HomeMy WebLinkAbout20021035.tiff RESOLUTION RE: APPROVE REQUEST FOR TEMPORARY VARIANCE TO HOURS OF OPERATION AND MAXIMUM NUMBER OF PARTICIPANTS ALLOWED AS ESTABLISHED BY USE BY SPECIAL REVIEW PERMIT#1208 FOR A PUBLIC RECREATIONAL FACILITY (PAINT BALL FIELD) IN THE A (AGRICULTURAL) ZONE DISTRICT - ACTION PURSUIT PAINT BALL, LLC, C/O ANTHONY NAVARRO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on April 21, 1999, the Board of County Commissioners approved the application of Henry and Carol Karre, 2240 East 24th Street, for a Site Specific Development Plan and Special Review Permit#1208 for a Public Recreational Facility (paint ball field) in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of Lots 1 and 2 in the NW1/4 SE1/4, and Lots 1, 2, 3, and 4 in the NE1/4 SE1/4 of the Union Colony Subdivision; being part of Section 15, Township 5 North, Range 65 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board has been presented with a request for a temporary variance to the hours of operation and maximum number of players allowed, as established by Development Standards#10 and #11 of said Permit, and WHEREAS, on April 24, 2002, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of Action Pursuit Paint Ball, LLC, do Anthony Navarro, for a Temporary Variance to hours of operation and maximum number of players allowed, as established by Use by Special Review Permit#1208 for a Public Recreational Facility (paint ball field) in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted as follows: 1. Nighttime operation shall be allowed on July 20 and July 21, 2002. 2. Maximum number of players may be exceeded on July 20 and July 21, 2002. Mr. Navarro states in his letter dated April 19, 2002 that this facility is scheduled to host a paintball competition. Please refer to the attached letter and brochure for additional information. The Department of Planning Services notes that Development Standard number 10 and 11 of USR 1208 states : 10. "Hours of operation from February 16 to November 14, shall be from 8:00 a.m. to 6:00 p.m. daily." 11. "The maximum number of players allowed shall be 50." The Department of Planning Services received this request and has forwarded this letter to the Board of County Commissioners for action. This is regarding USR#1208. We are hosting an event on July 20th thru the 21st 2002 at 2515 HWY 34 Bypass. We contacted Planning and Zoning in November when we were first approached by the promoters of this event. Planning and Zoning stated that an event of this size ( 150 people ), would not be an issue as long as I continue to follow the guidelines set down in our USR, namely adequate sanitation, Water, and Trash pickup. Additional parking will be provided at our new 10 acre paintball site that is located 1/4 mile from the existing site. We will then shuttle people to the existing site in the morning. We were told there might be a small fee and a form to fill out to be able to host this event so we gave the promoter our signed acceptance. This event will bring this large number of participants who during the two day event will give quite a boost to the local economy with consumption and usage of everything from hotel rooms, restaurants, gas, move theaters, etc.. We have hosted similar events for the last 4 years. None have come close to an event of this size and we are hoping that we can get approval for this event. if you have any questions please feel free to call me at 381-8188.
