TO: Carla Angeli, Planner DATE: February 15, 2002 FROM: Donald Carroll, Engineering Administrator py `L COLORADO SUBJECT: AmUSR-1280, Kerr-McGee Gathering LLC The Weld County Public Works Department has reviewed this proposal; this project falls primarily under the purview of the Use by Special Review Standards,Weld County Code, Chapter 23,Article II, Division IV, Section 23. Our comments and requirements are as follows: COMMENTS: The access road where WCR 37 would be is designated on the Transportation Plan Map as a section line access road. The applicant indicated on the plat that there is a 60-foot right-of-way present. This road is not maintained by Weld County. The compressor station will operate 365 days a year,and it will be operated by the same personnel that currently operates the station. One operator maintains the station for four to eight hours per day. A maximum of 10 people may be on site at one time. The maximum work force for the plant construction is estimated to be 25 construction personnel. REQUIREMENTS: The Weld County Public Works recommends approval of the application. There is an existing Nonexclusive License Agreement in place with H. S. Gathering, LLC for the upgrade and maintenance of Weld County's right-of-way on WCR 37. Kerr-McGee Gathering is amending the USR and assuming the operations at this site; therefore, a new Nonexclusive License Agreement shall be required for the same section of County road access. Storm Water Drainage: The applicant indicated that collection ponds and silt fences will be utilized as needed to contain erosion both during construction and at the final operation in accordance with the storm water discharge plan and permit. The applicant will obtain this permit from the Colorado Department of Health. Evidence of the application should be submitted to the Planning Services and Public Works Departments for review. ' Utilities and right-of-way permits shall be required for any pipeline, utility crossing, or utilizing Weld County rights-of-way that may serve the proposed compressor site. We have no objections to this proposal. The applicant is proposing a well(s) as its source of water. Based upon the number of people using the site it does not appear that the well is regulated by the Colorado Primary Drinking Water Regulations. However, the applicant should be made aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment. We strongly encourage the applicant to test their drinking water prior to consumption and periodically test it over time. We recommend that the following requirements be met prior to allowing the plat to be recorded: . 1. The applicant shall amend the existing Emission Permit for the modification in the operation if the Colorado Department of Public Health and Environment determines that such a modification represents a significant change in emissions or production. 2. The existing CDPS Permit must be amended for the increased operation if the Water Quality Control Division of the Colorado Department of Public Health & Environment determines that such a modification represents a significant change in the discharge. We recommend that the following requirements be incorporated into the permit as development standards: 1. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. All wastes shall be appropriately handled, treated, and disposed in accordance with the application materials and all applicable rules and regulations. 2. Waste materials shall be handled, stored, and disposed in a manner that controls EXHIBIT /X- KERR-MCGEE,GATHERING LLC fugitive dust, blowing debris, and other potential nuisance conditions. , 3. Fugitive dust shall be controlled on this site. , 4. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in 25-12-103 C.R.S., as amended. • 5. Adequate hand washing and toilet facilities shall be provided for employees. Bathroom facilities shall be available for employees upon completion of the construction at the adjacent compressor site. 6. The applicant shall provide additional adequate toilet facilities (port-a-potty) during the construction phase of the project and removed upon completion. 7. The facility shall provide bottled water for drinking during construction of the project. . 8. The facility shall maintain compliance with all requirements of the Water Quality Control Division of the Colorado Department of Public Health & Environment. • 9. The facility shall comply all rules and regulations of the Air Pollution Control Division of the Colorado Department of Public Health & Environment. 10. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2 risitiat;"*" Weld County Referral January 28, 2002 D C. Building permits shall be obtained prior to any construction. A separate permit is required for all structures including towers and storage tanks. 2. A plan review is required for each building, tank or tower. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when applying for the permit. 3. Buildings shall conform to the requirements of the 1997 UBC, 1998 IMC, 1997 IPC, 1999 NEC and Chapter 29 of the Weld County Code. 4. Buildings, tanks and towers will require an engineered foundation based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. Foundation inspections may be performed by Weld County inspection personnel, Colorado Registered Engineers, or Special Inspection Personnel with prior approval from the Building Official. 5. Building height shall be limited to the maximum height allowed per UBC Table 5-B. Wall and opening protection and limitations shall be in accordance with UBC Table 5-A. Separation of buildings of mixed occupancy classifications shall be in accordance with UBC Table 3-B and Chapter 3. Setback and offset distances shall be determined by Chapter 23 of the Weld County Code. 6. A Flood Hazard Development Permit shall be submitted for buildings constructed within the 100-year flood plain. Please contact me for any further information regarding this project.
