. Safety and fire protection will be as prescribed by the Fort Lupton Fire Protection District, Industry Standards, and/or other applicable rules and regulations of governmental bodies having jurisdiction on the premises. 9. The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans shall be approved. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services. 10. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Development Standards. Mr. Anson reviewed the notice and stated what the Board must consider when determining whether or not to grant a SUP pursuant to the zoning resolution. Mr. Honn reviewed the Planning Commission' s determination in their favorable recommendation to the Board and their conditions for said recommendation. The development standards recommended for the SUP were read by Tom. He reminded the Board that SE 140 is being considered simultaneous to the SUP. Amoco is leasing the parcel and therefore the Planning Staff recommends that the subdivision exemption be conditional with an expiration co-erminus with the lease of the subject parcel. While improvements may be constructed on the 1. 9 acre parcel, they would be removed upon termination of the project. Amoco' s representative, Scott Johnson, elaborated on the waterflood project. They will be hauling water in from other well sites. Mr. Johnson discussed their views on condition #1 of the Planning Commissions recommendation; a program of maintenance and/or upgrading of Weld County Road 20. Amoco does not feel that they should assume the total responsability for upgrading the road. They will; however, assume responsability for the dust abatement. Mrs. Esther McCrumb, adjacent landowner, related her concerns regarding the ground water comtamination. She requested some type of assurance that if the water is contaminated that Amoco will make restitution to the landowners. Mr. Johnson elaborated on their system and the precautions and methods that will be taken to assure that contamination of the ground water does not occur. It was a concensus of the Board that everything possible is being done to not contaminate the ground water. The Board & Mr. Johnson continued to discuss the road issue and decided a work session should be held regarding this matter. Lupton, Colorado. The NESSS Unit, which covers 1 square mile in Sections 17 and 20, T2N, R66W, currently consists of 16 oil wells producing out of the Sussex Sand Formation. Four of the 16 producing wells will be converted to water injection wells. A 17th producer will be drilled on an infill 20- acre spacing in the center of the unit. New flowlines will be installed to bring all production to the Special Use Area (SUA) for centralized treating, testing and sale. As a result, seven of the existing batteries in the unit would be eliminated and the land returned to its original condition. A portion of the described SUA is already leased to Amoco Production Company before the unitization occurred on March 1, 1981. This land is the location of the Schmidt #1 producing well and the battery site for the Schmidt #1 and #2. The function of the special use area (SUA) can be broken down into two distinct areas, production and water injection. All production flowlines from the 13 wells will tie into an automatic well test header. Two separate flowlines leave the test header and go to the production treater and the test treater, respectively (one well will be on test at all times) . The produced water and separated oil will then flow to the respective water and oil tanks located at the North end of the SUA. The oil will then be piped to the Continental Pipe Line Station located directly to the west of the SUA. The water injection function will consist of a produced water unloading location, water settling tanks and a water injection station. Water requirements for the waterflood are projected at 2000 BBLD. The NESSS Unit will not produce this guantity of water. Therefore, 25, 80 BBL truck loads of produced Sussex water, presently trucked to Weld County and 31 Disposal Facilities for disposal , will be diverted to this location for reinjection into the Sussex Formation. The water trucks will enter the SUA from Weld County Road #20 and pump the water into settling tanks from a concrete unloading pad. Amoco will upgrade 4 tenths of a mile of Weld County Road #20 to control dust and reduce road deterioration by the traffic (2 tenths of a mile either side of the SUA entrance). The existing road base will be dug up to a depth of 6 inches. Twenty four gallons of SA-1 manufactured by Launders Chemical Company will then be worked in to obtain a homogenous mixture. An additional 6 inches of class 6 road base will be hauled in and mixed with 24 more gallons of SA-1. Ninety two hundred gallons of dust oil will also be used. Traffic congestion on Weld County Road 20 will not be a problem. The 25 trucks per day will arrive at random throughout the day. However, in the event more than 1 truck arrives at the location at one time, the unloading pad will be large enough to handle 4, 80 BBL trucks simultaneously. Therefore, trucks will not be blocking traffic. There will be 2 rows of water settling tanks placed in parallel for maximum settling time. Each row will consist of 3, 1000 BBL tanks. The water will then be pumped through a series of filters and into a filtered water tank. The filtered water tank will supply the main water injection pump for the four injection wells. The entire injection facilities will be completely automated. However, in the event of a malfunction resulting in an overflow, all tanks will be connected to a 1000 gal . concrete overflow pit. In addition, a firewall well surrounds the tanks in order to contain potential spills. The building housing the main injection pump will be insulated. Therefore, under normal operating conditions, noise will not be a factor. All oil production tanks will be a minimum of 50 feet away from an ignition source, consistent with