Approved with Conditions
The Weld County Department of Planning Services has determined through administrative review that the
standards of Section 24-8-40.B.1 through 24-8-40.B.6 of the Weld County Code have been met. This
Recorded Exemption is approved with the following conditions in accordance with information submitted in
the application and the policies of Weld County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed
according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. The Applicant has proposed a well as the source of adequate water for Lots A and B. Property
owners are advised that the quantity of water available for usage may be limited to specific uses,i.e.,
"Domestic Use Only," etc. Because each situation is unique, the Department of Planning Services
encourages property owners to contact the Office of the State Engineer,Division of Water Resources
(1313 Sherman Street, Room 818, Denver,Colorado 80203. Phone 303-866-3581),to discuss each
individual situation.
3. Prior to recording the plat:
A. The plat shall be titled: Recorded Exemption No. 1207-01-1 RE-3286
OO, T -33a p
B. In accordance with Chapter 8, Article II of the Weld County Code, Lots A and B shall be
granted one residential access.Direct access from a public road shall be limited to one access
per legal parcel for residential use,no circle drives or additional accesses shall be granted.The
road shall be graded and drained to provide all weather access. Accesses shall be placed in
such a location as to have adequate sight distance in both directions,shall not be placed below
the crest of a hill or where physical obstructions are present and shall be a minimum distance
of 75 feet from any intersecting County or State roadway. Lot A and Lot B residential accesses
shall be from Weld County Road 38.
C. Lots A and B shall use the existing agricultural access points as no additional accesses shall
be granted.
D. All approved accesses shall be clearly shown on the plat.The applicant shall contact the Weld
County Department of Public Works to determine if a culvert is necessary at any approved road
access point. If a drainage culvert is required,a 15 inch Corrugated Metal Pipe (CMP) is Weld
County's minimum size. If the applicant chooses to place a larger culvert please contact the
Weld County Department of Public Works to adequately size the culvert.
E. Weld County Road 38 is designated on the Weld County Transportation Plan Map as a local
gravel road, which requires 60 feet of right-of-way at full build out. There is presently 60 feet
of right-of-way. A total of 30 feet from the centerline of Weld County Road 38 shall be
delineated right-of-way on the plat. This road is maintained by Weld County.
F. Weld County Road 13 is designated on the Weld County Transportation Plan Map as an
arterial status road, which requires 100 feet of right-of-way at full build out. There is presently
60 feet of right-of-way. A total of 50 feet from the centerline of Weld County Road 13 shall be
delineated on the plat as right-of-way reservation for future expansion of Weld County Road
13. This road is maintained by Weld County.
G. The applicant shall attempt to address the requirements (concerns) of the Johnstown Fire
Protection District as stated in their referral received May 1, 2002. Evidence of such shall be
submitted in writing to the Weld County Department of Planning Services.
'J H. The applicant shall attempt to address the requirements (concerns) of the Colorado Division
of Wildlife as stated in their referral received April 9,2002. Evidence of such shall be submitted
in writing to the Weld County Department of Planning Services.
/1. The applicant shall address the requirements of the Saint Vrain Valley School District RE-1J
as stated in the referral response received April 9, 2002. Evidence of such shall be submitted
// in writing to the Weld County Department of Planning Services.
he applicant shall submit a recorded deed for the N2 NE4 of Section 1, Township 3 North, -•
J.Lange 68 West.
K. Lot A shall comply with the less than thirty-five(35)acre maximum lot size required by Section
24-8-10.B of the Weld County Code.
K,--"( The applicant shall provide the Weld County Department of Planning Services with a certificate
from the Weld County Treasurer showing no delinquent taxes exist for the original parcel.
M. The following notes shall be placed on the plat:
1) All proposed or existing structures will or do meet the minimum setback and
offset requirements for the zone district in which the property is located. Pursuant
to the definition of setback in the Weld County Code, the required setback is
measured from the future right-of-way line.
No building or structure as defined and limited to those occupancies listed as
Groups A, B, E, H, I, M and R in Table 3-A of the 1997 Uniform Building Code,
shall be constructed within a 200-foot radius of any tank battery or within a
150-foot radius of any wellhead. Any construction within a 200-foot radius of any
tank battery or 150-foot radius of any wellhead shall require a variance from the
terms of the Section 23-6-10 of the Weld County Code.
2) Any future structures or uses on site must obtain the appropriate zoning and
building permits.
3) Prior to the release of building permits, the applicant shall submit a recorded
deed describing the Lot upon which the building permit is requested with the
building permit applications. The legal description on such deed shall include the
Lot designation and Recorded Exemption number.
4) Prior to the release of building permits, the applicant shall submit evidence to the
Department of Planning Services that Lots A and B have an adequate water
supply of sufficient quality, quantity and dependability.
5) Should noxious weeds exist on the property or become established as a result
of the proposed development the applicant/landowner shall be responsible for
controlling the noxious weeds, pursuant to Chapter 15, Articles I and II of the
Weld County Code.
6) Potential purchasers should be aware that groundwater may not meet all
drinking water standards as defined by the Colorado Department of Public
Health and Environment. The Weld County Department of Public Health and
Environment strongly encourages well users to test their drinking water prior to
consumption and periodically there after.
7) Potential purchasers should be aware that Lot A may not be eligible for a
domestic well permit which allows for outside irrigation and/or the watering of
stock animals. The State Division of Water Resources issues all well permits.
8) Prior to the release of building permits on Lots A and B, the Lot owner shall
verify with the nearest Town/City or Sanitation District to determine the location
of the nearest sanitary sewer line. In accordance with the Weld County Code,
if a sewer line exists within four hundred (400)feet of the property line and the
sewer provider is willing to serve the proposed structure, a septic permit cannot
be granted by the Weld County Department of Public Health and Environment.
Evidence of such shall be submitted in writing to the Weld County Department of
Planning Services.
9) WELD COUNTY'S RIGHT TO FARM Weld County is one of the most
productive agricultural counties in the United States, ranking fifth in total market
value of agricultural products sold. The rural areas of Weld County may be
open and spacious, but they are intensively used for agriculture. Persons
moving into a rural area must recognize and accept there are drawbacks,
including conflicts with longstanding agricultural practices and a lower level of
services than in town. Along with the drawbacks come the incentives which
attract urban dwellers to relocate to rural area: open views, spaciousness,
wildlife, lack of city noise and congestion, and the rural atmosphere and way of
life. Without neighboring farms, those features which attract urban dwellers to
rural Weld County would quickly be gone forever.
Agricultural users of the land should not be expected to change their long-
established agricultural practices to accommodate the intrusions of urban users
into a rural area. Well run agricultural activities will generate off-site impacts,
including noise from tractors and equipment;slow-moving farm vehicles on rural
roads; dust from animal pens, field work, harvest, and gravel roads; odor from
animal confinement, silage, and manure; smoke from ditch burning; flies and
mosquitoes; and the use of pesticides and fertilizers in the fields, including the
use of aerial spraying. Ditches and reservoirs cannot simply be moved out of
the way of residential development without threatening the efficient delivery of
irrigation to fields which is essential to farm production.
Section 35-3.5-102,C. R.S.,provides that an agricultural operation shall not be
found to be a public or private nuisance if the agricultural operation alleged to
be a nuisance employs methods or practices that are commonly or reasonably
associated with agricultural production.
Weld County covers a land area of over 4,000 square miles in size (twice the
State of Delaware)with more than 3,700 miles of state and county roads outside
of municipalities. The sheer magnitude of the area to be served stretches
available resources. Law enforcement is based on responses to complaints
more than on patrols of the county and the distances which must be traveled
may delay all emergency responses, including law enforcement, ambulance,
and fire. Fire protection is usually provided by volunteers who must leave their
jobs and families to respond to emergencies. County gravel roads, no matter
how often they are bladed, will not provide the same kind of surface expected
from a paved road. Snow removal priorities mean that roads from subdivisions
to arterials may not be cleared for several days after a major snowstorm. Snow
removal for roads within subdivisions are of the lowest priority for public works
or may be the private responsibility of the homeowners. Services in rural areas,
in many cases, will not be equivalent to municipal services. Rural dwellers
must, by necessity, be more self-sufficient than urban dwellers.
Children are exposed to different hazards in the county than in an urban or
suburban setting. Farm equipment and oil field equipment,ponds and irrigation
ditches, electrical power for pumps and center pivot operations, high speed
traffic,sand burs,puncture vines,territorial farm dogs,and livestock present real
threats to children. Controlling children's activities is important, not only for their
safety, but also for the protection of the farmer's livelihood. Parents are
responsible for their children.
4. The applicant shall submit two paper copies of the plat for preliminary approval to the Weld
County Department of Planning Services. Upon approval of the paper copy the applicant shall
submit a Mylar plat along with all other documentation required as conditions of approval.The
Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by
Department of Planning Services' Staff. The plat shall be prepared in accordance with the
requirements of Section 24-8-70 of the Weld County Code. The Mylar plat and additional
requirements shall be submitted within sixty (60) days from the date the Administrative
Review was signed. The applicant shall be responsible for paying the recording fee.
5. The Department of Planning Services respectfully requests the surveyor provide a digital copy
of this Recorded Exemption. Acceptable CAD formats are.dwg, .dxf,and .dgn(Microstation);
acceptable GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files
format type is .e00. The preferred format for Images is .tif (Group 4). (Group 6 is not
acceptable). This digital file may be sent to maps(c�r co.weld.co.us.
6. The Weld County Department of Planning Staff's approval of this Recorded Exemption
Application is based on satisfying the Conditions of Approval.Should an applicant be unwilling
or unable to meet any one of these conditions within 60 days of approval,then this case will be
forwarded to the Weld County Board of County Commissioners with a staff recommendation
for denial.

