RE: GRANT REQUEST FOR EXTENSION OF SUBMITTAL OF SITE SPECIFIC
DEVELOPMENT PLAN AND PLANNED UNIT DEVELOPMENT FINAL PLAN -
HARVEY MARKHAM
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on August 9, 2000, by Resolution #2000-1633, the Board approved the
application of Harvey and Jean Markham, 650 Highway 56, Berthoud, Colorado 80513,
requesting a Change of Zone from the A (Agricultural) Zone District to a PUD (Planned Unit
Development) Zone District for a parcel of land located on the following described real estate,
to-wit:
Part of the N1/2 NE1/4 of Section 19, Township 4
North, Range 68 West of the 6th P.M., Weld
County, Colorado
WHEREAS, Harvey Markham has requested an extension of the submittal for the
Planned Unit Development Final Plan as required by Section 27-8-50 of the Weld County Code,
with said application to be submitted by October 15, 2002, and
WHEREAS, the Board of County Commissioners heard all the testimony and
statements of those present, studied the request of the applicant and the recommendation of
the Department of Planning Services, and, having been fully informed, finds that this request
shall be approved.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the request of Harvey Markham for an extension of the submittal
for the Planned Unit Development Final Plan as required by Section 27-8-50 of the Weld
County Code, on the above referenced parcel of land be, and hereby is, granted, with said
application to be submitted by October 15, 2002.

The above and foregoing Resolution was, on motion duly made and seconded, adopted

SUBJECT: Request for extension for PUD final plan submittal for Harvey
Markham
* Section 27-8-50 of the Weld County Code states: "If a PUD final plan application is not
submitted within two (2) years of the date of approval of the PUD Zone District, the Board of
County Commissioners shall require the landowner to appear before it and submit evidence
substantiating that the PUD project has not been abandoned and that the applicant possesses
the willingness and ability to continue with the submittal of the PUD final plan. The Board of
County Commissioners may extend the date for the submittal of the PUD final plan application
and shall annually require the applicant to demonstrate that the plan has not been abandoned."
* The applicant, Harvey Markham, is requesting an extension for the submittal of his PUD final
plat application. The Change of Zone application (case #Z-545) was approved by the Board of
County Commissioners on August 5, 2000. He has indicated that he intends to submit his PUD
final plan application by October 15, 2002.
* Planning staff is in support of the applicant's request to extend the submittal date for the PUD
final plan application.

Subject:PUD Application Step 3 Submittal Extension
Dear Sir,
Chris,since the August 7th deadline for submittal of the step 3 of the PUD approval process will obviously
be missed,please get me on the agenda before the Planning Commission such that I can show them the project
has not been abandoned.Per our conversation and yours with the lawyer,this should suffice to get an ex-
tension of one year to complete the application process per Weld County PUD rules.
Currently the package preparation is as follows:
(1)Specific Development Guide 65%complete
(2)Development Plan 20%complete
(3)Landscape Design complete
(4)Utility Design complete
(5)Road Design complete
(6)Final Plat complete
The bulk of the preparation remaining is the Devopment Plan items such as:
(1)Convenants
(2)Deed Restricitions final draft and legal review
(3)Curent cost estimates and schedule.
These items should be complete and ready for submittal by approximately 10/15/02.
