Approved With Conditions
The Subdivision Exemption is approved in accordance with information submitted in the application and the policies
of Weld County. The Department of Planning Services has determined through its review that the standards of
Section 24-8-170 of the Weld County Code hove peen met.
1. Prior to recording the plat:
A. The plat shall be titled: Subdivision Exemption No. 947
B. The Kai property shall use the existing access points as no additional accesses shall be granted.
C. The applicant shall submit justification for the accesses located on the Wilson property to the Weld
County Department of Public Works. Evidence of Public Works approval shall be submitted to Weld
County Department of Planning Services. If approval is not granted, the applicant shall submit
evidence that the access has been removed.

D. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County
Department of Public Works to determine if a culvert is necessary at any approved road access point. If
a drainage culvert is required, a 15 inch Corrugated Metal Pipe (OMP) is Weld County's minimum size.
If the applicant chooses to place a larger culvert please contact the Weld County Department of Public
Works to adequately size the culvert.
E. Weld County Road 38 is designated on the Weld County Transportation Plan Map as a local gravel
road, which requires 60 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. A
total of 30 feet from the centerline of Weld County Road 38 shall be delineated right-of-way on the plat.
This road is maintained by Weld County.
F. The applicant shall submit written evidence to the Weld County Department of Planning Services
verifying that the occupant of the mobile home permitted by ZMF'H 1697, for temporary accessory farm
use, is principally employed at or engaged in the farming operation on the subject property in
accordance with Section 23-4-170 of the Weld County Code. The evidence shall consist of tax records,
employment agreements or other documentatla as determined suitable by the Weld County
Department of Planning Services. Failure to submit the required documentation may result in the
cessation of the allowance of the mobile home for temporary accessory farm use.
G. The applicant shall provide the Weld County Department of Planning Services with a Statement of
Taxes from the Weld County Treasurer showing no delinquent taxes exist for the original parcel.
H. The following notes shall be placed on the plat:
1) This Subdivisiorl Exemption is for adjustment of property lines between two contiguous parcels.
2) All proposed or existing structures will or do meet the minimum setback and offset requirements
for the zone district in which the property is located. Pursuant to the definition of setback in the
Weld County Code, the required setback is measured from the future right-of-way line.
No building or structure as defined and limited to those occupancies listed as Groups A, B, E, H,
I, M and R in Table 3-A of the 1997 Uniform Building Code, shall be constructed with-,
200-foot radius of any tank battery or within a 150-foot radius of any wellhead. Any construction
within a 200-foot radius of any tank battery or 150-foot radius of any wellhead shall require a
variance from the terms of the Section 23-6-10 of the Weld County Code.
3) Any future structures or uses on site must obtain the appropriate zoning and building permits.
4) Prior to the release of building permits, the applicant shall submit a recorded deed describing the
Lot upon which the building permit is requested with the building permit applications.
5) Should noxious weeds exist on the property or become established as a result of the proposed
development the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Chapter 15, Articles I and II of the Weld County Code.
6) All mobile homes as accessory farm uses are temporary. Allowance of the mobile homes shall
be extended only if the use continues to be in conformance with the criteria established in
Section 23-4-170 of the Weld County Code. The mobile homes shall be removed from the
property if the mobile home cannot be legally permitted for an approved use as listed in Chapter
23, Article IV, Division 3 of the Weld County Code.
7) Any disturbance of wetlands shall require the applicant to contact the Army Corps of Engineers
for permits pursuant to Section 404 of the Clean Water Act.
8) WELD COUNTY'S RIGHT TO FARM Weld County is one of the most productive agricultural
counties in the United States, ranking fifth in total market value of agricultural products sold.
The rural areas of Weld County may be open and spacious, but they are intensively used for
agriculture. Persons moving into a rural area must recognize and accept there are drawbacks,
including conflicts with longstanding agricultural practices and a lower level of services than in
town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to
rural area: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural
atmosphere and way of life. Without neighboring farms, those features which attract urban
dwellers to rural Weld County would quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area. Well run
agricultural activities will generate off-site impacts, including noise from tractors and
equipment; slow-moving farm vehicles on rural roads; dust from animal pens, field work,
harvest, and gravel roads; odor from animal confinement, silage, and manure; smoke from
ditch burning; flies and mosquitoes; and the use of pesticides and fertilizers in the fields,
including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of the
way of residential development without threatening the efficient delivery of irrigation to fields
which is essential to farm production.
Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found to be a
public or private nuisance if the agricultural operation alleged to be a nuisance employs
methods or practices that are commonly or reasonably associated with agricultural production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of
Delaware) with more than 3,700 miles of state and county roads outside of municipalities. The
sheer magnitude of the area to be served stretches available resources. Law enforcement is
based on responses to complaints more than on patrols of the county and the distances which
must be traveled may delay all emergency responses, including law enforcement, ambulance,
and fire. Fire protection is usually provided by volunteers who must leave their jobs and
families to respond to emergencies. County gravel roads, no matter how often they are bladed,
will not provide the same kind of surface expected from a paved road. Snow removal priorities
mean that roads from subdivisions to arterials may not be cleared for several days after a
major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for
public works or may be the private responsibility of the homeowners. Services in rural areas, in
many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be
more self-sufficient than urban dwellers.
Children are exposed to different hazards in the county than in an urban or suburban setting.
Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for
pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial
farm dogs, and livestock present real threats to children. Controlling children's activities is
important, not only for their safety, but also for the protection of the farmer's livelihood. Parents
are responsible for their children.

