HEARING CERTIFICATION DOCKET NO. 2002-64 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1376 FOR A BUSINESS PERMITTED AS A USE BY RIGHT OR ACCESSORY USE IN THE COMMERCIAL ZONE DISTRICT (LANDSCAPING MATERIALS YARD) IN THE A (AGRICULTURAL) ZONE DISTRICT -JENNIFER BARGEN AND BART STONEBACK A public hearing was conducted on September 4, 2002, at 10:00 a.m., with the following present: Commissioner Glenn Vaad, Chair- EXCUSED Commissioner David D. Long, Pro-Tern Commissioner M. J. Geile Commissioner William H. Jerke Commissioner Robert D. Masden Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Sheri Lockman Health Department representative, Char Davis Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated August 16, 2002, and duly published August 21, 2002, in the Tri-Town Farmer and Miner, a public hearing was conducted to consider the request of Jennifer Bargen and Bart Stoneback for a Site Specific Development Plan and Use by Special Review Permit #1376 for a Business Permitted as a Use by Right or Accessory Use in the Commercial Zone District (landscaping materials yard) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Chair Pro-Tem Long advised Bart Stoneback, applicant, that he has the option of continuing this matter to a date when the full board will be present. However, if he decides to proceed today, it will require three affirmative votes, or in the case of a tie vote, Commissioner Vaad will listen to the record and make the determining vote. Mr. Stoneback indicated he would like to proceed today. Sheri Lockman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Lockman gave a brief description of the location of the site and surrounding uses, and stated eight referral agencies responded favorably or provided comments which have been incorporated into the Conditions of Approval and Development Standards. Don Carroll, Department of Public Works, stated the primary access to the site will be from Weld County Road 17, and they will use recycled asphalt on the driveway to keep the dust down. He further stated there are accesses along Weld County Road 4 leading to the oil and gas facilities. In response to Commissioner Jerke, Mr. Carroll stated Weld County Roads 17 and 4 each have a gravel surface. Bart Stoneback, applicant, stated they farm the majority of the lot, and they will operate a small landscaping business with six employees, and have a limited storage of materials. In response to Commissioner Jerke, Mr. Stoneback stated they own 80 acres, the site plan delineates the proposed use is 600 feet from the road, there are no visual concerns,20 acres will remain in native grass, and 60 acres will be farmed. 2002-2344 PL1622 HEARING CERTIFICATION - JENNIFER BARGEN AND BART STONEBACK (USR #1376) PAGE 2 No public testimony was offered concerning this matter. Responding to Commissioner Long, Mr. Stoneback stated he has reviewed and agrees with the Conditions of Approval and Development Standards as proposed. Commissioner Jerke moved to approve the request of Jennifer Bargen and Bart Stoneback for a Site Specific Development Plan and Use by Special Review Permit#1376 for a Business Permitted as a Use by Right or Accessory Use in the Commercial Zone District(landscaping materials yard) in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission,with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Masden, and it carried unanimously. There being no further discussion, the hearing was completed at 10:45 a.m. This Certification was approved on the 9th day of September 2002.
