The subject property is approximately 301 acres located in the West '/2 and W '/2 of the NE IA of Section 21, as well as the East 1/2 of the Southeast IA of Section 20, Township 3 North, Range 67 West of the 6th P.M., in Weld County, Colorado. (See the Vicinity Map in Section 44.2.1.) The property is approximately halfway between County Road 17 and County Road 19. State Highway 66 marks the southern border of the property. Existing zoning and use of the subject property and surrounding properties is agricultural. The intent is to mine the property to recover a substantial sand and gravel reserve that is of significant commercial quality and quantity. The project will last approximately 20 years, and this time frame is highly dependent upon market conditions. The Applicant also requests that on-site asphalt and concrete batch plants utilize some of the aggregate produced. The end use of the property after reclamation will primarily be for wildlife and some potential residential development. Reclamation will be sequential and run concurrently with mining operations. The Town of Firestone property will be used for truck and equipment access during mining, and included with the reclamation plans thereafter. A temporary bike path system on Kurtz Ranch property will divert public pedestrian traffic out of the zone of mining operations and provide connections to open space trails to the north and south. The remainder of this application package discusses the proposal in detail and addresses all of the requirements of the Zoning Ordinance. 98023..WW D Kurtz Ranch Sand and Gravel Mine WC USR 1 802 1 Aggregate Industries West Central Region April Banks and Gesso, LLC SPECIFIC WELD COUNTY REQUIREMENTS 1 - Requirement 44.1 - Application Form (see following pages) Kurtz Ranch Sand and Gravel Mine WC USR 2 98023.WD Aggregate Industries West Central Region April 2001 Banks and Gesso, LLC 3 — Requirement 44.3 — Supporting Documents 44.3.1 - Colorado Mined Land Reclamation Board Submittal This separate document is enclosed at the end of this application package. 44.3.2 - Plans for Obtaining Water Supplies There is no evidence that obtaining additional water supplies will be required for this project. 44.3.3 — Cross Sections of Drainage Structures There are no drainage structures required by this project. 44.3.4 — Profile and Typical Cross Section of Haul Roads Internal haul roads will be utilized in the early phases of the mining process and will have access through the Town of Firestone property. Conveyors will be utilized to move material from the pit to the processing plant. The anticipated pavement section will be 4 inches of asphalt, over 8 inches of compacted aggregate basecourse. Culverts along the north side of Highway 66 will be adequately sized to handle stromwater in the ditch, and conform to any minimum size required by Weld County Public Works. 4 — Requirement 44.4 — Operating Policies In addition to the commitments contained in the Application to the Colorado Division of Minerals and Geology, the Applicant commits to the following operating policies: Kurtz Ranch Sand and Gravel Mine WC USR 4 98023.WD Aggregate Industries West Central Region April 2001 Banks and Gesso, LLC 44.4.1 - Setbacks The western mining limit will be maintained at a minimum of 100 feet from the east top-of-bank of the Saint Vrain Creek. On the north and south property lines, pending agreements with owners of these permanent man- made structures as outlined in the requirements of the Colorado Division of Minerals and Geology below, setbacks will be maintained at a minimum of 25 feet from buried pipelines and utilities. As required by Weld County zoning, mining will not take place closer than 125 feet to any existing residence on adjacent properties. Residences on the subject property shall remain after mining operations. Numerous gas and oil pipelines, pumps, and storage tanks are located on the Kurtz Ranch property. There are also various pipelines, ditches and utilities along the east and south property lines. A listing of these permanent man-made structures is included in the Colorado Mined Land Reclamation Board (CMLRB) Application in Section 44.3.1. Colorado State regulations prefer setbacks from these man-made structures of 200 feet unless the applicant obtains an agreement with the owner of the easement and structure to mine closer. Alternatively, the applicant has the option of supplying an engineer's report stating that mining closer than 200 feet will not affect the stability of the structure. The required agreements are being sought from property owners concurrently with submittal of applications to Weld County for a Use By Special Review Permit and to the CMLRB for a Regular 112 Permit. 