HomeMy WebLinkAbout20020212.tiff HEARING CERTIFICATION DOCKET NO. 2002-03 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1359 FOR A HOME BUSINESS (STORAGE BUILDING FOR TROPHY PARTS) IN THE A (AGRICULTURAL) ZONE DISTRICT -JOHN AND RUTH TRAUPE A public hearing was conducted on January 23, 2002, at 10:00 a.m., with the following present: Commissioner Glenn Vaad, Chair - EXCUSED Commissioner David D. Long, Pro-Tern Commissioner M. J. Geile Commissioner William H. Jerke Commissioner Robert D. Masden Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Chris Gathman Health Department representative, Char Davis Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated January 4, 2002, and duly published January 9, 2002, in the Tri-Town Farmer and Miner, a public hearing was conducted to consider the request of John and Ruth Traupe for a Site Specific Development Plan and Use by Special Review Permit #1359 for a Home Business (storage building of trophy parts) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Mr. Gathman gave a brief description of the location of the site and surrounding uses. He stated 12 referral agencies reviewed this proposal, eight responded favorably, and he has received no correspondence from surrounding property owners. He submitted a Memorandum, marked Exhibit H, proposing changes to the Draft Resolution,which he reviewed for the record. (Switched to Tape#2002-02.) In response to Commissioner Geile, Mr. Gathman stated the applicant will be living on the site, and there is an existing residence. Commissioner Long, acting as Chair Pro-Tem, advised Ruth Traupe, applicant, that she has the option of continuing this matter to a date when the full board will be present. However, if she decides to proceed today, it will require three affirmative votes, or in the case of a tie vote, Commissioner Vaad will listen to the record and make the determining vote. Ms. Traupe indicated she would like to proceed today. Responding to Commissioner Jerke, Ms. Traupe explained they currently operate a retail trophy shop in Westminster, Colorado; however, they need more room and this residence will provide an ideal location. Responding further to Commissioner Jerke, Ms. Traupe explained they will be storing the components, such as bases, columns, and figures, used to create award trophies. In response to Commissioner Geile, Ms.Traupe stated they received a Certificate of Occupancy from 2002-0212 J(7: L ; �e /)/j PL1578 HEARING CERTIFICATION - JOHN AND RUTH TRAUPE (USR #1359) PAGE 2 the Department of Building Inspection within the last month, so once their current home is sold, they will move into this new residence. No public testimony was offered concerning this matter. Commissioner Geile moved to approve the request of John and Ruth Traupe for a Site Specific Development Plan and Use by Special Review Permit#1359 for a Home Business(storage building for trophy parts) in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion also included replacing all references to"a Use Allowed by Right in the C-2 (Commercial) Zone District" with "a Home Business," deleting Conditions of Approval #2.A.1.d, #2.A.1.d.1, #2.A.1.d.2, and #2.A.1.e.2, amending Development Standard #4.A to state, "One Federal Express truck five time a week" and renumbering as appropriate. The motion was seconded by CommissionerJerke,and it carried unanimously. There being no further discussion, the hearing was completed at 10:30 a.m. This Certification was approved on the 28th day of January 2002.