This is in response to the Administrative Review for RE-3286 dated May 15,2002.
Below is the required documentation required as conditions of approval prior to recording the plat:
3G. We shall attempt to address the requirements of the Johnstown Fire Protection District. This
application is for a two-lot recorded exemption. The application was approved utilizing water from private
wells which will be permitted through the Colorado State Division of Water Resources. There is fire
protection across the street.
314. We shall attempt to address the requirements (concerns) of the Division of Wildlife. The letter
dated April 9,2002 is concerned about the impact of construction to the site on the Black-tailed Prairie Dog
colony. DOW recommends that construction occur during November 1 and February 28 which will have
less of an impact to any nesting owls since it is unlikely that owls would be present at this time.
Construction activity will occur during the months of November and February.
This land will not be used for grazing. To decrease the impact to the area, future development will occur
outside the draws and wetland area and will be set back from the prairie dog area. It is important to plan
for wildlife before development begins to ensure that the wildlife will be there for future generations.
3I. We are aware of the requirements of the Saint Vrain Valley School District RE-1J. The School
District requires a fee of$645.00 to be paid per unit. This will be paid directly to the school district prior to
any building permits for the new created lot.
2L. Attached is the tax statement.
This letter should adequately address conditions of approval 2G, 211, 2I and 2L for RE-3286. We are
currently working on the plat with a surveyor on the plat. You should have received a copy for review
prior to submittal of the mylar.

