Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and

WHEREAS, a public hearing was held en the 21st day of
January, 1981 at 2 : 00 o 'clock p.m. for the purpose of hearing
the petition of Steve and Caroline Brancucci, 8120 East 40th
Avenue, Henderson, Colorado 80640 , requesting a change of zone

WHEREAS, Section 81 of the Weld County Zoning Resolution
authorizes the Board of County Commissioners to grant a change
of zone upon the showing by the petitioner of certain facts , and
WHEREAS, the Board of County Commissioners heard all of
the testimony and statements of those present, has studied the
request of the petitioner and the recommendations of the Weld
County Planning Commission, and having been fully informed,
finds that changing conditions in the area justify said change
of zone.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the petition of Steve
and Caroline Brancucci for a change of zone from A-Agricultural
District to I-Industrial District on the above described tract
of land be, and hereby is, granted.
BE IT FURTHER RESOLVED by the Board of County Commissioners
that the reasons for approval contained in the Planning Commis-
sion recommendations dated December 2, 1980 be, and hereby are,
adopted as the findings of fact of the Board of County Commis-
sioners in this matter.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 21st day of
January, A.D. , 1981.

in the Chambers of the Board of County Comnissioners of Weld
County, Colorado, Weld County Centennial Center, 915 10th

It is felt that this request is consistent with the Comprehensive Plan and

Brighton has indicated their approval. Also it is compatible with surrounding

are adequate, it is not in a flood hazard area and is not in a geological hazard
area, etc.

THE DEPARTIcIENT OF PLANNING SERVICES STAFF RECOMMENDS THAT THIS
REQUEST BE denied FOR THE FOLLOWING REASONS :
Section 81.5.1. states that:
"The Planning Commission shall determine . . . that the proposal is consistent
with the Weld County Comprehensive Plan; if not, then that the zoning of the
property under consideration is faulty, or that changing conditions in the
area warrant a change of zone."
1. 1t is the opinion of the Department of Planning Services Staff that the applicant
has not adequately demonstrated in the submitted application materials or in
oral statements made prior to the scheduled Planning Commission Meeting that
the prcposed rezoning is consistent with the policies of the Weld County
Comprehensive Plan. Furthermore, it is the opinion of the Department of -Planning
Services Staff that the rezoning request is not consistent with the policies
of the Weld County Comprehensive Plan.
The City of Brighton Planning Commission has reviewed and -approved this request
for a change of zone (please refer to the attached letter) . However, the Depart-
ment of Planning Services Staff feels that the request is not consistent with the
Weld County Comprehensive Plan because the property does not appear to be located
within Brighton's Comprehensive Plan Area. Additionally, the property is not
located adjacent to the City of Brighton incorporated limits or adjacent to the
designated 'industrial portions of the planning area. The following policy, found
on pages 64 and 65 of the Weld County Comprehensive Plan addresses industrial
development. It states "zoning for industrial use in areas outside the area
covered by the comprehensive plans of the existing municipalities shall be
encouraged only for low -employee concentration, agriculturally related industries
or other industries that can show they cannot reasonably be accarodated within
the areas covered by the municipalities' conprdiensive plans. "
The proposed industrial zone change is not requested for an agriculturally
related industry. Nor is this an industry which cannot be reasonably accomodated
within the area covered by the Brighton Comprehensive Plan.

2. It is the opinion of the Department of Planning Services Staff that the
applicant has not adequately demonstrated in the submitted application
materials, or in oral statements made prior to the scheduled Planning
Commission meeting, that the zoning of the property under consideration
is faulty, or that changing conditions in the area warrant a change of
zone.
In the application materials the applicant has stated that the area has
changed over the last ten years from an agricultural area to a predominantly
industrial service and supply area. The applicant further states that there
are numerous industrial outlets in the proposed area. However, field inspec-
tions by the Department of Planning Services Staff show this property and
surrounding properties to be primarily mixed agricultural-residential in use
except for the subject property.
It is the Staff's opinion that no changing conditions exist in the area that
warrant the change of zone proposed. There have been no recent developments
on adjacent properties since the adoption of the Weld County Comprehensive
Plan.
It is the opinion of the Department of Planning Services Staff that the zoning
on the property under consideration is not faulty. Clearly, the City of
Brighton has set certain limits for growth and -development in the area by
the establishment of a Comprehensive Plan Area. This area has not been
included because at this time the City of Brighton would prefer to see low
intensity agricultural uses in this area rather than industrial development.
The historical use of this property has been agricultrual; this property
previously contained a storage warehouse for agricultural products. The use
of the property has changed only within the last year to be in conflict with
the Weld County Zoning Resolution.
3. It is the opinion of the Department of Planning Services Staff that the indus-
trial uses which could be allowed an the subject property, would not be
compatible with the surrounding land uses. If the rezoning request is
granted, the applicant could establish any Industrial use on the property,
many of which could conflict with the surrounding land uses.
The broad granting of uses inherent in establishing industrial zoning on the
property allows uses which may be more appropriate in a municipal area.
Adverse impacts associated with the industrial uses (such as noise, odor,
traffic, deterioration of air and water quality) could occur to surrounding
properties as a result of a change of zone on the property.

