Approved with Conditions The Weld County Department of Planning Services has determined through administrative review that the standards of Section 24-8-40.B.1 through 24-8-40.B.6 of the Weld County Code have been met. This Recorded Exemption is approved with the following conditions in accordance with information submitted in the application and the policies of Weld County. 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations. 2. The applicant has proposed a well as the source of adequate water for Lots A, B and C. Property owners are advised that the quality of water available for usage may be limited to specific uses, i.e., "Domestic Use Only," etc. Because each situation is unique, the Department of Planning Services encourages property owners to contact the Office of the State Engineer, Division of Water Resources (1313 Sherman Street, Room 818, Denver, Colorado 80203. Phone 303-866-3581), to discuss each individual situation. 3. Topographic or physical features of the proposed Lots,such as ravines,ditches,streams etc. may limit the area available for a new or replacement septic system. Prior to recording the plat,the Weld County Department of Public Health and Environment recommends that the applicant review the Weld County )00a- 33Xe IP • Code pertaining to septic systems to assure that any installed septic system will comply with all setback requirements found in the Code. In the event the proposed lot is not of sufficient size to allow the installation of a septic system, the lot may need to be enlarged. 4. Prior to recording the plat: Due to the prime agricultural soils on Lot C, the applicant shall submit a proposed building envelope to the Department of Planning Services for review. Upon approval by the Department of Planning Services, the building envelope shall be delineated on the plat. If a drainage culvert is required, a 15 inch Corrugated Metal Pipe(CMP) is Weld County's minimum size. If the applicant chooses to place a larger culvert please contact the Weld County Department of Public Works to adequately size the culvert. yr: Weld County Road 65 is designated on the Weld County Transportation Plan Map as a local gravel road,which requires 60 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. A total of 30 feet from the centerline of Weld County Road 65 shall be delineated right-of-way on the plat. This road is maintained by Weld County. 7. The Colorado Department of Transportation (CDOT)has jurisdiction over all accesses to State Highways. The applicant shall submit written documentation that they have reviewed the information and are aware of the requirements for building. ti The applicant shall provide the Weld County Department of Planning Services with a certificate from the Weld County Treasurer showing no delinquent taxes exist for the original parcel. The following notes shall be placed on the plat: 1) All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. No building or structure as defined and limited to those occupancies listed as Groups A, B, E, H, I, M and R in Table 3-A of the 1997 Uniform Building Code,shall be constructed within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead. Any construction within a 200-foot radius of any tank battery or 150-foot radius of any wellhead shall require a variance from the terms of the Section 23-6-10 of the Weld County Code. 2) Any future structures or uses on site must obtain the appropriate zoning and building permits. 3) Prior to the release of building permits, the applicant shall submit a recorded deed describing the Lot upon which the building permit is requested with the building permit applications. The legal description on such deed shall include the Lot designation and Recorded Exemption number. 4) Prior to the release of building permits, the applicant shall submit evidence to the Department of Planning Services that Lots A, B and/or C have an adequate water supply of sufficient quality, quantity and dependability. 5) Potential purchasers should be aware that Lots A and B may not be eligible for a domestic well permit which allows for outside irrigation and/or the watering of stock animals. The State Division of Water Resources issues all well permits. 6) Potential purchasers should be aware that approval of this Recorded Exemption does not guarantee that well permits will be issued for the lots. If the lot owner is unable to obtain a well permit a lot may be deemed non-buildable. The Weld County Department of Public Health and Environment strongly encourages well users to test their drinking water prior to consumption and periodically there after. 8) Prior to the release of building permits for any structure exceeding 3,600 square feet,the applicant must comply with the requirements of Appendix III-A of the Uniform Fire Code. • 9) Should noxious weeds exist on the property or become established as a result of the proposed development the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code. 10) WELD COUNTY'S RIGHT TO FARM Weld County is one of the most productive agricultural counties in the United States, ranking fifth in total market value of agricultural products sold. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural area: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal pens,field work, harvest, and gravel roads;odor from animal confinement,silage,and manure;smoke from ditch burning;flies and mosquitoes;and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of the way of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware) with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment,ponds and irrigation ditches,electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their children. S 5. The Permittee shall refer to all additional standard requirements included with this permit and any enclosed additional terms, conditions, exhibits, and noted attachments. 