Subject: Acquisition of land by school districts
Dear Commissioners:
Recently the St. Vrain Valley School District [SWSD] acquired land in Weld County for the purpose of
constructing a school on it in the future. CRS22-32-124 requires: "Prior to the acquisition of land or any
contracting for the purchase thereof, the board of education shall consult with and advise in writing the
planning commission, ,that has jurisdiction over the territory in which the site is proposed to be located
in order that the proposed site shall conform to the adopted plan of the community insofar as is feasible".
President Hall of the [SWSD] has stated that the district did not inform Weld County when the
Hergenreder property was acquired. This property lies in the MUD district and has agricultural zoning in
which the erection of a public school is a use by right.
I understand that the SWSD board of education will be meeting with the Weld Board of County
Commissioners on July 22, 2002 and may bring this to your attention in addition to sending a
communication making you aware of the purchase.
Please consider:
[1] The letter will not be timely as required by the statute.
[2] It is not within the powers of the SWSD to make a judgment as to the need to comply with the statute
because of the circumstances of any land acquisition.
[3] The statute requires that the Planning Commission be advised of the intention to acquire land. It
should be at the discretion of the Planning Commission as to whether a hearing or other action or
procedure is neccessary.
[4] There are other requirements for the school district specified in the statute relating to the acquisition
of land, that might be kept in mind for compliance.
I bring this to your attention not because of any opinion that I might have on this particular purchase, but
to insure that there is compliance with the statute so that any action or lack of action not in compliance
with it may be grounds for later contesting legal actions.