44.4.2 - Hours of Operation The following hours are proposed for 6 days per week, Monday through Saturday: 6:00 A.M. to 10:00 P.M. for sand and gravel mining and processing 6:00 A.M. to 2:00 A.M. for maintenance and repairs 6:00 a.m. to 5:00 p.m. for truck hauling, asphalt and concrete operations Kurtz Ranch Sand and Gravel Mine WC USR 5 98023.WD Aggregate Industries West Central Region April 2001 Banks and Gesso, LLC The administrative/executive offices may operate 24 hours per day, 7 days per week. An exception to the above hours will be allowed when government contracts are obtained that require extended hours. In this case, 24 hour per day operations will be allowed to meet such contract requirements. 44.4.3 - Weed Control Plan The applicant shall cut or trim unsightly and noxious weeds as necessary to preserve a reasonably neat appearance and to prevent spreading on adjoining properties. Supplemental weed control activities may be undertaken by the landowner on portions of the property not subject to mining at a given time. 44.4.4 — Existing Trees and Ground Cover Existing trees and groundcover within the setbacks will be maintained. If trees and groundcover must be removed in the setbacks during mining, this vegetation shall be replaced according to the reclamation plan which is included in section 44.3.1. Existing trees and groundcover not within the setbacks shall be removed and replaced as per the reclamation plan. 44.4.5 — Access The location of the access to State Highway 66 is indicated on the Extraction Plan Map. 44.4.6 — Paving of Access Road The entrance to the property will be paved with a typical apron. The designated haul route to the site is Colorado State Highway 66. 44.4.7 - Fencing There is an existing three-strand barbed wire fence along the perimeter of the property. This fence will be maintained throughout the life of the mine. Additional security fencing will be installed to isolate the general public utilizing the pedestrian path on the Town of Firestone property from mining areas. 44.4.8 - Topsoil Salvage As per the reclamation plan in the CMLRB application, there is more than adequate topsoil on site to reclaim the site. The topsoil that will be salvaged for reclamation will be placed along the south and eastern property boundaries, and adequately seeded to prevent wind and water erosion. These locations for topsoil stockpiles will also provide a noise and visual berm for adjacent properties. 44.4.9 — Processing Equipment The plant site with the processing equipment (and asphalt and concrete plants) will be located in the south-east area of the site. This site was specifically chosen to provide continuous access for oil and gas operations, as well as to avoid conflicts with the concurrent reclamation and wetlands mitigation activities required for this project. Every effort will be extended to provide maximum protection from visual and noise impacts for nearby residences. 44.4.10 — Insurance Evidence of adequate liability insurance is included in Attachment 'A.' Kurtz Ranch Sand and Gravel Mine WC USR 7 98023.WD Aggregate Industries West Central Region April 2001 Banks and Gesso, LLC 44.4.11 - Vested or Conditional Water Rights It is not anticipated that the proposed project will cause injury to vested or conditional water rights. A substitute water supply plan has been prepared and will be submitted to the Colorado State Engineer. 44.4.12 - Additional Operation Policies 1. All operations on the subject property shall be in conformance with the Weld County Flood Regulations. A separate flood hazard development permit is being applied for in conjunction with this application. A — Fill, berms, and stockpiles shall be placed in accordance with the Weld County Flood Regulations and terms of the flood hazard development permit. B — All fuel tanks, septic systems, temporary buildings, and any other hazardous items that might wash away during flooding shall be located in the plant area, east of the railroad ROW, above the floodplain. Only mining and reclamation activities will occur in flood-prone areas of the property. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. 3. Waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4. The maximum permissible noise level shall not exceed the industrial standards, as measured according to section 25-12-102, Colorado Revised Statutes. 5. The applicant shall remove, handle, and stockpile overburden, soil, sand and gravel from the facility area in a manner that will prevent nuisance conditions. Kurtz Ranch Sand and Gravel Mine WC USR 8 98023.WD Aggregate Industries West Central Region April 2001 Banks and Gesso, LLC 6. For personnel sanitation purposes, portable toilets will be used during mining. Septic systems will be constructed for use at the aggregate processing, asphalt, and concrete plants. Potable water will be supplied with bottled water hauled into the site. Well water will not be used for drinking water. 