RE: APPROVE EMERGENCY SHELTER GRANT CONTRACT AMENDMENT AND
AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Emergency Shelter Grant Contract
Amendment between the County of Weld, State of Colorado, by and through the Board of
County Commissioners of Weld County, on behalf of the Greeley/Weld County Housing
Authority, and the Colorado Department of Local Affairs, Division of Housing, with terms and
conditions being as stated in said amendment, and
WHEREAS, after review, the Board deems it advisable to approve said amendment, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, ex-officio Housing Authority Board, that the Emergency Shelter Grant
Contract Amendment between the County of Weld, State of Colorado, by and through the
Board of County Commissioners of Weld County, on behalf of the Greeley/Weld County
Housing Authority, and the Colorado Department of Local Affairs, Division of Housing, be, and
hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said amendment.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 25th day of February, A.D., 2002.

ESG CONTRACT AMENDMENT
THIS CONTRACT AMENDMENT, made this i7"day of46/uu/y , 2002, by and between the
State of Colorado for the use and benefit of the Department of Local Affairs, DIVISION OF HOUSING,1313
Sherman Street, Room 518, Denver, Colorado 80203, hereinafter referred to as the State, and GreelevNVeld
County Housing Authority, Post Office Box 130, Greeley, Colorado 80632, hereinafter referred to as the
Contractor.
FACTUAL RECITALS
Authority exists in the Law and Funds have been budgeted,appropriated and otherwise made available in
Fund Number 100 , Appropriation Code Number 656 , Contract Encumbrance Number H2ESG01638; and
Required approval, clearance, and coordination has been accomplished from and with appropriate
agencies; and
The parties entered into a contract dated July 1st,2001,for improving the quality of emergency shelters
for the homeless,to help make available additional emergency shelters, and to help meet the costs of operating
emergency shelters and of providing essential social services to homeless individuals,so these individuals have
access to safe and sanitary shelters, and supportive services and homeless prevention services and other types
of assistance to improve their situations.
The existing Emergency Shelter Grant Contract (ESG) permits the contractor to unilaterally transfer
program dollars from one funding category to another, so long as the cumulative budgetary line item changes do
not exceed 10% of the contract or $2,000.00 whichever is greater. Overall State ESG funding categories,
however, are capped by the U.S. Department of Housing and Urban Development (HUD), and any unilateral
transfer made by the contractor may cause the State to become out of compliance with its HUD ESG grant.
The intent of this contract amendment is to prohibit budget transfers between funding categories without
the prior written permission of the State.
NOW THEREFORE, it is hereby agreed that the contract is changed as follows:
1. Consideration for this amendment to the original contract, CE number H2ESG01638,
Contract Routing Number 00055, which shall be made pursuant to this amendment and the promises and
agreements herein set forth.
2. It is expressly agreed by the parties that this amendment is supplemental to the original
Contract Routing Number 00055, dated July 1,2001, referred to as the"original contract,"which is, by this
reference, incorporated, and made a part hereof, and attached as Exhibit B, and all terms, conditions, and
provisions thereof, unless specifically modified herein; are to apply to this amendment as though they were
expressly rewritten, incorporated, and included herein.
3. It is agreed the original contract is and shall be modified, altered, and changed in the
following respects only:
a. Section 17, parts b) i) and b) ii) are hereby declared null and void as of
Fe6rit a ry a2.2 , 2002.
b. Section 17, pa tr b)vi) shall be added to state, "No budget transfers are allowed
between categories without the prior written permission of the State."

4. The effective date of this amendment is i 6ru.a>%y b2-2 , 2002.
5. Except for the"Special Provision," in the event of any conflict, inconsistency, variance or
contradiction between the provisions of this amendment and any of the provisions of the original contract, the
provisions of this amendment shall in all respects supersede, govern, and control. The"Special Provisions"
shall always be controlling over other provisions in the contract or amendments. The representations in the
Special Provisions concerning the absence of bribery or corrupt influences and personal interest of State
employees are presently reaffirmed.
6. FINANCIAL OBLIGATIONS OF THE STATE PAYABLE AFTER THE CURRENT FISCAL
YEAR ARE CONTINGENT UPON FUNDS FOR THAT PURPOSE BEING APPROPRIATED, BUDGETED,
AND OTHERWISE MADE AVAILABLE BY HUD.
7. THIS AMENDMENT SHALL NOT BE DEEMED VALID UNTIL IT SHALL HAVE BEEN
APPROVED BY THE CONTROLLER OF THE STATE OF COLORADO OR SUCH ASSISTANT AS HE MAY
DESIGNATE.
