RE: APPROVAL OF ROAD IMPROVEMENTS AND MAINTENANCE AGREEMENT
WITH CONNELL RESOURCES , INC . AND AUTHORIZATION FOR CHAIR-
MAN TO SIGN SAME
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners has been pre-
sented a road improvements and maintenance agreement between
Weld County and Connell Resources , Inc. , and
WHEREAS , the terms and conditions of said agreement are
as stated in the agreement, a copy being attached hereto and
incorporated herein by reference, and
WHEREAS , the Board has studied said agreement and deems
it advisable and in the best interests of the citizens of Weld
County to approve said agreement.
NOW, THEREFORE , BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the agreement for road
improvements and maintenance between Weld County and Connell
Resources , Inc. be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be,
and hereby is, authorized to sign said agreement.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 16th day of
July, A.D. , 1984.

COUNTY OF WELD, STATE OF COLORADO
ROAD IMPROVEMENTS AND MAINTENANCE AGREEMENT
THIS AGREEMENT, made and entered into this 16th day of July
1984, by and between the COUNTY OF WELD, STATE OF COLORADO, hereinafter
called "County" and Connell Resources, Inc.
WHEREAS, LaPoudre Sand and Gravel , Inc. has been issued a Use by Special
Review Permit for an open-cut gravel pit located in Section 19, Township
6 North, Range 67 West of the 6th Principal Meridian, and
WHEREAS, said gravel pit will generate increased truck traffic, and
WHEREAS, the County roads serving the property will not efficiently support
the increased truck traffic, and
WHEREAS, the County and Connell Resources, Inc. have reviewed proposed
improvements to the existing county roads and acknowledged they will
enhance the accessibility and safety of the haul route to the above-
mentioned gravel pit.
NOW, THEREFORE, in consideration of the mutual covenants and conditions
hereinafter set forth, the County and Connell Resources mutually agree as
follows :
1 . The designated haul route to be improved will be Weld County Road 13
from the entrance to the gravel pit North to Colorado 392.
2. The improvements will consist of a 4 inch thick Hot Bituminous
asphalt mat, over 5 inches of Class 6 Aggregate Base Course and
4 feet shoulder.
3. Connell Resources , Inc. will furnish the necessary base material ,
hot bituminous pavement, equipment and labor to construct the
improvement.
4. The County will reimburse Connell Resources, Inc. for the
AC-10 liquid asphalt required to manufacture the HBP.
5. Connell Resources, Inc . will take care of the maintenance of the
traveled roadway from the pit entrance to Colorado 392 and the
County will maintain all other aspects of the right-of-way such
as culverts and signs .
6. The County will inspect and replace any culverts and bridges that
are in a deteriorated condition prior to paving.
7. All construction and materials shall be in accordance with the
State Department of Highways , Division of Highways, State of
Colorado, Standard Specifications for Road and Bridge Construction,
1981.
8. The County will provide testing and inspection for the construction.
9. The approximate cost to the county for the AC-10 liquid asphalt
is $18,000.
IN WITNESS WHEREOF, the parties have duly executed the agreement the day and
year first-above written.