• 2. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the Weld County
Department of Planning Services. Upon approval of the paper copies the applicant shall submit a Mylar plat i•
along with all other documentation required as conditions of approval. The Mylar plat shall be recorded in the •
office of the Weld County Clerk and Recorder by Department of Planning Services' Staff. The plat shall be
prepared in accordance with the requirements of Section 24-8-150.1 of the Weld County Code. The Mylar
plat and additional requirements shall be submitted within sixty (60) days from the date the Administrative
Review was signed. The applicant shall be responsible for paying the recording fee.
3. The Department of Planning Services respectfully requests the surveyor provide a digital copy of this
Subdivision Exemption. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable GIS •
formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files format type is .e00. The
preferred format for Images is .tif (Group 4). (Group 6 is not acceptable). This digital file may be sent to
maps_Pco.weld.co.us.
4. The Weld County Department of Planning Staff's approval of this Subdivision Exemption is based upon
satisfying the above conditions. Should an applicant be unwilling or unable to meet any one of these
conditions, within 60 days of approval, then this case will be forwarded to the Board of County
Commissioners with a recommendation for denial.

owners a new line to be located on an existing fence line. The Wilson's property
has 2 existing residences, 5336 WCR 38. The mobile home on Lot l is served
by an existing septic system (G19860223) which had a final inspection by the
WCDPH$E on l 1/16/90. The other residence on Lot /also has a septic system.

Dear Mr. Carroll:
This letter is in response to the condition of approval IF for SE-947. This letter and attachment is
intended to provide information to you so that we may complete the condition prior to recording of the
plat. I have included a copy of the Planning Department's conditions of approval for your review.
Enclosed is a map of the conditionally approved SE for a lot line adjustment. The Site map shows the
existing access points into Lot I of the SE. I have labeled in red the three access points to correspond
with the information provided below.
Access I: The existing access is necessary for the continued use of the pasture located west of the
existing improvements. The existing fenced yards, structures and terrain of the pasture requires the
continued use of this access for livestock and farm equipment.
Access 2: This access is the main residential access to the existing structures on this site and doesn't
accommodate large farm equipment.
Access 3: This access it for large farm equipment and trailers. Farm Structures and animal loading is
accessed on this side of the existing improvements. As stated above access 2 doesn't accommodate large
farm equipment so this access is necessary for the continued operation of the farm.
This information is intended to provide you with justification for the existing access points on SE Lot I so
that condition of approval IF of SE-947 can be met. All three access points are critical to the continued
farming operation of this property.

COMMENTS:
WCR 38 is designated on the Transportation Plan Map a local gravel road, which requires a 60-foot right-of-
way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County.
Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the
required setback is measured from the future right-of-way line.
REQUIREMENTS:
The Weld County Public Works Department recommends approval of this application.
The applicant shall utilize the existing residential access to this parcel, and no additional accesses shall be
granted.
Utilize the existing agricultural, oil and gas, and ditch rods that are necessary for your agricultural operation.
No additional accesses shall be granted.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.

Soil Classification #4: Aquolls and Aquepts, flooded
4--Aquolls and Aquepts. flooded. This nearly level
map unit is in depressions in smooth plains and along the
bottoms of natural drainageways throughout the survey
area. Aquolls, which have a dark colored surface layer,
make up about 55 percent of the unit. Aquepts, which
have a lighter colored surface layer. make up about 25
percent. About 20 percent is soils that are well drained
and soils that have sandstone or shale within 48 inches of
the surface.
These are deep, poorly drained soils that formed in
recent alluvium. No one pedon is typical. Commonly the
soils have a mottled, mildly to moderately alkaline loamy
or clayey surface layer and underlying material that ex-
tends to a depth of 60 inches or more. In places they have
a gleyed layer in the underlying material.
Most of the acreage is subject to excessive runoff. The
water table is at or near the surface in spring and during
the peak of the irrigation season.
These soils are used for rangeland and wildlife habitat.
Some small areas are irrigated pasture.
The potential native vegetation is dominated by
switchgrass, prairie cordgrass, saltgrass, alkali sacaton,
big bluestem, indiangrass, western wheatgrass, slender
wheatgrass, sedge, and rush. Cattails and bullrush grow
in the swampy spots associated with these range sites.
Potential production ranges from 4,000 pounds per acre in
favorable years to 3,000 pounds in unfavorable years. As
range condition deteriorates, the tall and mid grasses
decrease, production drops, and saltgrass, sedge, and rush
increase. The farming and irrigation in adjacent areas has
increased the amount of salts on much of the acreage

tion. Switchgrass, big bluestem, indiangrass, western
wheatgrass, pubescent wheatgrass, intermediate wheat-
grass, tall wheatgrass, and tall fescue are suitable for

requirements of livestock. For successful seeding, a firm
prepared seedbed is needed. A grass drill should be used.
Seeding early in spring has proven most successful. Til-
lage is needed to eliminate the undesirable vegetation.
Wetland wildlife, especially waterfowl, utilize this unit.
The wetland plants provide nesting and protective cover
as well as some food. The nearby irrigated cropland,
where wildlife obtain much of their food and find protec-
ive cover, makes this unit valuable to both wetland and
npenland wildlife.
Openland wildlife, especially pheasant, use this unit for
cover and nesting. Deer find excellent cover in some
areas. These valuable wildlife areas should be protected
rom fire and fenced to prevent encroachment and
,,veruse by livestock. They should not be drained. Caps