As indicated during the course of our telephone conference of Tuesday,
November 25, 1980, I represent Mr. and bfrs. Steve Brancucci who reside
at 8120 East 104th Avenue, Henderson, Colorado 80640, in connection with
'�\ the change of zone applications filed by Mr. and Mrs. Brancucci with the
DWeld County Department of Planning Services, covering two tracts, tne 4
J acres in size and another 2.324 acres in size, both of which are located
in North Weld County near the City of Brighton.
COZ 343:80:13 covers a tract of 2.324 acres, which tract of land is

adjacent to a much larger tract of land owned by Mr. and Mrs. Brancucci
which is utilized for agricultural purposes. The property i-s presently
zoned A-Agricultural. Currently located on the 2.324 acre tract is a
warehouse unit which has existed on the premises for -some period of time
and which has heretofore been utilized by the Brancucci family in connection
with their agricultural activities and operations. A domestic well is
presently located on the Brancucci farm and the pipeline from this
,domestic well which is at least 50 to 60 years old, provides domestic
water into the warehouse unit for drinking and sanitary facilities. As
outlined during the course of our telephone conference, if the change of
zone application is granted, it is the _intention of Mr. and Mrs. trancucci
to lease nut the warehouse unit and related 2.324 acre tract to oil and
gas supply firma desiring warehousing apace in the area as a part of the
on-going oil and gas operations now taking place generally in that area
of the county. As previously indicated, domestic water is now piped
into the warehouse unit and has been for some period of time and provides
domestic water service for both drinking and sanitary facilities. -It is
not intended that the water through the existing pipeline be used for
industrial purposes but as a domestic source of supply by the people

Dear Ms. Traxler :
The Brighton Planning Commission reviewed two referrals
concerning rezoning applications from Steve and Caroline
Brancucci . A concern was voiced in regard to the type of
development that has been occurring between Brighton and
Fort Lupton. It was felt that -each case must be reviewed
carefully to insure compatable development in this area.
It was also felt that it would be extremely difficult to
prohibit the conversion from agricultural to industrial uses
along this corridor.
The Brighton Comprehensive Plan calls lox low intensity
agricultural use for the area immediately surrounding our
projected municipal boundaries. In addition, the plan con-
tains a policy that discourages strip development between
Brighton and Fort Lupton.
After considerable discussion, the Brighton Planning
Commission voted (4 to 3) to recommend approval in both cases.

Beginning at the Southeast Corner of said Section 30 and considering the South
line of said Section 30 as bearing North 90'00' 00" West, with all other bearings
contained herein relative thereto;
Thence North 05°51 ' 39" West, 1498. 12 feet to the True Point of Beginning;

The 2.324 acre tract located in a portion of the 11/2 of Section 30,
Township 1 North, Range 66 West of the 6th P.M. , Weld County, Colorado,
the subject matter of this proposed zone change, is located in an area
which has drastically changed in character over the past number of years
from a predominantly agricultural area to what now appears to be a
predominantly industrial service and supply area with numerous oil and
gas industrial establishments located in the adjacent and general area.
A map demonstrating numerous industrial outlets in the immediate area is
attached to this statement of -explanation.
It is our understanding that the City of Brighton and the Adams County
Comprehensive Master Plan now includes that portion of Weld County lying
south of Weld County Road 4 as an area of proposed industrial activity.
As the Planning Staff of Weld County is no doubt thoroughly familiar,
existing business enterprises are now located in the general area where
the proposed zone change is requested. Included within the framework of
this general area, numerous concrete batch -plants, gravel quarries,
welding and machine shops and numerous oil and gas service and supply
firms, some of which -are located almost adjacent to the area of the
requested zone change.
Based upon the business activities which have occurred in the recent
past and which are now occurring, being oil and gas development activities,
and the increasing demand for industrial warehousing and industrial
service and supply firms to provide supplies and services to the area,
there is a continuing change in character of business activity from A-
_Agricultural to I-Industrial. The proposed zone change would clearly
appear to be a beneficial asset to the continued growth of the nil and
gas -exploration industry which is already located in this portion of
Weld County. A number of oil and gas service and supply firms, such as
Halaburton Industries and Western Company, have -placed regional headquarters
facilities in Weld County. There appears to be growing demand for the
construction and Erection of warehousing facilities and service supply
facilities for these various oil and gas firms, pipeline companies and
other related business activities.

Attached is the soils map and soils description you requester. Please
note that the major limiting factor for building sites is the shrink swell potential potential of the subsoil as it wets and dries. Special care will
need to be taken in the design of any septic system due to the rapid
permeability of the sand and gravel substratums.
Please be advised that this soils information is general in nature. An
on-site investigation should be conducted before any construction takes
place.

At the request of Mr. Melvin Dinner of Dinner and Hellerich,
Attorney at Law, I have investigat-ed the -gravel potential on two
parcels of land proposed -for rezoning from Agriculture] A to I-
Industrial . The two tracks are located in the SE/4 sec. 30,
T1N, R66W and lie on gravel -deposits shown as T3 on our gravel
resources map of the Fort Lupton quadrangle.
Although gravel has been mined elsewhere on this same deposit, the
material is probably too fine }grained tote considered an important
resource. The actual sizes of these parcels are more limitinig
factors. Certainly the smaller tract, 2.3 acres, obviously is
not workable. The larger tract, 4 acres, apparently is divided
by Colorado 85 and the UP rights-of-way and, therefore, would not
constitute a conveniently workable site.

We have reviewed the above referenced zone change requests.
The first request (COZ 343 :80:13) contains no mention of water use or
availability and, therefore, we cannot recommend approval. The second
request (COZ 343 :80:14) is to utilize a permitted well (registration no.
116824). This well has as conditions of approval that it will be used for
drinking and sanitary facilities only in-an individual commercial business
and use will not exceed 3110 _gallons per day. If the proposed use is
within these limitations , we would have no objection to approval of this
plan.