Soil Classification #4: Aquolls and Aquepts, flooded
4—Aquolls and Aquepta, flooded. This nearly level
map unit is in depressions in smooth plains and along the
bottoms of natural drainageways throughout the survey
area. Aquolls. which have a dark colored surface layer,
make up about 56 percent of the unit. Aquepts, which
have a lighter colored surface layer, make up about 2.5
percent. About 20 percent is soils that are well drained
and soils that have sandstone or shale within 48 inches of
the surface.
These are deep, poorly drained soils that formed in
recent alluvium. No one pedon is typical. Commonly the
soils have a mottled, mildly to moderately alkaline loamy
or clayey surface layer and underlying material that ex-
tends to a depth of 60 inches or more. In places they have
a gleyed layer in the underlying material.
Moat of the acreage is subject to excessive runoff. The
water table is at or near the surface in spring and during
the peak of the irrigation season.
These soils are used for rangeland and wildlife habitat.
Some small areas are irrigated pasture.
The potential native vegetation is dominated by
switchgrass, prairie cordgrass, saltgrass, alkali sacaton,
big bluestem, indiangrass, western wheatgrass, slender
wheatgrass, sedge, and rush. Cattails and bullrush grow
in the swampy spots associated with these range sites.
Potential production ranges from 4,000 pounds per acre in
favorable years to 3,000 pounds in unfavorable years. As
range condition deteriorates, the tall and mid grasses
decrease, production drops,and saltgrass,sedge,and rush
increase.The farming and irrigation in adjacent areas has
increased the amount of salts on much of the acreage.
Management of vegetation on this soil should be based
on taking half and leaving half of the total annual produc-
tion. Switchgrass. big bluestem, indiangrass, western
wheatgrass, pubescent wheatgrass, intermediate wheat-
grass, tall wheatgrass, and tall fescue are suitable for
seeding. The plants selected should met the seasonal
requirements of livestock. For successful seeding, a firm
prepared seedbed is needed. A grass drill should be used.
Seeding early in spring has proven most successful. Til-
lage is needed to eliminate the undesirable vegetation.
Wetland wildlife, especially waterfowl, utilize this unit.
The wetland plants provide nesting and protective cover
as well as some food. The nearby irrigated cropland.
where wildlife obtain much of their food and find protec-
tive cover, makes this unit valuable to both wetland and
openland wildlife.
Openland wildlife,especially pheasant, use this unit for
cover and nesting. Deer find excellent cover in some
areas. These valuable wildlife areas should be protected
from fire and fenced to prevent encroachment and
overuse by livestock. They should not be drained. Capa-

