• RESOLUTION 038 RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL FOR IDAHO CREEK PLANNED UNIT DEVELOPMENT, S #554, PHASE 1 - KB HOME OF COLORADO, INC. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated March 7, 2001, the Board did approve the application of KB Home of Colorado, Inc., c/o Kent Carlson, P.O. Box 247, Eastlake, Colorado 80614, for a a Site Specific Development Plan and Planned Unit Development Final Plan, S#554, for 351 Residential lots in the Mixed Use Development area on the following described real estate, to wit: Part of the NW1/4 NE1/4 of Section 10, Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado, as shown n the final plat as Phase 1 of Planned Unit Development Final Plan, S #554, Idaho Creek, and WHEREAS, on October 22, 2001, the Board of County Commissioner of Weld County, Colorado, did approve an Improvements Agreement According to Policy Regarding Collateral for Improvements (Public Road Maintenance) for Idaho Creek PUD, S #554, Phase 1, between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and KB Home of Colorado, Inc., with terms and conditions being as stated in said agreement, and accept Development Bond #26 68 23, from American Home Assurance Company, in the amount of$2,001,967.00, and WHEREAS, staff from the Weld County Departments of Public Works and Planning Services have conducted a visual inspection and recommends reduction of said collateral to $533,454.00. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Development Bond #26 68 23, issued by American Home Assurance Company, be, and hereby is, reduced to the amount of$533,454.00, as stated in the Surety Rider issued on October 24, 2001, a copy of which is attached hereto and incorporated by reference. I I ^° 3 I COLORADO DATE: September 10, 2002 RECD FROM: Kim Ogle, Planner III r' SUBJECT: S-554, Idaho Creek, Filing I On-Site Improvements Release of Collateral On April 30, 2002 the Weld County Department of Public Works preformed a site inspection of the transportation portion of Exhibit A, Filing I for Idaho Creek PUD, case number S-554. Don Carroll in his memorandum dated May 3, 2002 states that all transportation related items for Filing I have been completed. In the Improvements Agreement, Item Nos. 8.1.5 and 8.1.6, it states that fifteen (15) percent shall be retained for a period of one year. At the end of one year and if no distress or repairs are needed to the asphalt, the fifteen (15) percent collateral ($25,000.) for the internal roads and ($6300.) for Weld County Road 7.5 off-site shall be released. On May 14, 2002, the Department of Planning Services preformed a site investigation of the completed improvements for Idaho Creek, Filing I at the request of the applicant. The Department of Planning Services determined that all non-transportation items associated with the First Filing have not been completed. Given this circumstance, the Department of Planning Services recommends retaining five hundred two thousand one hundred fifty-four (502,154.00) and no/100s dollars until the non-transportation related items are installed and approved by this office. Therefore, the Department of Planning Services and Department of Public Works recommend that two million and one nine hundred sixty-seven thousand (2,001,967.00) dollars and no/100s, be released. Staffs recommendation is to release the collateral, in the form of a Letter of Credit. This release is conditioned on the posting of a new form of collateral by the applicant. Consulting Engineers. There are 17 failures out of 69 compaction tests taken throughout the Filing 1 project on the final lift. This computes to approximately 25% of the final lift failing. I have retained 15% of your paving item, which is usually done for a period of one year for a guarantee. We require that a guarantee period now be extended for two years due to the high percent of failure. During the two-year period, we will monitor for distress or repairs needed. Possibly an additional overlay or seal coat is needed. At the end of the two-year period, we will re- evaluate Idaho Creek, Filing 1 , prior to release of any collateral associated with the pavement item. Around noon the foreman ordered a heavier vibratory roller. Only retests with change in density were recorded. The larger vibratory roller arrived at 3:10 pm. The large vibratory roller improved compaction results,and the third mat had all passing tests. Rolling of the mat continued until densities within project specifications were reached. Tests in this report represent about 1/4 of the tests performed.