3. Incorporated as part of this permit are the following: Application for Access Permit(CDOT Form No. 137) Permit(CDOT Form No. 101) and its two page attachment Exhibits: "A" -Access Plan "B" -Vicinity Map 4. This permit is issued in accordance with the State Highway Access Code(2 CCR 601-1),and is based upon the information submitted by the Permittee. This permit is only for the use and purpose stated in the Application and Permit. Any changes in traffic volumes or type, drainage, or other operation aspects may render this permit void, requiring a new permit to the be applied for based upon exisiting and anticipated future conditions. 5. Access construction methods and materials shall conform to the Colorado Department of Transportation Standard Specifications for Road and Bridge Construction(current edition). 6. If necessary,minor changes,corrections and/or additions to this permit may be ordered by the Department inspector, other Department representative or local authority to meet unanticipated site conditions. Changes may not be in violation of the State Highway Access Code. All major changes to the plans must be approved in writing by the Department prior to commencement of any work on or within the State Highway right-of-way. 7. This permit is subject to revocation due to: 1)Noncompliance with the provisions of this permit; 2) Abandonment; 3) Supersedure by new permit covering the same installation; or 4)Conflict with necessary planned highway construction and/or improvements. The Permittee shall promptly terminate occupancy upon notice of cancellation of the permit from the Department,unless a new permit is applied for and granted. 8. Reconstruction and improvements to the access may be required when the Permittee has failed to meet the required design and/or material specifications. If any construction element fails within two years due to improper construction or material specifications,the Permittee is responsible for all such reparis. 9. The Department retains the right to perform any necessary maintenance work in this area. 10. Backing maneuvers within and into the State Highway right-of-way are strictly prohibited. All vehicles shall enter and exist the highway right-of-way in forward movement. Backing into the right-of-way shall be considered a violation of the terms and conditions of this access permit and may result in revocation of the permit by the Department and/or the issuing authority. 11. Routine,periodic maintenance and emergency repairs may be performed within the State Highway right-of-way,under the general terms and conditions of the permit. Any significant repairs such as culvert replacement,resurfacing, or changes in design or specifications,will require written authorization from the Department. The Department shall be given proper advance notice whenever maintenance work will affect the movement or safety of traffic on the State Highway. In an emergency,the Department Region Office and the State Patrol shall immediately be notified of possible hazards. 12. All work is to conform to the plans referenced by this permit on file with the Department or as modified by this permit. (If discrepancies arise,this permit shall take precedence over the plans.) When it is necessary to remove any highway right-of-way fence, the posts on either side of the access entrance shall be securely braced with approved end posts in conformance with the Department's M-607-1 standard, before the fence is cut, to prevent slacking of the remaing fence. The access shall be maintained 28 feet wide with 20 foot radii. 15. Surfacing of the access shall be maintained as per Exhibit"A". 17. The access shall be maintained in a manner that will not cause water to enter onto the roadway, and will not interfere with the existing drainage system within the State Highway right-of-way. This property is split into 2 parcels. The south parcel is 150 acres and has an irrigation pond on it. The north parcel is 160 acres. Our intent is to install an irrigation pivot on the north parcel which will be fed from the pond on the south parcel. The pivot will enable us to use the water much more efficiently. We would like to exempt off two of the 5-acre corner parcels from the pivot. We intend to give the deed for the 150 acre south parcel to our parents,but before we do we need to establish a 30 foot easement road the length of the 310 acres which will provide access to the irrigation pond from either Highway 52, or County Road 10. The access from Highway 52 is already an established agricultural access that we have applied to be residential access also. We will also need easement for the irrigation pond,and for the water line that will run from the pond to the center of the pivot on the north parcel. These easements will be necessary for us in order to continue farming in case anything ever happened to our parents and the land would change hands. These are all shown in the attached map in the exemption package. Water supply statements: A. Domestic use: Domestic well permits exist on all 3 proposed parcels B. Irrigation water: There are 240 acres of Henrilyn water on the 310 acre property. A sprinkler pivot will be installed on the north parcel which will pull water from the existing pond and irrigate all but the four 5-acre corners that the sprinkler will not reach. 2. The proposed lots will each have septic systems. The copy of the septic permit for the first of the proposed parcels is attached. The others will be pending. 