7. The facility shall operate in accordance with the approved dust abatement plan at all times. The facility shall have sufficient equipment available to implement the dust control as required by the Weld County Health Department. 8. The site shall be maintained in compliance with the local fire protection district, the U.S Fish and Wildlife Service, the U.S. Army Corps of Engineers, and the Colorado Division of Minerals and Geology. 9. "No Trespassing" signs shall be posted and maintained on the perimeter to clearly identify boundaries of the site. 10.The facility shall operate in accordance with the approved storm water detention plan. 11.All construction on the property shall be in accordance with the Weld County Building Code Ordinance. 12.Lighting provided for security and emergency night operation on the site shall be designed so that the lighting will not adversely affect surrounding property owners. 13.The sand and gravel operation will comply with operation policies identified in Section 44 of the Weld County Zoning Ordinance as articulated above. 14.The property owner or operator shall be responsible for complying with the Operating Standards of Section 24.6 of the Weld County Zoning Ordinance, as amended. 15.Personnel from the Weld County Health Department and Weld County Planning Department shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the Kurtz Ranch Sand and Gravel Mine WC USR 9 98023.WD Aggregate Industries West Central Region April 2001 Banks and Gesso, LLC property comply with the Development Standards stated herein and all applicable Weld County regulations. 16.The Special Review area shall be limited to the plans shown herein and governed by the foregoing standards and all applicable Weld County Regulations. Substantial changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 17.The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. 5 - Requirement 44.5 - Reclamation Policies In addition to the commitments made in the application to the Colorado Division of Minerals and Geology, the Applicant commits to the following reclamation policies: 44.5.1 - Compatibility with Surrounding Land Uses The reclamation plan anticipates, and was designed for, an end use of wildlife habitat and some potential residential development. The surrounding land uses currently are agricultural in nature with natural areas adjacent to the Saint Vrain Creek. A sand and gravel operation is currently approved directly south of the subject project. The reclamation plan for the subject property is compatible with the existing and anticipated surrounding agricultural uses. 44.5.2 - Completion of Operations - Safety 98023..WW D Kurtz Ranch Sand and Gravel Mine WC USR 10 9802 1 Aggregate Industries West Central Region April Banks and Gesso, LLC Following the completion of operations, the Kurtz Ranch property will be maintained in a condition safe for its limited number of recreational and potential residential users. Access to the site will be limited to on-site residents, employees necessary to service oil and gas facilities, and sportsmen and sportswomen hunting game in wildlife areas. For safety purposes, access by others will be restricted. 44.5.3 — Drainage Sufficient drainage shall be provided to prevent pockets of standing water or undue erosion. Grading shall be accomplished in such a manner that storm water leaves the property at the original, natural drainage points. Runoff at any one such point shall not normally be increased over historic flows. Increases over historic flows shall be allowed only when it is shown that the increased flows will not adversely impact uses or lands affected by such flows. 44.5.4 - Grading and Erosion Control All excavated areas shall finally be graded in substantial conformity to the use of the land proposed in the reclamation plan. Ridges, banks and mounds shall be graded so as to minimize erosion. Trees, shrubs, legumes, grasses, or other ground cover shall be replaced in order to avoid erosion insofar as is practicable. 6 - Other Weld County Requirements: 6.1 - Detailed Description of the Method of Mining Operation The detailed mining plan is included in the attached CMLRB application package. Kurtz Ranch Sand and Gravel Mine WC USR 11 98023.WD Aggregate Industries West Central Region April 2001 Banks and Gesso, LLC 6.2 - Certified List of Property Owners Within 500 Feet The required listing is enclosed in Attachment 'B.' 6.3 — Certified List of Mineral Owners and Lessees The required certified list is enclosed in Attachment 'C.' 6.4 — Statement of Consistency with the Weld County Comprehensive Plan The Applicant has compared this proposed use and has prepared this application package to be consistent with the Mineral Resource Goals and Policies contained in the Weld County Comprehensive Plan. The details of the proposal contained in this application supports the intent of the Goals and Policies of the Comprehensive Plan. 6.5 — Consistency with the Intent of the