Said described parcel of land contains 16 . 838 acres, more or less , including a strip of land 30 feet in width along the South edge for county road right-of-way purposes and is subject to any rights- of-way or other easements as granted or reserved by instruments of record or as now existing on said described parcel of land. WHEREAS, the petitioner was present, and WHEREAS, evidence was presented in support of the granting of the Special Use Permit for a dairy operation on the above described real estate, and WHEREAS, Section 3 . 3. (E) (2) of the Weld County Zoning Resolu- tion authorizes such a use in an Agricultural Zone District upon approval by the Board of County Commissioners, and WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and statements of those pre- sent, has studied the request of the petitioners and the recom- mendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, is satisfied that the request for a Special Use Permit for a dairy operation on the hereinabove described real estate, conforms to the purposes of Section 3 . 3 (E) (2) of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application of James and Judy Docheff for a Special Use Permit for a dairy operation on the hereinabove described tract of land be, and hereby is, granted subject to the following: 1. The Development Standards contained in the Special Use Permit. 2 . No building or electrical permits shall be issued on the Special Use Permit are until the Development Standards for the Special Use Permit have been placed on the Special Use Permit plat and said plat has been delivered to the office of the Department of Planning Services. BE IT FURTHER RESOLVED by the Board of County Commissioners of Weld County, Colorado that the reasons for approval contained in the Weld County Planning Commission recommendations dated September 2, 1980 be, and hereby are, adopted as the findings of fact of the Board of County Colluuissioners in this matter. Darrell Felton, adjacent landowner to the west, was present in opposition to the request. Following discussin of the request Commissioner Steinmark stated that the application was in order and this request is proper in .and agricultural zone. Commissioner Steinmark made a motion to approve the special use permit request for a dairy operation for James & Judy Docheff with the Planning Commission' s recommendations and development standards. The dairy operation on the hereon described parcel shall be limited to the facilities shown hereon which are designed to handle a total of 220 cows and all other uses permitted by right under Section 3.3.B. of the Weld County Zoning Resolution. 2. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. 3. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems. 4. Lagoons for wastewater retention shall be installed as per Rules and Guidelines for Water Pollution Control at Livestock Confinement Areas issued by the Colorado Department of Health, May 1968. The applicant shall be responsible for any additional applicable directives or guidelines issued by the Colorado Department of Health, Water Pollution Control Division . 5. All accesses shall have the approval of the Weld County Engineering Depart- ment. All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department. 6. All plans, specifications and data pertaining to the dairy operation shall be submitted to the Weld County Health Department for approval prior to obtaining a Building Permit for the dairy operation. 7. There shall be no discharge of wastes into any streams, other bodies of water, or adjacent drainage systems without obtaining a National Pollution Discharge Elimination System Permit from the Colorado Department of Health. 8. The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Development Standards shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services. 9. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Development Standards. Non-compliance with any of the above stated Development Standards may be reason for revocation of the Special Use Permit by the Board of County Commissioners. This will be a blatant violation of your zoning code. It is a half—mile from Road 3 to our line. The dairy will be not only well under the half mile limit of the area zoned for housing in Section 30 and the east side of Road 3 in Section 29, but will be constructed so that we, less than one—third mile away, will have all the disadvantages of a blocked view, dust, noise, and noxious odors. From a personal standpoint, I am the one who will be affected most by land devaluation. Already, Mr. Docheffls house, farm buildings, end corrals are lined up north to south facing us, thus interfering with our view of the mountains. The dairy operation will complete the barrier. Any future land development to take advantage of the scenic beauty of Union Reservoir will be destroyed . Mr. Docheff works es en artificial inseminator for cattle in association with an artificial insemination company. This business could easily be included in the dairy operation using donor bulls. The two enterprises together could create a commercialization of the area with innumerable problems. From a community standpoint, this is en area of good farmland, enjoying relative quiet and privacy. The view of the lake and mountains as you drive west on Road 2.8 is lovely. The bird—watchers are there each weekend . The young people are riding horseback along the road .
