HomeMy WebLinkAbout820601.tiff RESOLUTION RE: AIRCRAFT RENTALS FOR THE SHERIFF'S DEPARTMENT. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado Statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Sheriff's Office has a need to rent aircraft for law enforce- ment purposes and extradition of prisoners, and WHEREAS, the Sheriff's Office has qualified deputies to serve as pilots for such flights in accordance with all applicable rules and regulations, and WHEREAS, the Sheriff's Office only rents aircraft after comparing commercial flight costs to insure that the rental of the aircraft is the least expensive option for the Sheriff's Office, and WHEREAS, the Sheriff's Office has researched the least expensive aircraft rental agreement in the area, and WHEREAS, the Sheriff's Office has requested authorization for standing authority to rent the aircraft with the most advantage from a cost benefit point of view to the County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners that the Sheriff's Office is hereby authorized to rent aircraft when it is the most cost effective way to conduct a law enforcement activity or extradition of prisoners, and BE IT FURTHER RESOLVED that personnel authorized to fly specific aircraft for the Sheriff's Office may rent aircraft for official Sheriff's Office purposes once approved by the Sheriff, and BE IT FURTHER RESOLVED that such authorized pilots in the Sheriff's Office may sign on behalf of Weld County, the aircraft rental agreements with Steve Weigandt and Tri-County Aviation (Exhibit "A") . BE IT FURTHER RESOLVED that the names and qualifications of all authorized Sheriff's Office pilots operating under the authority of this resolution will be on file with the Director of Finance and Administration, and BE IT FURTHER RESOLVED that all Sheriff's Office pilots must operate within all applicable local , State, and Federal laws, rules, and regulations and terms of the aircraft rental agreements at all times while renting and flying an air- craft on behalf of Weld County. 820601 The above and foregoing resolution was, on motion duly made and seconded, adopted by the following vote on the 6th day of October, A.D. , 1982. ATAL AGREEMENT IN CONSIDERATION FOR THE RENTAL to me of aircraft owned or operated by Tri-County Aviation , on each flight I make , I agree to the following: 1 . GENERAL USE: I will retutn the aircraft at the agreed time, weather permitting, and will secure and clean it to the same condition that I received it. 2. RENTAL TIME STANDARDS:If the next succeeding number is visible at all, on the' Hobbs meter , then that is the applicable number. Discrepencies must be verified by a TCA.employee PRIOR to starting the engine; . 3. FAA REGULATIONS: I am familiar with FAA Regulations, generally, and other Federal, State and Local Air Regulations and agree to abide by them at all times. 4. REQUIRED SIGN-OFFS: Endorsemants from a TCA Flight Instructor are required prior to PIC operations for the following conditions: Initial check-out, Night flight, Mountain flying and Instrument flying conditions. 5. CHECK OUT STANDARDS: Licensed pilots may rent TCA aircraft after receiving a check-out and sign-off by a TCA instructor. Each type aircraft, i.e. , Tomahawk, Warrior,Arrow. etc. requires a seperate check-out. 6. RECENCY OF EXPERIENCE: To rent TCA equipmant a pilot must have flown that TYPE aircraft at TCA, within the preceding sixty (60) days. Exceptions based on time logged elsewhere, total time, ect. , may be made on an. individual basis by the Chief Flight Instructor. 7.WEATHER MINIMUMS:I will obtain weather reports and forecast immediatly before and during cross country flights and will not fly when ceilings are forecast to be below 3000 feet and visibility below 5 miles, unless I am on an IFR Flight Plan, properly rated for the flight and approved for IFR Flying by TCA. 8. FLIGHT PLANS REQUIRED: I will always file an FAA Flight Plan for any cross country flights. VFR OR IFR. 9. PIC OPERATIONS: I will allow no one else to fly the aircraft. • O. AIRPORTS APPROVED FOR OPERATIONS: I will land only at established airports as listed in the "Airport/Facility Directory," except as a precautionary or emergency measure, when reasonabl necessary; • I . GEOGRAPHICAL LIMITS: I will not operate the aircraft outside the Continental United States without the express written permission of the Chief Flight Instructor or. the General Manager of Tri-County Aviation. 2. ENROUTE TRIP EXPENSES: The amount of any parking, tie-down, or hangar charges, oxygen use, maps, charts, landing fees, sales or use tax or any other charges assessed against the air- craft, pilot or owner arising directly or indirectly out of the use or possession of a said aircraft by the renter during the term of this contract or until the aircraft is returned to the operator at location specified hereon, is the sole responsibility of the renter and shall be paid to the operator. 3. FUEL AND OIL purchased away from the base of operations must be verified by a receipt and will be reimbursed on that basis only. AIRCRAFT MAINTENANCE AWAY FROM HOME BASE: I agree not to tamper with, or attempt to repair any part of the airp'. :e or its accessories but will telephone the lessor collect for instructions in the event of a malfunction of any part of the airplane or its accessories. 5. ACCIDENT NOTIFICATION: I agree to report all accidents, major or minor, to the lessor at once, together with the names and addresses of witnesses and involved parties, and in the event of accident will not move the aircraft unless expressly authorized to do so by the lessor. RENTERS INSURANCE:The following notice is to inform you that subject to the conditions, limitations and exclusions of policies and subject to compliance with Tri-County Aviation's Rental Agreement, T'ri-County Aviation has in effect Aircraft Liability Insurance/Renter's Insurance protecting you as follows: a. Damage resulting from an in-motion accident $500. 18.LOSS OF USE TO LESSOR: I •agree to pay for loss of use, other loss or damage to the aircraft or to other persons or property caused in whole or in part by my failure to comply with the requirements contained in this agreement; 19.UTILIZATION:Renters may schedule the aircraft for as long as desired. They are then expected to use the aircraft for at least 70Z of the scheduled time. Mechanical problems an weather are cause for exception.A half-hour is. the minimum period of use. Cross Country Minimums Are: • a. Two hours daily, Monday thru Friday. b. Three hours daily. Saturday, Sunday, and Holidays If these levels of usage are not met the underage will be charged for at one-half (' ) the hourly rental rate. 2O.CANCELLATION: (A) Reservations of aircraft may be cancelled as late as the day prior to the flight. Reservations broken the day of the scheduled flight generally cause TCA to lose the use of the aircraft for that period and a nominal fee of $15.00 is charged the renter to help TCA defray the loss. (B)Aircraft on cross-country flight in excess of 3 days require a deposit equal to one-half of the minimum use expected for that period. 21 .1 ACKNOWLEDGE that I have read and understand this Agreement' and have received a copy of it.