Zone District Kurtz Ranch is within the 'A' (Agricultural) Zoning District. The intent of this district is to "provide areas for the conduct of agricultural activities and activities related to agriculture and agricultural production without the interference of other, incompatible land uses". In addition, "the 'A' District is also intended to provide areas for the conduct of Uses by Special Review which have been determined to be more intense or to have a potentially greater impact than Uses Allowed by Right." Mineral resource development is one of the Uses by Special Review in the 'A' (Agricultural) District. This application has been designed to meet the intent of the Zone District and the requirements of the Use by Special Review. 6.6 - Statement of Adequate Provisions to Protect the Health, Safety, and Welfare The application contains adequate provisions to protect the health, safety, and welfare of surrounding landowners and the County residents. The Kurtz Ranch Sand and Gravel Mine WC USR 12 98023.WD Aggregate Industries West Central Region April 2001 Banks and Gesso, LLC plan contained in this application package addresses all of the major areas of potential pollution and nuisance factors related to these issues such as noise, dust, water pollution, drainage, truck traffic, etc. 6.7 - Statement of Compatibility with Existing Uses Existing surrounding land uses are predominantly agricultural in nature, with a sand and gravel operation currently permitted, directly south of the subject project. The proposed mining is allowed as a Use by Special Review in the Zoning Ordinance. The mine and reclamation plans, along with the end use of the property has been designed to be compatible with the surrounding agricultural land uses and contain provisions to ensure compatibility. 6.8 - Statement of Compatibility with Future Uses For the foreseeable future, uses surrounding the subject property will continue to be agricultural in nature. Adjacent property to the north also contains commercial quantities and commercial quality sand and gravel deposits. Sand and gravel mining and reclamation as wildlife habitat of the subject property is consistent with the future anticipated uses of surrounding properties. 6.9 - Statement Concerning Flood Plain, Geologic Hazards, and the Airport Overlay District; Compliance with Section 50 6.9.1 Flood Plain — A Flood Hazard Development Permit is being submitted concurrently with this Use by Special Review application. The Applicant will comply with all requirements of the Permit. Kurtz Ranch Sand and Gravel Mine WC USR 13 98023.WD Aggregate Industries West Central Region April 2001 Banks and Gesso, LLC 6.9.2 — Geologic Hazards —The subject property contains no known geologic hazards. 6.9.3 —Airport Overlay District —The subject property does not lie within the Airport Overlay District. 6.9.4 — Statement of Compliance with Section 50 — Upon approval of and compliance with the Flood Hazard Development Permit, the subject property will be in conformance with Section 50 — Overlay Districts. 6.10 - Proof of Water Copies of ownership documents concerning water are discussed in Attachment 'D.' 6.11 - Copy of Legal Instrument Identifying Applicant's Interest in the Property The Applicant, Aggregate Industries West Central Region, has an interest in the property through an option to lease agreement titled Sand and Gravel Lease. A copy of that option agreement is presented in Attachment 'E. This agreement identifies Camas Colorado, Inc., Aggregate Division as the Lessee; however, all real property interests of Camas Colorado have since transferred to Aggregate Industries West Central Region by way of merger of these two business entities. The Applicant will also finale an agreement with the Town of Firestone, similar to the one in Attachment `E', to secure access through the abandoned railroad right-of-way. 6.12 — Noise Report The proposed project will meet all appropriate noise standards enumerated in 25-12-101 CRS (as amended) for industrial uses. The Kurtz Ranch Sand and Gravel Mine WC USR 14 98023.WD Aggregate Industries West Central Region April 2001 • Banks and Gesso, LLC Applicant is requesting the Weld County Department of Planning Services to waive a noise report. 6.13 - Special Review Use Questionnaire The special review questionnaire is enclosed under Attachment 'F'. 