The Weld County Public Works has reviewed this proposal;this project falls primarily under the purview of the Use
by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments
and requirements are as follows:
COMMENTS:
WCR 64 ("0" Street) is designated on the Transportation Plan Map as a local paved road, which requires a 60-
foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld
County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50,
-"—the required setback is measured from the future right-of-way line.
REQUIREMENTS:
Access: The property is entirely fenced. Utilize the existing access point to accommodate parking to the facility.
Off-Street Parking/Access Drive: The off-street parking and the access drive shall be surfaced with gravel,
asphalt, concrete or the equivalent. It shall be graded to prevent drainage problems.
Storm Water Drainage: There is no new structures or paved parking areas proposed to generate additional
storm water run-off from the site. The site is clean and orderly with no drainage problems to adjacent property
owners visible. I will waive the requirement for the storm water drainage for this USR.

Environmental Health Services has reviewed this proposal for a bed and breakfast facility. We
have no objections to the proposal, however, we do recommend that the following conditions be
part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be recorded:
1. The applicant shall submit evidence to the Department of Planning Services, from the
Colorado Division of Water Resources, demonstrating that the well is appropriately
permitted for the purposed use.
We recommend that the following requirements be incorporated into the permit as development
standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities
Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a
manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not meant to
include those wastes specifically excluded from the definition of a solid waste in the
Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive
dust, blowing debris, and other potential nuisance conditions.
4. Fugitive dust shall be controlled on this site.
5. This facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in 25-12-103 C.R.S., as amended.
6. Adequate handwashing and toilet facilities shall be provided for guests.
7. Any septic system located on the property must comply with all provisions of the Weld
County Code, pertaining to Individual Sewage Disposal Systems.
8. A permanent, adequate water supply shall be provided for drinking and sanitary purposes.

Dear Mr. & Mrs. Reese:
The Environmental Health Services of the Weld County Department of Public Health
and Environment has reviewed your application for a cistern permit to be located at
21491 County Road 64, Greeley, Colorado. The review of this application was
conducted in accordance with Weld County Code, Chapter 14, Article III, pertaining to
the "Cistern Water Use".
The Division has denied this application. This determination was made for the following
reasons:
1) In accordance with Section14-3-80 of the Code, the applicant was unable to
demonstrate "the lack of availability of another approved source of drinking water
such as domestic wells or public water systems".
Please be advised that in accordance with Section 14-3-120 of the Code you can
appeal this decision and request a variance from the Weld County Board of Health.
However, you must file a written appeal within ten (10) days of receipt of this letter.
The next Board of Health meeting will be on Tuesday, July 23, 2002, at 9:00 am in the
Board Room (Room 210) at 1555 North 17 Avenue, Greeley. If you intend to appeal
this decision please submit your written request as soon as possible.

The Greeley-Weld County Airport Authority has reviewed the subject referral and offers the
following comments:
Case Number USR-1386 is a request by Brett& Chrisann Reese, for a Site Specific
Development Plan and a Special Review Permit within the Agricultural Zoned District. The
property and existing structure are located between WCR 45 and west of the Greeley-Weld
County Airport.
The Greeley-Weld County Airport Authority does not specifically object to the Special Review
Permit. However, it should be noted that the Bed and Breakfast will operate underneath three
traffic pattern areas for runway's 34, 9 and 27. As such, the nature of a high volume of low flying
aircraft directly above the site should be taken into consideration. This property is located within
the Airport Zoning Overlay District as adopted by Weld County and within an area the Federal
Aviation Administration may consider incompatible for certain types of use. It is recommended
that if the property is reclassified or granted a Special Use Permit, a statement concerning noise
and overflight should be incorporated within the permit.

1. Building permits shall be obtained for change of use to bed and breakfast.
2. A plan review is required for each building. Two complete sets of plans are required when
applying for the permit. Smoke detectors shall be installed according to Section 310.9.1 of the
1997 Uniform Building Code.
3. Provide two copies of a plot plan for the site with all buildings shown indicating the distance
to property lines for all buildings as well as distances between buildings.
4. Additions or remodeling of buildings shall conform to the requirements of the 1997 UBC,
1998 IMC, 1997 IPC, 1999 NEC and Chapter 29 of the Weld County Code. C heck with the
Building Department for specific requirements.

The City of Greeley Planning Staff has reviewed the following Use by Special Review for a Bed and
Breakfast and have the following concerns.
• The Proposed use is within the Airport Area of Influence. Be advised that as the airport
expands so will future noise issues. The site is '/2 mile west of future critical zones as well as
present critical zones. Be informed that airport traffic will increase as the City will eventually
annex the airport within the City of Greeley's municipal boundaries.
Other than the above-mentioned item, the City of Greeley Planning staff finds no conflicts with our
interest.