ble years to 1,800 pounds in unfavorable years. As range
condition deteriorates,the sand bluestem,sand reedgrass,

and sand sage increase. Annual weeds and grasses invade
the site as range condition becomes poorer.
Management of vegetation on this soil should be based
on taking half and leaving half of the total annual produc-
tion.Seeding is desirable if the range is in poor condition.
Sand bluestem, sand reedgrass, switchgrass, sideoats
grams, blue grams, pubescent wheatgrass, and crested
wheatgrass are suitable for seeding. The grass selected
should meet the seasonal requirements of livestock.It can
be seeded into a clean,firm sorghum stubble,or it can be
drilled into a firm prepared seedbed. Seeding early in
spring has proven most successful.
Windbreaks and environmental plantings are generally
suited to this soil. Soil blowing, the principal hazard in
establishing trees and shrubs, can be controlled by cul-
tivating only in the tree row and by leaving a strip of
vegetation between the rows. Supplemental irrigation
may be needed at the time of planting and during dry
periods.Trees that are best suited and have good survival

Recorded Exemption Questionnaire
1. Water supply statements addressing the following:
a. Domestic use; Domestic water is proposed to be sewed by private wells.
b. Irrigation water; There is a 1/4 share of Highland irrigation water to stay with
Lot B.
2. A statement explaining that the proposed lots will have an adequate means for the
disposal of sewage in compliance with the requirements of the underlying zone district
and the Weld County Health Department. A copy of the septic permit or a letter from
the sewage disposal facility must accompany the application.

Proposed Lot A is located on the eastern portion of the property adjacent to
WCR 13 and WCR 38. Lot A has been historically been used for pasture and
is the non-productive portion of the parcel. Lot A will have the uses by right
in the agricultural zone district. Lot B is the western portion of the parcel and
includes the irrigated farmland. Lot B has historically been used for irrigated
crops and pasture. Lot B will continue to have the uses by right in the
agricultural zone district. At this time, there are 20 animal units located on
the site. There are no oil & gas activities on site.
4. The reason for the proposed recorded exemption with an explanation how each lot will
be used.
The purpose of this application is to split a non-productive portion from the
remaining property. As stated above, Lot A and Lot B will continue to have
the uses by right in the agricultural zone district.