6.14 - Weld County Road Access Information Sheet A completed information sheet is enclosed under Attachment `G'. Traffic Information and Proposed Road Improvements Annual production of aggregates from this property are estimated at 1,000,000 tons per year. Some will be consumed on-site and shipped as finished asphalt or concrete products. Tractor trailers at approximately 85,000 pounds or tandems at approximately 55,000 pounds will be used to haul aggregates and hot-mix asphalt from the site. Ready-mixed concrete trucks (with rotating drums), would haul ready-mixed concrete from the project site. Based upon the use of these trucks, importing some materials, and using a 300-day per year working schedule gives an average of 180 truck round trips - 160 trips per day for haul trucks. Additional traffic will be generated by employees, sales people, and visitors to the site. As an estimate, these trips will account for approximately 56 additional trips per day, which includes automobiles and light trucks (pickup trucks). Aggregate Industries, Inc. proposes to pave the entrance from Colorado State Highway 66 to current CDOT standards, as required by their access permit. The Applicant will utilize chemical dust suppressants and water trucks to control dust on on-site roads. Please see Traffic Impact Study under Attachment 'H'. INTRODUCTION Project Overview This traffic impact study addresses the capacity, geometric, and control . requirements associated with the proposed operation of the Kurtz Ranch Sand and Gravel Mine located in Weld County, Colorado. Site Location and Study Area Boundaries The site is north of State Highway 66 between Weld County Road 17 and Weld County Road 19. The study area to be examined in this traffic impact analysis encompasses the site access drive to State Highway 66. The site location is shown on Figure 1. Description of Site The land for this development is currently vacant. The proposed project includes a commercial land and gravel mining facility. Access to the site is proposed via one full-movement access drive to State Highway 66. PROPOSED PROJECT TRAFFIC Trip Generation Since standard traffic generation characteristics are not available for this type of facility, the mining operators have prepared an estimate of daily and hourly trips based on projected employment and truck trips. This information is presented in Table 1. I Adjustments to Trip Generation Rates No trip reductions were taken in the traffic study in an effort to provide a conser- vative analysis. I Trip Distribution The overall directional distribution of the site-generated traffic was determined based on the location of the site within Weld County, and the surrounding street system. The overall trip distribution used in the analysis assumes 90 percent of the site-generated trips will be to and from the east (I-25 corridor). Project Trip Assignment Traffic assignment is how the generated and distributed trips are expected to be loaded on the roadway network. The site-generated trip assignments are shown on Figure 2. The total traffic projections from the Sand Land study were used as background traffic volumes for this study. The background traffic volumes are shown in Figure 3. PROJECT IMPACTS Peak Hour Intersection Level of Service The Unsignalized Intersection Analysis technique, as published in the Highway Capacity Manual by the Transportation Research Board in 1994, was used to analyze the site access. This technique allows for the determination of the intersection level of service based on congestion and delay of each traffic movement. Traffic analyses were completed for total traffic (with project). The results of these analyses are provided in Table 2. Definitions of level of service are given in Appendix B. The capacity worksheets are provided in Appendix C. The full-movement access point to State Highway 66 is projected to operate acceptably. At the site location, State Highway 66 is a RA Category Highway with a posted speed of 65 mph. According to Tables 4-5 and 4-6 of the 1998 State Highway Access Code, the site access drive will require construction of a left turn deceleration lane (800 feet in length, including a 25:1 taper). Although the right turns do not warrant a deceleration or acceleration lane, both lanes are recommended due to the heavy truck volume. The right turn deceleration lane should be 800 feet and the acceleration lane should be 1,380 feet. Both lane lengths include a 25:1 taper. I I I 1 I c 1 12 I VI. CONCLUSION This study assessed the traffic impacts of the proposed Kurtz Ranch Sand and Gravel Mine located in Weld County, Colorado. Traffic operations at the site access drive and State Highway 66 will function well as an unsignalized intersection. Auxiliary lanes will need to be constructed with development of this site. Although the right turn ND lanes are not required according to projected traffic volumes they are being recommended due to the high proportion of large trucks using the access. Delay is a measure of driver discomfort, frustration, fuel consumption, and lost travel time. Delay is a complex measure, and is dependent on a number of variables, including the quality of [the signal] progression, the cycle length, the green time ratio, and the v/c ratio for the lane group or approach in question. Level-of-service A describes operations with very low delay, i.e., less than 5.0 seconds per vehicle. This occurs