RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL AND ACCEPT
REPLACEMENT COLLATERAL FOR USE BY SPECIAL REVIEW PERMIT#1217 -
FAITH TABERNACLE CHURCH, CIO DANNY PERDEW
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated January 29, 2001, the Board did approve an
Improvements Agreement According to Policy Regarding Collateral for Improvements (Private
Road Maintenance)with Faith Tabernacle Church, c/o Danny Perdew, 13248 Weld County
Road 72, Greeley, Colorado 80631, concerning property described as Lots 2, 3, 4, 5, 6, and 7,
Block 1, Peterson-Alexander Subdivision; being part of Section 16, Township 5 North,
Range 66 West of the 6th P.M., Weld County, Colorado, and
WHEREAS, pursuant to said Improvements Agreement, Irrevocable Letter of Credit
#000107 from Centennial Bank of the West, 2700 47th Avenue, Greeley, Colorado 80634, in
the amount of$13,000.00, was submitted to Weld County, and later replaced with Irrevocable
Letter of Credit#3305708-6001 from Vectra Bank of Colorado, 301 First Street, Kersey,
Colorado 80644, in the amount of$13,000.00, to Weld County as replacement collateral, and
WHEREAS, staff from the Weld County Departments of Planning Services and Public
Works has conducted visual inspections of the project and recommend cancellation and
release of said collateral, with 15 percent of the paving cost to be retained for a one-year
period, and
WHEREAS, the Board of County Commissioners deems it advisable to cancel and
release Irrevocable Letter of Credit #3305708-6001 from Vectra Bank of Colorado, 301 First
Street, Kersey, Colorado 80644, in the amount of$13,000.00, and to accept Personal
Check#1393 from Faith Tabernacle, in the amount of$1,500.00.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Irrevocable Letter of Credit#3305708-6001 from Vectra Bank of
Colorado, 301 First Street, Kersey, Colorado 80644, in the amount of$13,000.00, be, and
hereby is, canceled and released.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby
is, directed to return said collateral to the appropriate issuing party.
BE IT FURTHER RESOLVED, that Personal Check #1393 from Faith Tabernacle, in the
amount of$1,500.00 be, and hereby is, accepted.

Request for Release of Collateral
On November 28, 2001, the Department of Planning Services performed a site investigation of
the completed improvements for the Faith Tabernacle Church case number USR-1217 at the
request of Danny Perdew, the applicant. The completed improvements for which a draw is
being requested include the construction of Parking Lot Striping, Irrigation Ditch Improvements
and Landscape Treatment.
Don Carroll of the Weld County Department of Public Works, recommends the release of the
collateral for the full amount of$500 that was held for the parking lot striping item.
Kim Ogle of the Department of Planning Services has inspected the non-transportation items
and determined that there are several plant related issues that should be addressed. Referring
to the recorded Landscape Plan, the seven Viburnum opulus, Dwarf American Cranberry
adjacent to the sanctuary in the northeast corner of the structure are absent. Further, the
seven Berberis thunbergii, Crimson Pygmy Barberry adjacent to the Pastor's study entry are
absent. Adjacent to the northern most paved parking area, the Fraxinus pennsylvanica, Green
Ash is absent and the four Corpus servicea, Dwarf Variegated Dogwood and the three Pinus
nigra, Austrian Pines are absent from the planting areas noted on the drawing.
The area immediately north of the structure is to be planted in bluegrass. Staff did not visually
identify any bluegrass present at this location. Further, the area for future expansion to the
immediate west of the structure is identified as dryland pasture. This area upon visual
inspection did not appear to be planted with the dryland pasture mix.
Given the issues associated with a lack of plant material, the Department of Planning Services
recommends the withholding of fifteen (15) percent of the landscape item for a period of one
year. At the end of the one year if no replacement of plant material, including the native grass
areas, the bluegrass turf in and around the building and the planting of all shrubs, evergreen
and deciduous trees, the fifteen (15) percent collateral shall be released. Lee Morrison,
Assistant County Attorney, has advised that the release of funds would be in accordance with
the terms of the Improvements Agreement.
Therefore, the Departments of Planning Services and Public Works recommend that thirteen
thousand and no/100s ($ 13,000.00) dollars (Letter of Credit#3305708-6001 by Vectra Bank)
be released and be replaced with a new Letter of Credit. This release is conditioned on the
posting of the new Letter of Credit for one thousand five hundred ($ 1500.) dollars by the
applicant, thereby enabling all outstanding issues to be addressed and rectified. The applicant
has submitted a check in the amount of fifteen hundred (1500) dollars to replace the previously
identified Letter of Credit.

COLORADO Phase I
At the request of Planning Services, an inspection of the site was completed.
In referring to my memo dated December 21, 2000, the only transportation item that was not
completed for Phase I was the striping of the parking lot due to weather conditions.
I have verified that the parking lot striping is completed. I, therefore, recommend release of the
collateral for the full amount of$500 that was held for the striping item.
All other non-transportation items shall be verified by Planning Services prior to release of collateral
for Phase I.