Lot B will be 53 acres, more or less and Lot A will be 29 acres, more or less.

The Weld County Public Works Department has reviewed this proposal. Our comments and
requirements are as follows:
COMMENTS:
WCR 38 is designated on the Transportation Plan Map as a local gravel road, which requires a 60-
foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained
by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23,
Article III, Section 23-3-50, the required setback is measured from the future right-of-way line.
WCR 13 is designated on the Transportation Plan Map as an arterial status road, which requires
a 100-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is
maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code,
Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-
way line.
REQUIREMENTS:
The Weld County Public Works Department recommends approval of this application.
The access shall be placed in such a location to have adequate sight distance in both directions
and not below the crest of a hill or where physical obstructions are present.
Direct access from a public road shall be limited; only one access is allowed per legal residential
parcel. No circle drives will be allowed. In accordance with Chapter 8, Article II of the Weld County
Code, this policy shall apply to all new and existing accesses within the unincorporated areas of
Weld County. Properties within municipalities or other counties that access Weld County roads are
also subject to this policy.
The applicant shall utilize the existing agricultural/residential access to this parcel,and no additional
accesses shall be granted. (Lots A and B from WCR 38)
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the
property or become established as a result of the proposed development, the applicant/landowner
shall be responsible for controlling the noxious weeds.

Environmental Health Services has reviewed this proposal; the following conditions are
recommended to be part of any approval:
1 . A Weld County Septic Permit is required for the proposed home septic systems
and shall be installed according to the Weld County Individual Sewage Disposal
Regulations. Please note, the lot owners should verify with the nearest
Town/City or Sanitation District to determine the location of the nearest sewer
line. In accordance with the Weld County Code, if a sewer line exists within 400
feet of the property and the sewer provider is willing to serve the proposed
structure, a septic permit cannot be granted by the Weld County Department of
Public Health and Environment.
Additionally, please note the following:
1) This application is proposing wells as its source of water. The applicant should
be made aware that while they may be able to obtain a well permit from the
Office of the State Engineer, Division of Water Resources, the quantity of water
available for usage may be limited to specific uses, i.e. domestic use only, etc.
Also, the applicant should be made aware that groundwater may not meet all
drinking water standards as defined by the Colorado Department of Public Health
and Environment. We strongly encourage the applicant to test their drinking
water prior to consumption and periodically test it over time.

Dear Chris:
Thank you for referring the W. Donald & Maybelle Wilson Two Lot Recorded Exemption to the School District.
The District has reviewed the development proposal in terms of future student impacts and available school
capacity and has the following RECOMMENDATION: the District is OPPOSED to the approval of this
application due to this development's impact o tt_alreadv overcrowded school facilities.
The Board of Education has established a District-wide policy of opposing new developments that add to the
student enrollment of schools projected to be at or above 125% of their capacity. This particular application,
which is currently located in the Mead Elementary, Mead Middle School and Skyline High School Feeder, will
add 1 new single-family dwelling unit with a potential impact of I additional student in this feeder. The District
opposes this development because, as indicated in the chart below, Mead Middle School and Skyline High
School will exceed 125% of their capacity with the addition of students from this development. The District
may reconsider this opposition should the developer wish to discuss how the development can be better timed
to coincide with the District's construction of new facilities, or if other mitigation measures can be taken to
accommodate this development's contribution of new students in light of school capacity shortfalls.