Landscape / Site Plan Review
The Department of Planning Services reviewed the above referenced Use by Special Review
Landscape/ Site Plan and offers the following comments:
A Landscape Plan was submitted with the application that outlined the current plant materials
on site. References to site circulation, parking, and screening have not been adequately
addressed.
Landscaping materials as proposed in the Approved Landscape Plan shall be maintained at all
times. Dead or diseased plant materials shall be replaced with materials of similar quantity and
quality at the earliest possible time.
The parking area attached to the Bed and Breakfast Lodging facility shall accommodate a
minimum of two designated parking stalls. Further, the applicant shall address all requirements
of the American for Disabilities Act in future drawings. Typically, one of the two parking spaces
shall be van accessible with an eight (8) foot aisle between parking spaces. The area for the
non-ambulatory parking spaces shall be paved. In addition, a curb cut or ramped area from the
parking area into the Bed and Breakfast Lodging facility enclosure has not been delineated on
the plat. All parking spaces shall have curb stops.
From the application materials, it appears that there is a sufficient area for off street parking.
All parking areas shall be screened from adjacent properties and road rights-of-way. The
applicant shall delineate an opaque visual screen on all sides of the property to mitigate the
potential negative impact and aesthetic concerns on surrounding properties.
The applicant shall demonstrate a safe and approved access, including a vehicular and
pedestrian access to the street. The proposed access is surrounded by a fence fronting WCR
64 ("O") Street.
The internal circulation within the parking area is unclear. Future drawings shall delineate the
proposed circulation pattern including emergency access. The aisle width and parking spaces
shall conform with Chapter 23, Appendix A of the Weld County Code.
Areas used for storage or trash collection shall be screened from adjacent public rights-of-way
and adjacent properties. These areas shall be designed and used in a manner that will prevent
wind or animal scattered trash.
The applicant shall address the issue of on-site lighting, including security lighting, if applicable.
It shall be noted that "any lighting ... shall be designed, located and operated in such a manner
as to meet the following standards: sources of light shall be shielded so that beams or rays of
light will not shine directly onto adjacent properties...."
The applicant has not delineated any on-site sign(s). If an on-site sign(s) is desired, the signs
shall adhere to Section 23-4-90.A and .B of the Weld County Code. One identification sign per
principal use shall be allowed, provided that the sign does not exceed sixteen (16) square feet
in area per face. Further, the location of the sign, if applicable shall be delineated on the
Landscape / Site Plan. All structures, including signs, on site must obtain the appropriate
building permits.
The applicant shall enter into an Improvements Agreement according to policy regarding
collateral for improvements and post adequate collateral for all transportation (access drive,
parking areas, etcetera) and non-transportation (plant materials, if applicable, fencing,
screening, etcetera). The agreement and form of collateral shall be reviewed by County Staff
and accepted by the Board of County Commissioners prior to recording the USR plat.

Upon review of my computer and files, the following violation was noted (VI-0100061). The violation is in
regards to a hotel(Vanwinkle's Cave)without an approved and recorded Use by Special Review permit;therefore,
if approved and once recorded this violation would be closed.
Please be advised that this case has already appeared before the Board of County Commissioners on the 11'"day
of December, 2001.
The Board referred the violation to the County Attorney's office to proceed with immediate legal action. Since
a "USR"application was submitted,this case was put on hold, pending the outcome. If denied this case will be
forwarded back to the County Attorney's office, to proceed with legal action.

Dear Ms. Angeli:
We have reviewed the above referenced proposal for a site specific
development plan for a bed and breakfast facility (lodging for guests within an
existing house). Although this agency does not typically provide comments for
land use actions that do not involve subdivisions of land, this particular referral
involves a potential illegal use of an existing well.
Well permit number 97827-A was issued on April 24, 1978 for domestic
uses and the well was drilled on August 21, 1978 and therefore, the permit is
currently valid. This well, however, cannot be used for the proposed bed and
breakfast. The statutes do not allow for multiple uses (domestic and commercial
exempt) for one well.
This office, on June 4, 2002, received a fax from Mr. Reese stating that a
separate water system will be used to serve the guest rooms. A cistern is
proposed and will be filled by a commercial water supplier. This office has no
objections to the water supply proposed.
We would recommend, however, that the County verify the nature of the
plumbing in the existing house to ensure the water systems are in fact separate.
