RE: ACTION OF THE BOARD CONCERNING MOBILE HOME PERMIT, ZPMH #2343,
AND AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST FAY AND BETTY MAVITY, C/O ROBERT MAVITY FOR
VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 25th
day of November, 2002, considered the request of Fay and Betty Mavity, do Robert Mavity,
15205 Mary Avenue, Fort Lupton, Colorado 80621, for a mobile home to be used as a
temporary use during a Medical Hardship, and
WHEREAS, said mobile home is located in an A (Agricultural) Zone District on a parcel
of land being more particularly described as follows:
Lot 8, Block 30, Aristocrat Ranchettes, Second
Filing, a Subdivision of Weld County, Colorado
WHEREAS, the applicant was represented by Robert Mavity, who requested the
application for a Mobile Home Permit, ZPMH #2343, be withdrawn, because the Medical
Hardship no longer exists, and
WHEREAS, Mr. Mavity admitted that another mobile is also currently located on said lot,
and
WHEREAS, Fay and Betty Mavity, do Robert Mavity, are allegedly in violation of the
Weld County Code because said mobile homes are located on said lot without proper permits,
and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until February 24, 2003, to allow adequate time for the property
owners to bring the subject property into compliance and for an inspection of the property by
the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the request of Fay and Betty Mavity, do Robert Mavity, for
permission to place a mobile home to be used as a temporary use during a Medical Hardship
on the above described parcel of land, be, and hereby is, withdrawn.
BE IT FURTHER RESOLVED by the Board of County Commissioners of Weld County,
Colorado, that said violation be referred to the Weld County Attorney's Office for legal action,
with an instruction for delay of action upon such referral until February 24, 2003, to allow
adequate time for the property owners to bring the subject property into compliance and for an
inspection of the property by the Department of Planning Services staff.

REQUEST: This is a request for a Mobile Home to be used as a Temporary Use During a Medical
Hardship.
LEGAL DESCRIPTION: Lot 8, Block 30,Aristocrat Ranchettes, located in Section 27, T2N, R66W
of the 6th P.M., Weld County, Colorado.

WATER SOURCE: Cistern SEWER SOURCE: Septic system
The Department of Planning Services' staff has reviewed this request and recommends that this
request be denied based on the following concerns:
1. It is the opinion of the Department of Planning Services' staff that the applicant has not shown
compliance with Section 23-4-180 of the Weld County Code, as follows:
a. A medical hardship exists in which the person to be living in the MOBILE HOME requires
the supervision and care of those persons residing in the principal DWELLING UNIT on the
property (or the reverse). Documentation of the medical hardship shall be established in
a letter from the subject's medical doctor or other evidence deemed suitable by the
Department of Planning Services. The letter shall be submitted as a part of the zoning
permit application and shall verify that the subject is physically impaired and requires full-
time care.
The Department of Planning Staff reviewed the information provided by the applicants,and
concurs that the mobile home currently located on the lot does not meet the requirements
as set forth in Section 23-4-180 of the Weld County Code, as full time care in not required
and assistance for maintenance problems on Ms.Mavity's acreage does not meet the intent
of a Medical Hardship.
b. There is no reasonable alternative available to the applicant for the care of a person who
needs medical supervision.
The Department of Planning Staff concurs there is an alternative as Ms. Betty Mavity
currently resides on the lot directly to the west of where Mr. Robert Mavity resides.

Should the Board of County Commissioners approve this request, the Department of Planning
Services' staff recommends the following conditions be attached:
1. Evidence from the Weld County Department of Health and Environment shall be submitted to the
Department of Planning Services stating that the existing cistern has been renewed.
2. Derelict manufactured (mobile) home: a manufactured (mobile) home that is partially or totally
damaged by fire,earthquake,wind,or other natural causes,or is in a state of general dilapidation,
deterioration, or decay resulting from improper lack of maintenance,vandalism,or infestation with
vermin or rodents. Any such derelict manufactured (mobile) home shall be returned to and
maintained in the condition as originally established on site and as inspected by the Weld County
Building Inspection Department, or it shall be removed from the site.
Noncommercial junkyard: An area where any waste,junk, or used or second hand materials are
stored or handled,including,but not limited to scrap iron and other metals,paper,rags,rubber tires,
building materials,and bottles. A noncommercial junkyard may also include the storage or keeping
of derelict vehicles. The noncommercial junkyard shall be totally enclosed within a building or
structure or visually screened from all adjacent properties and public rights-of-way.
3. All zoning permits for mobile homes during a medical hardship are temporary. Such permits shall
be subject to review annually on the anniversary of the original permit's issuance. Such permits
shall be extended only if the use continues to be in conformance with the criteria set out in Section
23-4-180. Any permit for a medical hardship use shall automatically expire, and the mobile home
shall be removed upon cessation of the medical hardship or at any such time as the mobile home
is used for other than the permitted use.
4. The applicant shall submit documentation to the Department of Planning Services by December
1st of each year describing the status of the medical hardship. This permit is temporary and shall
terminate once the medical hardship ceases to exist, at which time the applicant shall have thirty
(30)days to remove the mobile home from the property.
5. All proposed or existing structures will or do meet the minimum setback and offset requirements for
the zone district in which the property is located. Pursuant to the definition of setback in the Weld
County Code, the required setback is measured from the future right-of-way line.
6. Should noxious weeds exist on the property or become established as a result of the proposed
development the applicant/landowner shall be responsible for controlling the noxious weeds,pursuant
to Section 15-1-10 of the Weld County Code.
7. The applicant shall maintain compliance with Section 23-4-180 of the Weld County Code at all
times.

We are currently updating our medical hardship zoning permit records. These permits are temporary. Such

This letter is a letter of medical necessity for Betty Mavity.
Betty Mavity lives at 15165 Mary Avenue,Ft Lupton, Co. She has two additional trailers on her
property. Her daughter Jackie Gorman had lived in one trailer and her son Robert Mavity lives in
the other. Jackie recently passed away and there is no longer a need for this trailer. Betty has
significant health problems and heavy maintenance problems on her acreage which require
assistance. Robert's presence helps to provide for these needs.
Betty has asked for one years period of time to:
1. Move into the trailer that had been occupied by Jackie.
2. Remove and replace her present trailer.
3. Dispose of Jackie's trailer.

This letter is to inform you of our current status. My sister Jackie Gorman died recently,
unexpectedly and suddenly. Her estate is still being gone through which includes her mobile home
located at 15205 Mary Avenue, Fort Lupton, CO, It is planned that my mother, Betty Mavity,
will be moving into Jackie's old home. The attached letter lists Betty's current condition which
also requires aid in everyday chores. We would like to request that an extension be granted until
such a time as things are decided for sure and Jackie's estate has been settled. If you wish to