The recommendation of the District noted above applies to the attendance boundaries current as of the dale of
this letter. Residential growth and new school facilities could affect the project's attendance area in the future.
As of this time, there are no anticipated boundary changes or facility expansions that would warrant a change
in the current attendance areas. Bus transportation would most likely be provided under the current
attendance areas.
Should the County decide to recommend approval of this development proposal, the School District's cash-in-
lieu and/or land dedication requirements would still need to be satisfied. This requirement involves the
dedication of land with the adjacent Infrastructure or payment of an equivalent cash-in-lieu fee based on the
student yield of the development. .Although cash-in-lieu fees are insufficient to help provide for construction of
schools and resolving capacity shortages, it does assist in the purchase of land for future school sites. Since
this property Is not a likely future school site, the fee would be assessed per the attached chart. Please let me

Dear Sherri,
I received and reviewed the proposal for the two lot exemption at the corner of WCR 13 and WCR 38.
During the review, I visited the site. In this letter you will find the Division of Wildlife comments
concerning the proposal.
The site consists of two land use types. Lot A has misc. short grasses and is used primarily for grazing.
While I was at the site I noticed that there were cattle on the site. There are also two dry/semi-dry creek
beds along the east side and down the middle of the lot. These creeks flow into the pond that is located
to the southeast of the lot. The lot appears to have had extensive grazing, even along the creek beds.
Black-tailed Prairie Dogs have colonized the entire lot and have spread into Lot B and surrounding
properties. Lot B appeared to be in agricultural use and had been tilled at the time of my visit and I could
not tell what was going to be planted there.
The Division of Wildlife is most concerned about the impact of construction to the site on the Black-
tailed Prairie Dog colony. The presence of Black-tailed Prairie Dogs gives rise to several potential
concerns from an ecological view as well as the public relations/public policy arena. This species, more
than any other, seems to inculcate strong emotions in people on both sides of the issue. Efforts to
remove the animals from a parcel may be met with strong resistance from individuals and/or organized
groups. From a biological standpoint, prairie dogs may be considered the key species in prairie
ecosystems. Studies indicate that the burrow system created by prairie dogs provide essential habitat for
literally dozens of other vertebrate groups. The relationship between prairie dogs and native grass stands
is well documented. Recently the National Wildlife Federation petitioned the U.S, Fish and Wildlife
Service (USFWS) to list Black-tailed Prairie Dogs, the species found in Weld County, as a threatened or
endangered species on the federal roster. Currently, in Colorado they are listed as a game species, which
allows take under sport harvest or to alleviate nuisance/damage situations.

Burrowing Owls, a species listed on the Colorado Threatened Species List, rely on prairie dog burrows as
critical nesting habitat. As a migratory species and a raptor, both the USFWS and the Colorado Division
of Wildlife protect Burrowing Owls. The species is considered primarily a summer resident of Colorado
and a casual winter resident on the eastern plains of Colorado. In winter, they are found from Texas and
New Mexico down into Argentina. The critical nesting period for Burrowing Owls occurs between
March 1 and October 31. During this time breeding females occupy burrows, generally in active prairie
dog towns, to nest and fledge their young. Females tend to raise one brood per year. Nesting owls will
return to the same prairie dog town to nest year after year unless the town is destroyed. When
confronted with human disturbance near nest sites, Burrowing Owls abandon the nest. Efforts to relocate
nesting owls have generally proven to be ineffective.
Prairie dog removal on this site should be required prior to development or construction work begins.
Trapping/transplant efforts or euthanasia are legal options for prairie dog removal. Euthanasia efforts
must occur through the use of approved toxicants and trapping and transplanting of prairie dogs requires
prior approval of the Colorado Division of Wildlife. Note that bulldozing active prairie dog colonies is
not an acceptable method of removal.
Furthermore, since prairie dogs are present at this site then surveys are needed for bald eagle, ferruginous
hawk,and western burrowing owls. All bird species are protected by the law and killing one is illegal. The
bald eagle(Federally and State Threatened)and ferruginous hawk(State Special Concern)use prairie dog
towns for feeding and the western burrowing owl(State Threatened)live in prairie dog holes. The following
should be observed:
- If construction is to occur between March 1 and October 31,prior to any earth-moving taking place,
the area should be presurveyed for the presence of burrowing owls by a certified biologist with proper
training. The owls are susceptible to being buried and killed in their holes by construction activity
during the nesting season. Please see the attached sheet titled"Suggestions for handling burrowing owl
issues"for more detailed guidance.
- If construction is done between November 1 and February 28, it is very unlikely that owls would be
present since they migrate out of the state during the winter.
Barriers are good option if the landowner wishes to keep the prairie dogs at the site, but does not want
them coming close to the proposed residence. This would be one of the better alternatives. If the
developer or landowner are interested in using barriers or have questions about them, they can contact
me and I can provide them with proper literature on the issue.
If grazing is going to continue on Lot B, it is also recommended that the creeks should be fenced and
grazing not allowed along the edges. Less grazing along the creeks would allow wetland species to
return to the area. Riparian areas are key habitat types to many species. They provide corridors for
wildlife movement and provide nesting areas for many bird species. The Preble's Meadow Jumping
Mouse and the Ute Ladies' -tresses orchid, both federally listed species, rely heavily on riparian areas for
their survival.