when progression is extremely favorable, and most vehicles arrive during the green phase. Most vehicles do not stop at all. Short cycle lengths may also contribute to low delay. Level-of-service B describes operations with delay in the range of 5.1 to 15.0 seconds per vehicle. This generally occurs with good progression and/or short cycle lengths. More vehicles stop than for LOS A, causing higher levels of average delay. Level-of-service C describes operations with delay in the range of 15.1 to 25 seconds per vehicle. These higher delays may result from fair progression and/or longer cycle lengths. Individual cycle failures may begin to appear at this level. The number of vehicles stopping is significant at this level, although many still pass through the intersection without stopping. Level-of-service D describes operations with delay in the range of 25.1 to 40.0 seconds per vehicle. At level D, the influence of congestion becomes more noticeable. Longer delays may result from some combination of unfavorable progression, long cycle lengths, or high v/c ratios. Many vehicles stop, and the proportion of vehicles not stopping declines. Individual cycle failures are noticeable. Level-of-service E describes operations with delay in the range of 40.1 to 60.0 seconds per vehicle. This is considered to be the limit of acceptable delay. These high delay values generally indicate poor progression, long cycle lengths, and high v/c ratios. Individual cycle failures are frequent occurances. Level-of-service F describes operations with delay in excess of 60.0 seconds per vehicle. This is considered to be unacceptable to most drivers. This condition often occurs with N oversaturation, i.e., when arrival flow rates exceed the capacity of the intersection. It may also occur at high v/c ratios below 1.00 with many individual cycle failures. The proposed post-mining land uses are compatible with the agricultural uses in the surrounding area. In addition, the post-mining uses are consistent with allowed uses permitted in the Weld County Zoning Ordinance. The property will also provide an interim bike path during the operation of the mining facility. The interim bike path will connect to the existing path located at the south property line, continue along the east property line and reconnect to the Town of Firestone easement at the midpoint of the east property line. The reclamation plan is presented as follows. Reclamation Process Reclamation will take place concurrently with mining with no more than 70 acres being disturbed at any one time before reclamation commences. Since there is effectively no reclamation of the pond bottom, the 70 acres corresponds to the plant site, settling ponds and perimeter slope/pond backfill. Vegetation will be removed, and then available topsoil will be stripped and stockpiled for later use in revegetation. Any surplus topsoil materials, corresponding to the acreage proposed to be inundated, will be designated for upper zones of ponds backfilled to re-create wetlands. Areas that will be inundated with water will not be replanted. Slopes and upland areas will be topsoiled and revegetated. Kurtz Ranch Sand and Gravel Mine OMG 112 Permit 15 98023.WD Aggregate Industries West Central Region April 2001 Banks and Gesso, LLC Topsoil Preservation Soils on the site vary from sandy loam, loam, and aquolls and aquepts, with surface layers varying from 1 to 13 feet thick. The location of the topsoil stockpiles will be within the permit area and in areas close to final placement. As filled areas in ponds and around the perimeter of the proposed mine pit limits are completed, topsoil will immediately be respread in preparation for revegetation. Soil material that is stockpiled for later use in revegetation will be placed on a stable surface within the permit area and will be clearly marked. These topsoil stockpiles will be protected from disturbances associated with the mining operation and from wind and water erosion, compaction, and other disturbances that would reduce its capability to support vegetation. The stockpiles will be seeded with a temporary cover when stockpiles will remain in place for more than one growing season. Soil materials will be subjected to physical and chemical soil analysis to determine possible means of enhancing plant growth. Soil analysis may include pH, texture, specific conductance, sodium absorption ratio, nitrate nitrogen, plant available phosphorous and potassium. It is expected that these soil test results will indicate little enhancement is necessary for successful revegetation. Kurtz Ranch Sand and Gravel Mine DMG 112 Permit 16 98023.WD Aggregate Industries West Central Region April 2001 Banks and Gesso, LLC Regrading and Shaping Backfill on ponds will occur with adequate compaction to ensure slope stability. All pond slopes will be backfilled at a 3:1 slope, except where shallower