Amoco's safety specifications. F. H. Dillard District Superintendent STJ/mj g WORK SESSION June 29, 1981 Five Commissioners Present Amoco SUP Request - "Tom Honn, Scott Johnson and Gris Rogert, Amoco Representatives Tom noted that the SUP application was requested from Amoco due to the concentrated truck activity in the area where the facility is to be located. Scott Johnson presented an indepth review of the Northeast Spindle Sussex Sand Unit project, pointing out special features. Amoco is requesting that they be allowed to continue with construction now in progress. They acknowledge that they will be proceeding at their own risk should the permit be denied. Amoco also requests that the County simultaneously advertise for both the Planning Commission and Board of County Commissioner hearings required by the permit process. The Commissioners approved both requests. State Highway Access Code - Tom Honn Tom noted that the Colorado Highway Commission will hold a public hearing on July 16, in Steamboat Springs for the adoption of the new State Highway Access Code which will cause procedural changes in permitting driveway, street, and road approaches to the State Highway System. The code provides an option for the County to administer permit processes or delegate the process to the Colorado Highway Department. A letter will be sent to the State Highway District Engineer requesting that the process be delegated to the State Highway Department as approved by the Board. Fraternity House Director - Gene McKenna Gene stated that Walter Pilcher has presented his resignation from the position of Director of the Fraternity House. Gene suggested combining the Administration of the Fraternity House and the Youth Shelter Home to maintain a consistent approach in handling the youth. Robert Armijo would become the Director of both shelter homes effective July 15, 1981 and a Counselor I will be hired. A dollar savings will be realized through this change. The Board approved the combination of administrations of the shelter homes. Child Support Attorney - Gene McKenna, Don Warden, Tom David Applications are still being taken to fill the position of Child Support Attorney. The salary level was discussed; it was suggested that the level be raised from $16,000 to $20,000 to attract more quality applicants. The Commissioners approved this request. County Road 272 - Wayne Smyth, Drew Scheltinga, Vern Nelson, Colorado Landfill Engineer Vern presented a review of the proposed road design and signage. A cost estimate schedule was also presented and reviewed. It was noted that Colorado Landfill will pay for engineering services. Wayne will bid out the project and report back to the Board. Road and Bridge Advisory Board Chip & Seal Recommendations - Wayne Smyth, Drew'Scheltinga Wayne presented a list of the priority road Chip & Seal recommendations, noting a total of 39.1 miles that will be bidded out. Lupton Request for Kahil Street - Wayne Smyth, Drew Scheltinga Wayne has received a request from Fort Lupton asking the County to pave the rest of Kahil Street. The Board suggests Fort Lupton form an improvement district in which the County would be willing to participate. Wayne will write a letter to that effect. County Road 15 - Wayne Smyth, Drew Scheltinga Dacono is' requesting that the County post a speed limit on County Road 15 at 25 miles per hour. Dacono also requests that the County give the town authority to patrol Road 15 for traffic control . The Board suggested several options , including annexing the road; Wayne will notify Dacono. 59th Avenue - Wayne Smyth The petition for putting in guardrails at the curve on 59th Avenue was discussed. It was noted by Wayne that if speed limits are obeyed, the curve is no problem to complete. All of the accidents at that location were due to speeding or drinking and driving. The petition will be placed on the agenda for July 13. A general Engineering discussion ensued. District Attorney Office Staffing - Bob Miller, Elaine Valencia, Don Warden, Dick Barrett Bob stated that with the elimination of the CETA programs , the District Attorney's Office will be short four employees previously provided through CETA. He proposes substituting three On-the-Job Training (OJT) employees for the four CETA employees. He feels that there is sufficient savings in other areas of the District Attorney Office budget to fund the three OJT positions for the balance of 1981 but is concerned that funding may not be available for 1982. The Board approved filling three OJT slots for the rest of 1981 , but stated that it be made clear to those hired that funds may not be budgeted to maintain the positions in 1982. Bob was instructed to present the request for funding of these slots for 1982 during the regular Budget Hearings. The vacancy in the Consumer Fraud Division was discussed. It was decided to continue with this area as in the past due to the contributions and benefits to the general public. We toured the road, examined the existing conditions, discussed construction alternatives, and settled on a tentative agreement for re construction. The following terms apply to the portion of Weld County Road 20 between U.S. 85 and a point approximately 300 feet east of the driveway into the water injection site, a distance of .8 of a mile more or less. Weld County will agree to: A. Investigate the site for utility and gas line interference and determine the locations and depth. B. Perform any necessary surveying or staking out for the road construction. C. Provide an on-site representative throughout the course of the job to coordinate the work and ensure that proper construction methods are carried out. D. Do the rough site grading, clearing, and grubbing along the road shoulders to prepare the road bed for receiving the lifts of gravel. E. Provide motorgraders throughout the job to spread the lifts of gravel as they are applied by the haul trucks. F. Make available to Amoco the necessary