We have no objection to withdrawing our original recommendation providing the following two conditions can be met: 1. Mr. Mathews withdraws his request to vacate or close Higgins Avenue in writing. 2. The replat of Lot 6 not complicate or interfere with access to other properties. It's my understanding from our phone conversation this morning that neither one on the conditions will present a problem. Mr. Mathews left a phone message with Frank this morning asking to withdraw his request to close Higgins Ave. Frank will return Mr. Mathews call, but we still want it in writing. COMMENTS: The Weld County Public Works Department has received a separate request from the applicant, Marty Mathews, 15075 Higgins Avenue, to vacate Higgins Avenue from Mary Avenue south to Harold Avenue. A copy of Mr. Mathews request is attached. The applicant's request to replat the east half of Tract 6 is adjacent to that portion of Higgins Avenue being requested for vacation. Issues of access to Mr. Mathews' property located south of the east half of Tract 6 need to be resolved in conjunction with Case S-616. The vacation of Higgins Avenue should be done at the same time as a replat of the east half of Tract 6. Department of Pu is COLORADO Health and Environment CASE NO.: S-616 NAME: Marty Mathews The Weld County Health Department has reviewed this proposal. The applicant wishes to vacate the E2 of Tract 6, 2' Filing, Aristocrat Ranchettes. A review of our files finds a septic permit SP-9700184, address listed on the permit is 15024 Mary Ave, Ft. Lupton. However, based on a review of the documentation submitted with the permit application it appears the septic system is not for the E2 of Tract 6. The legal description submitted for the permit describes property between Tract 6 and Tract 11, 2n' Filing, Aristocrat Ranchettes. The perc test field inspection sheet indicates an irrigation ditch in close proximity to the perc test site. An irrigation ditch traverses the property between Tract 6 and Tract 11. All septic systems located on the property shall have appropriate permits from the Weld County Department of Public Health & Environment. The Environmental Health Division of the Weld County Department of Public Health & Environment was unable to locate a septic permit for the septic system located on the subject parcel. Any existing septic system which is not currently permitted through the Weld County Department of Public Health & Environment will require an I.S.D.S. Evaluation.
