RESOLUTION OF RECOMMENDATION TO THE BOARD OF COUNTY
COMMISSIONERS
Moved by Cristie Nicklas that the following resolution be introduced for passage by the Weld
County Planning Commission. Be it resolved by the Weld County Planning Commission that the
application for
CASE#: Town of Ault Intergovernmental Agreement (Ord- XXX)

REQUEST: An Intergovernmental Agreement between the Town of Ault and Weld County be
recommended favorably to the Board of County Commissioners for the following
reasons:
It is the Planning Commission's recommendation that the above mentioned Intergovernmental
Agreement meets the intent of the Weld County Comprehensive Plan as follows:
Comprehensive Plan UGB.Goal I states that "Weld County will encourage and assist each
municipality in establishing an intergovernmental urban growth boundary agreement. The
following UGB.Policy I states, Weld County recognizes that municipalities can and should plan
their own futures in terms of the nature and rate of growth. "
The Town of Ault has worked with Weld County in establishing this proposed Intergovernmental
Agreement and indicated their interest in planning for responsible growth. (Comprehensive Plan,
page 3-1).
2. Comprehensive Plan UGB.Goal 2 and UGB.Policy 2 indicate that "Urban development
shall be concentrated in or adjacent to urban growth boundary areas that provide an official
designation between future urban and non-urban uses. These boundaries shall be established
through an intergovernmental agreement between the municipality and the County. "
The Town of Ault has delineated their Urban Growth Boundary on the attached map. Through
this Intergovernmental Agreement, the Town of Ault has specified the future growth of their
community. Further, it is noted that Weld County recognizes that it is appropriate for its
municipalities to plan for growth at their current boundaries and in the surrounding areas.
(Comprehensive Plan, page 3-1).
3. Comprehensive Plan UGB.Goal 3 states that "the County and municipalities should
coordinate land use planning in urban growth boundary areas, including development policies

and standards, zoning, street and highway construction, open space, public infrastructure and
other matters affecting orderly development. "
Weld County recognizes that an intergovernmental urban growth boundary agreement is by far
the best tool for coordinating development for municipal/county interface. (Page 3-1,
Comprehensive Plan.) It is further noted that the County Commissioners imparted the following
criteria to guide the municipalities in developing their urban growth boundaries. These guidelines
are the impetus for many communities in establishing an Intergovernmental Agreement with
Weld County:
1. Growth should pay for itself in terms of initial costs, and in the long range, through good
design and functional efficiency.
2. Annexation patterns should directly correlate with municipal service areas.
3. Infill of communities is a far more efficient use of land than urban sprawl.
As outlined on pages 3-1 and 3-2 of the Comprehensive Plan, the county recognizes that when
growth at the municipal/county level is not coordinated, problems arise. Additionally, when a
municipality and the County enter into an Urban Growth Boundary agreement, the County agrees
to abide by the municipality's vision for future development in the area. Likewise, the
municipality agrees to limit its expansion to the defined areas where it plans to provide municipal
services. It is understood that urban growth is an ongoing process and Urban Growth Boundary
agreements will be subject to revision as needed.
4. The county recognizes that through intergovernmental agreements the municipality agrees to
limit its expansion to the defined areas where it plans to provide municipal services, therefore,
participating in responsible growth.
It is this belief that Weld County and the Town of Ault desire to enter into this Intergovernmental
Agreement.
The purpose of this Intergovernmental Agreement between the Town of Ault and Weld County is
to establish procedures and standards pursuant to which the parties will move toward greater
coordination in the exercise of their land use and related regulatory powers within unincorporated
areas surrounding each municipality. The community of Ault exercises governmental authority
over the same matter within its boundaries; including annexations.
It is the opinion of the Planning Commission and at the direction of the County Attorney that this
Intergovernmental Agreement be forwarded to the Board of County Commissioners with
favorable recommendation.

This recommendation is based, in part, upon a review of the application materials submitted by
the applicant, other relevant information regarding the request, and responses from referral
entities.

Lauren Light, Department of Planning Services presented Case USR-1363, reading the recommendation
and comments into the record. The Department of Planning Services is recommending approval of the
application along with the Conditions of Approval and Development Standards.
Fred Otis, attorney for Morning Fresh Farms Inc., stated that Ms. Light had done a great job in covering the
pertinent information and he will be happy to answer any questions. Ms. Clamp asked about the status with
coal interest. Mr.Otis stated that he had not received any notification from the mineral owners so there has
been no contact with them. Mr. Otis stated that he would like to see a change to Condition of Approval#2L
to state that the applicant will comply with the County and State Oil and Gas regulation setbacks. Mr. Otis
discussed the new laws with regard to notification and coming to an agreement with the Mineral Owners. He
does not believe that an agreement should have to be made but the attempt to address the concerns. The
Mineral owners have acquired a"friend in the Counties"that enables them leverage for acquiring benefits from
developers.
Mr. Morrison stated that it should be present in the record that if an agreement cannot be made with the
Mineral owners prior to the Board of County Commissioners that they would need to be present to identify the
issues of that agreement.
Cristie Nicklas asked staff and Mr. Morrison about the applicant being required to find out who the mineral
owners are and if they are not notified already. Mr. Morrison stated that Weld County has in place a
notification process as well as the state.
The Chair asked if there was anyone in the audience who wished to speak for or against this application. No
one wished to speak.
Fred Walker moved that Case USR-1363, be forwarded to the Board of County Commissioners along with

