HomeMy WebLinkAbout20020491.tiff HEARING CERTIFICATION DOCKET NO. 2002-14 RE: RESUBDIVISION FOR THE VACATION OF THE E112 OF TRACT 6, ARISTOCRAT RANCHETTES, 2ND FILING - MARTY MATHEWS A public hearing was conducted on March 6, 2002, at 10:00 a.m., with the following present: Commissioner Glenn Vaad, Chair Commissioner David D. Long, Pro-Tern Commissioner M. J. Geile Commissioner William H. Jerke Commissioner Robert D. Masden - EXCUSED Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Sheri Lockman Health Department representative, Pam Smith Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated February 15, 2002, and duly published February 20, 2002, in the Tri-Town Farmer and Miner and Greeley Tribune, a public hearing was conducted to consider the request of Marty Mathews for a Resubdivision for the vacation of the E1/2 of Tract 6, Aristocrat Ranchettes, 2nd Filing. Lee Morrison,Assistant County Attorney, made this a matter of record. Chair Vaad advised the applicant's representative, Todd Hodges, Todd Hodges Design, LLC, that he has the option of continuing this matter to a date when the full board will be present. However, if he decides to proceed today, it will require three affirmative votes, or in the case of a tie vote, Commissioner Masden will listen to the record and make the determining vote. Mr. Hodges indicated he would like to proceed today. Sheri Lockman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of Planning Services staff into the record as written. Ms. Lockman gave a brief description of the location of the site. She explained Tract 6 was originally a two-acre parcel which was illegally subdivided into two one-acre lots by the original owner. She stated under normal circumstances the property owners would be required to recombine the lots and create one legal parcel; however, this situation was complicated by the fact that owner of the west half did apply and was approved to construct a home. Ms. Lockman stated the Department of Planning Services recommends approval of this request to create two legal parcels and correct the illegal land split. Ms. Lockman also requested Condition #1.C because the applicant has provided evidence for individual septic systems for each home. Mr. Hodges stated this property was originally split in 1979, later recombined by the same property owner, and split again in 1993 prior to the sale to Mr. Mathews. Mr. Hodges stated the property is consistent with the surrounding lots,and Mr. Mathews also owns the 13-acre parcel to the south, which is not part of Aristocrat Ranchettes. Responding to Chair Vaad, Ms. Lockman reiterated Condition#1.C can be deleted because the septic permit was located by the Department of Public Health and Environment. 2002-0491 PL1586 HEARING CERTIFICATION - MARTY MATHEWS (S #616) PAGE 2 Drew Scheltinga, Department of Public Works, stated at the time he received the referral for this case, Mr. Mathews had already submitted a petition to vacate Higgins Avenue, which would have complicated this request due to access to other properties. He stated Mr. Mathews has since withdrawn his request, so he has no further concerns. Pam Smith, Department of Public Health and Environment,clarified there was a question regarding the septic system because it appeared there were two permits for the same address; however, the applicant has provided the original permit and she has no further concerns. No public testimony was offered concerning this matter. Commissioner Jerke moved to approve the request of Marty Mathews for a Resubdivision for the vacation of the E1/2 of Tract 6,Aristocrat Ranchettes, 2nd Filing, based on the recommendations of the Planning staff, with the Conditions of Approval as entered into the record. His motion also included deleting Condition of Approval#1.C. The motion was seconded by Commissioner Geile. Commissioner Jerke commended the Department of Planning Services and Mr. Hodges for working to resolve this situation. There being no further discussion, the motion carried unanimously, and the hearing was completed at 10:15 a.m. This Certification was approved on the 11th day of March 2002.
