Weld County Planning Department GREELEY OFFICE MAY 8 2002 RECEIVED May 6, 2002 18856 County Rd. 8 Brighton, CO 80603-9447 To: Department of Planning Services We received a letter notifying us that Javier Fernandez and Gabriela Gutierrez have requested a Special Review Permit for a Commercial Rodeo Arena in Vantage Acres. We live across the road and about an eighth of a mile away from this location on Road 8. Last summer when they held rodeos there, we could hear the music loud and clear, which we enjoyed for the most part,but after a while it began to become annoying. Our greatest concern, though, is the amount of traffic we had on Road 8 and that many of the drivers were driving extremely fast and it poses a threat to our grandchildren when they are out in our yard. We would certainly not enjoy having to contend on a regular basis with the amount of traffic,the trash left behind, and the rate of speed that many of the drivers operated under. We are also concerned about the use of alcohol and drugs that seem to become a part of this type of activity. We do not see where it would benefit our rural area in any positive way. Of Planning Services 1555 N. 17th Ave Greeley,CO 80631 RE: USR-1383 Javier Fernandez&Gabriela Guitierrez c/o Arid Guitierrez COMMERCIAL RODEO ARENA To the Board of Commissioners: We would like to express our strong opposition to this development Last summer when they had their first rodeo we were not happy with the way it was handled;very loud music and a PA system that we could hear inside our home;trucks,trailers,vans,cars,and buses roaring through the field stirring up clouds of dust,people pulling out of said field onto Rd 8 without stopping to see if there was any oncoming traffic, creating several close calls people parked on both sides of Rd 8 and walking across which created more problems for traffic on Rd 8. After this event there was trash everywhere that took them several weeks to finally get cleaned up. After all of the traffic in the field,it was very dusty whenever the wind blew because it destroyed any vegetation that was there. We did not complain to the Sheriff's Dept because we thought it might be a onetime affair,maybe a celebration(birthday,wedding etc.)and thought it wouldn't happen again. This event had a very large amount of people and vehicles and we can only foresee that if this is granted,it will grow and there will be no authority or supervision to control it. We live in a quiet rural neighborhood and do not wish to have this kind of venture in our neighborhood. This would open the door for someone to put any kind of motor type track in(motorcycles,cars,go-karts etc),auctions on a regular basis,and other ventures that are commercial and not suited for a family neighborhood. We are business owners ourselves,with a retail store in Denver that specializes in street rod car parts. We would never think to impose on our neighbors by having a"Rod Run"on our property. With the paccing of the school bond in our district our property taxes have now almost doubled,we at least know that our property value has also gone up. If this proposal is allowed to be passed we think it will affect our property value as well as the quality of our lives.that we moved to the country to enjoy. We are not opposed to business,just not in a residential area. There are many acreage's that are available in more open areas that would be better suited for this purpose. I have experienced the effects of past Rodeos at this location last year. They are dirty, dangerous and noisy. They last all day and drive folks inside where they have to turn the t.v.'s up to drown out the noise. We were able to survive those events by packing up our family and leaving for the duration. We have no objection to horses or equestrian activity; we own and rise horses ourselves, as do many of the folks who live here. But,the proposed site is only five acres. It is located in the middle of a residential area. There are dozens of homes within 4-500 yards of this location. Many more who have to drive through it. The events are extremely noisy due to the fact that a Mariachi Band has been on site at all previous events. The music is amplified and broadcast by a Public Address System, which was used in all prior events. Of the five acres available, about two to two and a half are used for parking. The entire area is packed with cars truck and horse trailers. Some vehicles must be parked along Road 8. There are people, including little children, running back and forth from the parking area to the arena between vehicles, trailers, horses and riders on horseback. There has to be at least three hundred to five hundred people cramped into this small area. Many members of this crowd spill out into the road and surrounding properties. Many of the crowds appear to be intoxicated, gambling and booze seem to be a major draw for this event. WCR #8 in this area is difficult to drive through with people and vehicles entering and exiting the "Rodeo"all day long. It is a dangerous situation and an accident waiting to happen for all involved. The sheer number of people, not to mention the inebriated state of many, coming here for these events create a risk of attracting an undesirable element and criminal activity to detriment of the surrounding property owners and their families. Fernandez and Gutierrez, the owners of the property have shown absolutely no regard for their neighbors in the past. When neighbors have approached them to voice their concerns, we are told"No Hable Ingles". When the Sheriff was called to deal with EXHIBIT complaints already addressed in this letter they seemed to be able to communicate just fine. Unfortunately, the Sheriff's was no help so your department was contacted. Add to our concerns the fact that these rodeos are so obnoxious that most if, not all, of us who are affected will want to sell and move if it is allowed to continue. Many of us have invested large sums of many in our property and stand to lose it if you allow this use. Where could we find a buyer(s) who would willingly spend 300-400,000 dollars on property if they had to deal with these issues for five months a year? If this commercial use is allowed the destruction to our residential property values will force us to recoup our losses by developing our own commercial uses out here. If you