SUGGESTIONS FOR HANDLING BURROWING OWL ISSUES \t"oF9
This advice is intended as guidance for those intending to poison or otherwise impact a prairie
dog town. It would also apply to projects involving the live capture of prairie dogs. Burrowing
owls live in many prairie dog towns, using unoccupied prairie dog holes for nest sites as well
as for roosting. The owls are only present in Colorado during the period from about March 1
through October 31. They migrate out of state during the winter.
Federal and state laws prohibit the killing of burrowing owls. It is quite possible to kill these
birds inadvertently during prairie dog poisoning projects, removal of live prairie dogs, or during
earth moving for construction. Since the owls usually hide in burrows when danger approaches,
it is not practical to "chase them away" prior to prairie dog control. Because of this, the
Division of Wildlife suggests checking prairie dog towns for burrowing owl presence if any of
the above activities are planned between March 1 and October 31. Since they are migratory,
it is safe to assume that no burrowing owls will be present during the November 1 to February
28 period. The following guidelines are intended as advice on how to determine if burrowing
owls are present in a prairie dog town.
1) For Prairie Dog Towns Small Enough to be Easily Viewed from One Location:
On two consecutive mornings from sunrise until two hours after sunrise, view the prairie dog
town from a good vantage point using high quality binoculars. The owls may be standing on
the mound around a burrow, or often may be perched on fence posts or telephone poles on or
near the town. The weather should be reasonably clear and calm with no precipitation since
poor weather will cause the owls to be less active and stay below ground. If the weather
interferes, the viewing mornings do not need to be consecutive.
If no burrowing owls are seen in two mornings of searching, it is likely that owls are not using
the town.
2) For Prairie Dog Towns too Large to be Viewed from One Location:
Similar techniques to those described above should be used, but two or more stations may need
to be used to view the entire town. It may be necessary to spend two mornings at each viewing
point, but if there is considerable overlap in the area visible from the different points, less time
could be spent at each point. The viewer can use judgement on this based on local conditions
at the time. The bottom line is to devote enough time searching to assure that no burrowing
owls are present.
What to do if Burrowing Owls are Present:
If burrowing owls are confirmed to be present in the dog town, there are two options.

- Wait until November 1 or until it can be confirmed that owls have left the area before moving
forward with the project; or
- Carefully monitor the activities of the owls, noting and marking which holes they are using.
The owls may use several holes in a dog town. This is riot easy to do and may take
considerable time! When all the burrowing owl holes have been located and marked, prairie dog
holes more than 150 feet away from the owl holes can be poisoned or disturbed with little
danger to the burrowing owls. Poisoning or disturbing closer holes may endanger the birds.
Incidentally, bulldozing an active prairie dog town is not recommended for humane reasons,
regardless of whether burrowing owls are present.
BURROWING OWL IDENTIFICATION
Adult burrowing owls are small, about 9-11 inches in total length. They are brown with white
spotting and white barring on the chest. They have long legs in comparison to other owls.
Juveniles are similar to the adults but smaller, and have a white to buff colored chest without
barring.