3. The property is currently being farmed. An irrigation pivot will be installed on the north 160 acre parcel after the 2002 crops are harvested.The pivot water will be supplied from Henrilyn water collected in the existing pond. The south 150 acre parcel will be combination of irrigated and dry land crops. Approximately 80 head of cattle will be rotated through during the January through March calving season. 12 head of saddle horses will be kept on the property at all times. No existing improvements on land. 4. The proposed lots will be used for principal residences,livestock shelters, hay barns and possible farm help residence. 5. The entire property is currently being farmed. A map is included in this packet showing the proposed lots. 6. There is an existing irrigation pond and agricultural access from Highway 52 to the pond. Some areas of the property have better drainage than others. The lots have been planned accordingly. 7. No existing structures. This project falls primarily under the Weld County Recorded Exemption Standards. Our comments and requirements are as follows: COMMENTS: WCR 65 is designated on the Transportation Plan Map as a local gravel road, which requires a 60- foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. REQUIREMENTS: The Weld County Public Works Department recommends approval of this application. The access shall be placed in such a location to have adequate sight distance in both directions and not below the crest of a hill or where physical obstructions are present. (Lot A 5 ac parcel WCR 65) If a drainage culvert is required, a 15-inch corrugated metal pipe is the County's minimum size requirement. If the applicant chooses to place a larger culvert, please contact the Public Works Department to adequately size your culvert. Efforts are now under way to negotiate a School District-wide capital construction fee that is acceptable to the municipalities within Re-3J boundaries. As a compromise to resolve the status of RE-3288, the Board asks that--if the County approves this application-- it be with the stipulation that a fee will be assessed at the time of building permit or certificate of occupancy issuance that is equal to the per unit capital construction fee agreed to by the municipalities within Re-3J and in effect at the time of issuance. As stated previously,the Board considers a cash-in-lieu of land payment of$2,574 to be a"given." In addition, there is the expectation of a capital construction fee of a yet-to-be-determined amount. Although recorded exemptions, individually, represent a small increment of the total housing stock, the cumulative effect of several such approvals is exerting a considerable negative effect upon the school district's ability to provide adequate educational opportunities for the resulting students. Additionally, the substantial separation of these units from other more densely populated areas increases school transportation costs, further eroding the amount of funds that can be applied in the classroom toward educating the students. The school district's Board of Education is opposed to approval of additional new housing without adequate mitigation of both land and facility costs. However, in the event that the County Commissioners decide to approve this application, Weld County School District Re-3J respectfully requests that these exemptions be required to mitigate the costs of providing land for school sites as well as capital construction costs for the necessary educational structures, as explained below. Site Issues Based upon the district's school capacities and site size standards, the proposed exemption would generate the need for less than one acre of land; the cash equivalent would approximate $1,287 per single-family housing unit(see Table 1). If approved, it is requested that this amount be paid to the school district as a cash-in-lieu of land dedication for each new unit allowed. Further, statutory limitations on the School District's bonding capacity will not permit the district to add the space that will be required to adequately serve anticipated enrollment. Net bonding capacity available approximates $8.8 million, which is less than necessary to provide adequate space for existing students and those that will be generated by already approved residential projects, Unless school construction is enabled by some additional mechanism(s), certain interim capacity enhancing measures will be required above and beyond our current practice of adding portable classrooms. Many of these mechanisms are not well accepted by the district or our mutual constituents. As illustrated in Table 1A, the gross cost to provide facilities to serve single-family homes is about $9,104 per unit. After deducting for future taxes that will be paid to the district for current bond redemption payments, the net unmet cost per unit will approximate $5,763 per unit. It is requested that this per unit sum be paid by the applicant to mitigate the excess facility costs attributable to these housing units. Payment at building permit or certificate of occupancy would be acceptable to the School District. Recommendations The Board of Education remains very concerned about the recent trend toward accelerated residential activity throughout the district and the ensuing enrollment that will follow, as well as the district's physical and financial ability to serve that growth. Approval of additional residential development without a ready and identified means of providing appropriate infrastructure would not demonstrate good stewardship of the public trust. As stated previously, cash-in-lieu of land of$1,287 and unmet capital costs of$5,763 are requested for each single-family housing unit.
