RE: APPROVE REQUEST FOR TEMPORARY VARIANCE TO HOURS OF OPERATION
AS ESTABLISHED BY USE BY SPECIAL REVIEW#536 FOR A DRY OPEN-CUT
GRAVEL PIT AND ASPHALT BATCH PLANT - LAFARGE NORTH AMERICA
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on February 9, 1983, the Board approved the application of Stromquist
Farms and Frontier Materials, Inc., 3600 Highway 52, Erie, Colorado, for a Use by Special
Review Permit for a dry open-cut gravel pit and asphalt batch plant, on the following described
real estate, to-wit:
Part of Sections 20 and 21, Township 2 North,
Range 68 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board has been presented with a request for a temporary variance to
the hours of operation as established by Development Standard #2 of said Permit, and
WHEREAS, on April 24, 2002, the Board of County Commissioners heard all of the
testimony and statements of those present, studied the request of the applicant and the
recommendations of the Weld County Department of Planning Services staff and all of the
exhibits and evidence presented in this matter and, having been fully informed, finds that this
request shall be approved.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the request of LaFarge North America for a Temporary Variance
to hours of operation as established by Use by Special Review Permit #536 for a dry open-cut
gravel pit and asphalt batch plant, in the A (Agricultural) Zone District on the hereinabove
described parcel of land be, and hereby is, granted as follows:
1. Nighttime operation shall be allowed during the period of mid-June through
August, as necessary, to provide asphalt for projects along 1-25.

Lafarge has requested to extend their hours of operation at the Stromquist Pit and Asphalt
Plant (USR-536). They are wishing to complete projects along 1-25 which require night
operations. The Weld County Attorney's Office has indicated that the Board of County
Commissioners should decide if this extension should be allowed.

RE: Special Project for USR-536:82:51, Stromquist Pit and Asphalt Plant
Dear Ms. Daniels-Mika:
As I had mentioned on my phone message yesterday, we are bidding on some CDOT
work and are trying to determine what we will need to submit to the county in order to
temporarily run the asphalt plant at night. We had requested the same temporary use in
1997 and the following information was submitted in letter form to get that approval:
Job Location: Paving 1-25 form Hwy 7 to 120th Ave
Project Production: 61, 446 tons
Time Frame: Mid-April through June, 1997
Hours of Operation: 6pm-5am
We were not required to go before the Planning Commission or County Commissioners.
Todd Hodges had approved our request in 1997.
The specifics on the project this year are as follows:
Job Location: Paving 1-25 form Hwy 52 to Hwy 66
Project Production: 50,000 tons
Time Frame: Mid-June through August, 2002
Hours of Operation: 9pm-5am
In your message, you mentioned that you had not encountered this issue before and you
thought that we would have to go back through the whole permitting process. I don't
think that I have the most recent changes to the zoning regulations, but in the copy that I
have it states the following under Sec. 23-3-20 Agricultural Zone - Uses allowed by right:
Asphalt or concrete batch plant used temporarily and exclusively for the
completion of a PUBLIC road improvement project.

CDOT projects are very time sensitive and I am assuming that is why this statement was
put in. This project has a 20-day notice to proceed. We cannot spend 6 months before
the Planning Commission and County Commissions, nor could any of our competitors.
CDOT has very stiff penalties for not completing the paving in 2002.
For traffic and public safety reasons, the Colorado Department of Transportation is not
allowing any paving during daylight hours. Anyone that will be doing the paving will be
under the same night requirements that we are asking for.
With this additional information, I would appreciate it if you could please review my
request and provide me with a written response.

COUNTY OF WELD, STATE OF COLORADO
ROAD IMPROVEMENTS AND MAINTENANCE AGREEMENT
THIS AGREEMENT, made and entered into this 17th day of
October , 1983, by and between the COUNTY OF WELD,
STATE OF COLORADO, hereinafter called "County" and FRONTIER
MATERIALS, INC., hereinafter called "Frontier".
WHEREAS, Frontier has applied to the County for a Use by
Special Review Permit for an open-cut gravel pit and asphalt
batch plant located in part of Sections 20 and 21, Township
2 North, Range 68 West of the 6th Principal Meridian, and
WHEREAS, said gravel pit and asphalt batch plant will
generate increased truck traffic, and
WHEREAS, the County roads serving the property will not
efficiently support the increased truck traffic, and
WHEREAS, the County and Frontier have reviewed proposed
improvements to the existing county roads and acknowledged they
will enhance the accessibility and safety of the haul route to the
above-mentioned gravel pit and asphalt batch plant,
NOW, THEREFORE, in consideration of the mutual covenants and
conditions hereinafter set forth, the County and Frontier mutually
agree as follows:
1. The designated haul routes to be improved will
be Weld County Road 5 from the entrance to the
gravel pit and asphalt batch plant south to
Weld County Road 18; Weld County Road 18 from
weld County Road 5 to Weld County Road 7; and
Weld County Road 7 from Weld County Road 18
south to State Highway 52.
2. The improvements will consist of a 3 inch thick,
24 feet wide hot bituminous asphalt mat and a
total of 6 inches of aggregate base course on
Weld County Road 7 from Highway 52 to Weld County
Road 18.
Weld County Road 18 from Weld County Road 7 to
Weld County Road 5 and Weld County Road 5 from
Weld County Road 18 to the entrance to the
gravel pit and asphalt plant will have a total
of 6 inches of aggregate base 20 feet wide. The
exact thickness of additional base course will
be determined by sampling and testing of the
existing materials.
3. Frontier will furnish the necessary base material,
hot bituminous pavement, equipment and labor to
construct the improvements.
4. The County will reimburse Frontier for the cost
of the AC-10 liquid asphalt required to manu-
facture the hot bituminous pavement.