Robert Anderson, Department of Planning Services presented Case County Code 2001-XX, reading the
recommendation and comments into the record. The Department of Planning Services is recommending
approval of the application.
Bruce Barker interjected that on the notice that decisions on zoning and development plans are still made
by the county commissioners. This agreement contains a difference with reference to urban development,
this includes reference to cental water including permanent septic systems. The previous agreements
included public water and sewer but the Town of Ault desired the flexibility with regard to septic system
issue.
Stan Kass, mayor of Ault, provided clarification with regard to the IGA and the flexibility of accepting septic
systems into the town when annexed.
Cristie Nicklas asked the publication of the notice. Mr. Kass stated that it was published once in the North
Weld Herald paper along with the mailing of a letter to the surrounding property owners.
Cathy Clamp asked about the size of the Urban Growth Boundary and does the town feel that they can
service that size of the boundary. Mr.Kass stated that with the additional developments that are on the table
now those services will expand as the population expands.
The Chair asked if there was anyone in the audience who wished to speak for or against this application.
Cynthia Sidwell, has questions with regards prelude to annexation and what will be the impact concerning
land use as agriculture and the continuing use to operate as an agricultural use. Mr. Barker stated that it
does not require the owner to annex but if they wanted to develop they would have to petition for annexation
first and if it is accepted that will be when the impact would be felt. If the owners are keeping the land as
it there will be no changes felt. Mr. Barker stated that if a development was proposed the Town of Ault will
provide water and sewer if possible.
Malcom Birt, stated that he has five questions 1. How many time is it required to be published. 2. What
is definition of Urban development through Weld County and Ault. 3. Business out of home what is the
effect. 4. What will the effect be on his personal use of the property. 5. Are all the uses that have been
uses in the last years will they be grand fathered in. Mr. Barker stated that the publishing requirements are
in a different newspaper. The Planning Commission asked that the Town of Ault do an additional
notification. The definition of Urban Development is found in Paragraph 2.4. 3. There would be no
differences on the property uses. The change occurs when the owners are seeking to change the property.
JW Hutchinson, stated concerns were wanting to know about the annexation of the property if a
development of some type was wanted. If the sale of the property was done then the new owner would have
to deal with that issue.
The chair closed the public portion of the hearing.

On October 16, 2001, Case Number County Code-2001-0X was continued by the Planning
Commission. The applicant, the Town of Ault, was not present. At the hearing the Planning
Commission expressed concerns regarding citizen notification of inclusion in the Ault
Intergovernmental Agreement Area (IGA) and the lack of applicant representation.
The following day I spoke at length with the Mayor and expressed the Planning Commissions'
concerns. The Mayor volunteered at that point to notify all affected property owners, of the
proposed IGA and impending hearing) prior to the scheduled hearing on December 18, 2001.
Attached, is an abbreviated copy of the original package.

NOTICE OF PUBLIC HEARING
TO: Land Owner's within the Urban Growth Boundary of Ault,
Colorado, Weld County, State of Colorado.
The Town of Ault has been working on an Intergovernmental Agreement
(IGA) with Weld County for the past year, and as part of that agreement, we
have defined a growth boundary around Ault. That boundary is further
defined as WCR 84 on the north, WCR 37 on the east, WCR 80 on the
south, and WCR 33 on the west. Inside this Urban Growth Boundary the
Ault Municipal Government makes final decisions on zoning, annexations,
development plans, and on provisions for water and sewer service. Outside
the boundary the Weld County Government makes the decisions. Weld
County has requested that we advise you of this arrangement; that a hearing
to approve the IGA will be held on December 18, 2001 at 1:30 p.m. in the
Court House in Greeley; and that if you have questions or concerns you may
pick up a copy of the proposed IGA at the Town Hall in Ault, and/or attend
the hearing.
There are very few differences in policy between the Town of Ault and
Weld County regarding zoning and development, but if you intend to do any
developing yourself, or feel you might be affected by nearby development,
you are invited to become more informed by either of these means.