slopes are used for wetland shorelines at the anticipated final water elevation in each pond. This will create areas of shallow waters favored by fish and waterfowl, adjacent to re-created emergent wetland areas. Topsoil will be placed and seeded from this elevation up the slope to the property line. Excess overburden will be placed over the 3:1 slopes, as indicated on Exhibit F, to create an undulating shore line, with rounded corners, prior to topsoil placement. Approximately 6 to12 inches of topsoil will be placed on all 3:1 slopes, both above and below the expected water line. Contour furrows will be established on the shoreline slopes to reduce erosion and encourage stable plant growth. Topsoil Replacement Topsoil replacement (approximately 6-12 inches) will occur following regrading and scarification of the surface. Placement will primarily occur during late summer and fall. This procedure limits the time that topsoil is exposed prior to revegetation and avoids moving topsoil when it is frozen or too wet. The seeding will typically occur in the fall, to expose the soils to sufficient winter moisture for successful germination in the spring, when the ground is often too wet to seed. Kurtz Ranch Sand and Gravel Mine DMG 112 Permit 17 98023.WD Aggregate Industries West Central Region April 2001 Banks and Gesso, LLC Re-vegetation Re-vegetation of non-wetland areas will utilize predominantly native grasses. The Natural Resources Conservation Service conducted a field visit and range assessment of the site. As indicated in the attached report, the site is classified as a salt meadow, with soil types varying in alkalinity levels. As recommended, the Applicant will obtain topsoil samples in advance of seeding operations and submit the test results to the Conservation Service office for a specific seed mix recommendation. The anticipated grass species are listed in Table E-1, without specific rates. The seed mix for temporary covering of berms and topsoil piles is provided in Table E-2. Re-vegetation of wetland areas will utilize the plant types listed in Table E-3. Prior to mining, shallow groundwater monitoring wells will be installed at various interior locations. These wells will be monitored to determine seasonal groundwater fluctuations of wetland and non-wetland areas prior to disturbance. This data will be utilized in determining finished grade of re-created wetlands, as well as to predict the normal water elevation in ponds. Seeding Method Seeding will be accomplished using either a seed drill properly equipped to meter the native grasses of the mix, or using broadcast followed by harrowing or raking. Following seeding, the area will be covered and crimped with certified clean straw at a rate of approximately two tons per acre. Weed Management The development of weeds will be closely monitored to ascertain the need for control. Of greatest concern will be the development of Canada Thistle, Russian Thistle, Mustard, Kosha, Field Bindweed, and possibly Rye. If any of these appear during the first year after seeding, they will be controlled with several mowing operations, at specific times. The presence of annual and biennial weeds during the first few years after seeding is normal and can be expected to diminish thereafter. The use of herbicides for weed control should wait at least one year after seeding, to allow the native grasses to gain stamina. The Applicant assumes responsibility for weed control on all areas of the site affected by mining operations. The Applicant's weed control program will also supplement the owner/lessor's weed control program on undisturbed areas of the site where requested or deemed necessary. Dominant vegetative cover includes saltgrass on the majority of open areas, Alkali bluegrass under the cover of the trees, and where the water table is high, the sedges, rushes and cattails are dominant . SEED MIX RECOMMENDATIONS AA AA.......A AAA A AA A A A A A A There is a variety of soil present at this site. Listed in descending order, Soil #3, Aquolls and Aquents with a gravelly substratum, Soil #10, an Altvan Loam, and Soil #1 a Bankard Sandy Loam. Judging on the species present at this site, there are portions that could be very alkaline and/or saline. The extent of the alkali/saline problem will determine which grass species will or will not work at this site. I recommend that a soils test be completed after reclamation and prior to revegetation. I can then make a complete recommendation based on that soils test. To give you an example of a few of the species that could work at this site, Inland saltgrass, Alkali sacaton, NEWHY wheatgrass, Intermediate/Pubescent wheatgrass, Alkali bluegrass are all potential species . Knowing the exact future intended use will also be helpful, as there are species that are more palatable to cattle than others, while some create better wildlife habitat.