quantities of pit run and crushed material from the County gravel sources located at the Koenig Farm and the Hokestra Pit. G. Provide any culverts or culvert extensions necessary for adequate drainage. Amoco will agree to: A. Provide all equipment and labor necessary to load at the pits, haul to the job site and dump on the County road, approximately 90O0 cubic yards of pit run and crushed rock to raise Weld County Road 20 an average of two feet. B. Provide a suitable water distributor truck with operator and a vibratory sheeps-foot roller, or other suitable compactor for rolling down and com- pacting the lifts of material as the road is raised. C. Water the County haul roads from the gravel pits for dust abatement during the hauling process (at least twice a day or as necessary) . The road will be raised approximately two feet for the .8 of a mile to be re- constructed with the driving surface approximately 28 feet wide with 3:1 side slopes. This in no way guarantees that the road will be useable for the water hauling operation 365 days a year; however, by raising the road up above the level of the fields and building it with rock from our gravel pits, it should be equivalent to our better County roads, which are surfaced with gravel. WSS:sd L_ L _ ,p Tom Honn, Planning July 20, 1981 - . _ Drew Scheltinga,nga, Engineering Manager Amoco Water Flood Facility SUP In a letter dated June 29, 1981, Fred Dillard of Amoco indicated this facility would generate 25 loaded water trucks per day. Weld County Road 20 between U.S. Highway 85 and the proposed site is a narrow gravel road that will not support the increased activity, particularly during adverse weather. Severe drainage problems also exist in this stretch. Amoco proposes to upgrade .4 of a mile in the vacinity of the site. That would still leave approximately 2 mile stretch east of U.S. 85 that would not be upgraded. I have had previous discussions with Amoco representatives, contractors, and material suppliers in regard to the method of upgrading proposed. As of this time, I have not received any technical data on the stablization methods proposed. Because of previous discussions, and the contents of Mr. Dillard's letter, I am positive the surface course proposed is not a pavement, but rather a stablizing and dust preventative measure. It should not be construed that Amoco' s proposal would provide a permanent wearing surface. This surface will certainly have to be maintained with motorgraders. The stablization method in chemicals proposed are not unique. However, Weld County has had no experience in maintaining a surface that has been constructed with gravel , chemical , and dust oil as proposed. My concern is if the proposal does work, the County will end--up maintaining a heavily loaded road without an adequate surface. I think a Work Session with the Commissioners and Amoco is in order. FINDINGS The Commission finds as follows: 1. Amoco Production Company, as applicant herein, is an interested party in the subject matter of the above-referenced hearing. 2. Due notice of the time, place and purpose of the hearing has been given in all respects as required by law. 3. The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order. 4. The Sussex Sand reservoir encountered in the Well No,. 2 Leo Smits "B", located in the Nh'. NW Section 20, Township 2 North, Range 66 West, 6th P. M., Weld County, Colorado, between the approximate depths of 4475 and 4610 feet subsurface, has been defined and determined by drilling as underlying the following described lands in Weld County, Colorado, to-wit: Township 2 North, Range 66 West, 6th P. M. Section 17: S12-S-1 Section 20: N 1, N r S' and that said reservoir constitutes a common source of supply; and that such lands should hereafter be referred to as the Northeast Spindle Sussex Sand Unit Area0 5. The Unit Agreement and Unit Operating Agreement as presented by Applicant, are necessary to increase the ultimate recovery of oil and gas from said reser- voir, and that the terms provided therein are just and reasonable to all interests contained within said Sussex Sand Unit Area. 6. The proposed fluid injection project, which will initially be water injec- tion, and the use of other recovery techniques at some future date upon approval by the Director, for secondary recovery is necessary to increase the ultimate recovery of oil and gas, and that such operation, pursuant to said Unit Agreement and Unit Operating Agreement, will result in an estimated additional recovery of oil and gas with a value in excess of the estimated additional cost incident to conducting such operation. 7. Wells to be utilized as intake wells for the waterflood project are Well No. 1 Schmidt, NW�NF : Well No. 1 11 & Nl Schmidt, SW.NI': ;; Well No. B-2 Smits, NE NW-9r-; and Well No. B-1 Smits, SE NW E, all in said Section 20. The utilization of other wells in the unit area as intake wells when deemed necessary by the operator, should tw e,r) q be upon approval of the Director, and upon compliance with the rules and regulations of the Commission. 8. Testimony presented at the hearing showed that said Unit Agreement ' and Unit Operating Agreement have been approved in writing by those persons who, under the agreement, will be required to pay at least eighty per cent (80')/0 of the costs of the unit operation, and also by the owners of at least eighty_percent (80%) of the production or proceeds attributable to royalty, overriding royalty, and production payments. The Unit Agreement and Unit Operating Agreement covering lands in the Northeast Spindle Sussex Sand Unit Area, which agreements are attached to, and made a part of the original order of this Commission on file in the office of the Commission, are approved as being in the public interest for conservation. 2. The Sussex Sand reservoir, common source of supply, underlies the following described lands in Weld County, Colorado, to-wit: Township 2 North, Range 66 West, 6th P.
