The legal description of the property involved is shown as part of the W1/2 SW1/4 of Section 21, Township 6 North, Range 66 West of the 6th P.M., Weld County, Colorado. If you wish to be heard by the Board of County Commissioners, it will be necessary for you to indicate your request by signing the bottom of this letter and returning it to this office. Regular hearing procedures will then be followed. In order to proceed as quickly as possible, we must receive your reply by November 18, 2002. Water Division 1,Water District 3 Dear Mr. Grahman: We have reviewed additional information submitted to this office on September 24, 2002 regarding the above referenced proposal to subdivide a 26.34-acre parcel into 8 single-family residential lots and one open space lot. The proposed water supply for the household use is still North Weld County Water District (District). A service agreement between the District and the developer was signed June 10, 2002. The Water Supply Information Summary Sheet included with this additional information indicates that the household use water requirement for the residential lots is 600 gallons per day per lot (5.37 acre- feet per year for eight lots), the irrigation water requirement for the residential lots is estimated at 32 acre- feet per year and the livestock (23 head) water requirement is estimated at 276 gallons per day (0.309 acre-feet per year), resulting in a total demand for the subdivision of 37.679 acre-feet. Irrigation water is proposed to be supplied through a transfer distribution system to be installed that will pump irrigation water from the irrigation ditch. The applicants currently own four (4) shares of Cache La Poudre Irrigation Company water and use these shares to irrigate the proposed development property. The applicants proposed to lease to the Homeowners Association 2.15 shares (15 acre-feet per share) of Cache La Poudre Irrigation Company water for the irrigation system for the eight residential lots. We want to bring to your attention that, due to lease-agreement for the irrigation water, the irrigation water may not be available to this subdivision on a permanent basis. Pursuant to Section 30-28-136(1)(h)(II), C.R.S., the State Engineer's office offers the opinion, that sufficient evidence has been provided to show that the proposed water supply can be provided without causing material injury to existing water right and the supply is expected to be adequate.