allow this use, could you turn other requests for commercial or light industrial uses? In short, this proposed use, if allowed will have an extremely negative impact on the people who live here. It will affect the quality of our lives, our property values and could have a long term disastrous effect even on those properties not located within a mile of the use. I have lived in this area for over fifteen years and have seen many changes, some good some bad. We do not always have the opportunity to control development of the land surrounding our homes but I feel very strongly about the development of commercial sites in an existing residential and agricultural environment. I have first hand knowledge of the impact this permit would have on the surrounding homes in this area. Last summer rodeos were held at this location without permits and were very disruptive. Not only was there a problem with the amount of people attending the event, but the noise, traffic, trash, and general appearance of the event site was horrendous. This is a residential housing development, not intended for commercial use and I don't feel the area is equipped to handle the problems that will be created by issuing a permit of this nature. There are houses in close proximity to the proposed site and those residents have lived in those homes for years. Is it fair to anyone to have the peace and quite we have come to expect disrupted by an event that none of us will ever attend? There are environmental concerns, as the land will not support vegetation when subjected to the expected volume of pedestrian and automotive traffic at both the rodeo site and the parking site. Parking The above location is a very small acreage with a house,detached garage,barn,out buildings,and an arena. There is very little area left for off-road parking,which requires overflow parking to be on the adjacent roads,WCR 8&Western Drive.Neither of these roads are designed for that type of use,especially for an event which attracts several hundred people.The events last summer demonstrated this problem with massive congestion. 3. Tragic Control As mentioned in the above item,there are two adjacent roads to this location.Neither of these roads were designed to handle the large volumes of traffic associated with an event which attracts several hundred people,with many of those people pulling horse trailers.At the end of one of the events last summer,4 vehicles were in a high speed race going north on Western Drive,then east on 195th Avenue.Both of these roads are narrow gravel roads which serve a large number of homes.As the race rounded the corner of Western Drive& 195th Avenue(a blind corner),2 pickups pulling horse trailers were side-by-side running at a high rate of speed.This sort of traffic hazards are very critical in our area due to large number of homes and hone back riding. 4. Animal Control As mentioned in Item 2,this location is a small acreage which is not suitable for a large volume of vehicles. This problem is aggravated even more due to the large number of animals required for such an event.Rodeo events require a large number of cattle and horses,which require considerable area for corrals,pens,feed storage,and water facilities. 5. We believe that our interest is valid as we travel WCR 8 to access our home multiple times daily. As a result, we drive directly in front of the proposed rodeo site. Last summer, we witnessed many rodeos at this address: Lot 19 Vantage Acres. At this time, we saw noticeably drunk drivers getting into vehicles and were overwhelmed by the increased traffic that parked on the shoulders (what there is of it) up and down WCR 8. With vehicles parked both on the north and south side of WCR 8, it was difficult to meet a car and to pass safely. We also believed that since alcohol was being served/consumed at these gatherings that our children would not be safe to ride their bikes on the weekends on our road, the dirt part of WCR 41. Living close to WCR 8 can be hazardous as drivers use our road as a fast cut off to get to the southbound I-76 frontage road. If that driver has been drinking at the rodeo, or is impaired in any way, their driving produces an unacceptable risk factor for all the families living on the dirt WCR 41. We are concerned that Agricultural land would be utilized in this Irresponsible manner. If the applicants were serious candidates, we believe they would have obtained the proper permits before holding rodeos in this zone. Please vote no on this special permit. According to the construction report, the well is producing from approxhni<itcly 58 tec'. deep to 78 feet deep. At this depth, the well is most likely withdrawing groundwater from an alluvial formation that overlies the Denver Basin bedrock aquifers. Since the permitted use at that time was "domestic", the allowed uses today would be those domestic uses that were in place at the time the well permit was issued in 1971 — subject to the limits of C.R.S. 37-92-602(1)(b). That statute limits the uses of this exempt well to ordinary household use in not more than three single family dwellings, irrigation of not more than one acre of home gardens and lawns, and the watering of the user's own non-commercial domestic animals. Use of this well to provide water for animals involved in a rodeo and for spectators or persons other than those that normally dwell in the residences would not be allowed. The animals would not be the user's own non-commercial domestic animals and the human consumption would not be part of ordinary household use This well could be evaluated for a permit for these uses if the well owner was to acquire a court approved augmentation plan to replace stream depletions caused by the use of the well. A well could also be drilled into the Lower Arapahoe aqulfcr (approximately 180 feet — 425 feet deep) to appropriate ground water for commercial uses. Withdrawal of water from this aquifer for commercial uses would also require a court approved augmentation plan. Finally, a well could be drilled into the Laramie-Fox Hills aquifer (approximately 770 - 1,040 feet deep) without the requirement of an augmentation plan. For a five-acre lot, there would be approximately 1 .0 acre-foot of water legally available on an annual basis. The issuance of any permit is subject to a complete and successful evaluation.
