The parcel of land under consideration is described as the EA EA, Section 32, T3N, R67W of the 6th P.M. , Weld County, Colorado. This property is located on the west side of County Road 19 bounded by County Roads 28 and 26 to the north and south respectively, about 4 miles southwest of the town of Platteville. The property contains approximately 157.371 acres of Class I, II, III, IV, and VI irrigated soils and Class IV and VI non-irrigated soils in the Agricultural Zone District. The request is to split the property into parcels of 2.371 acres and 155 acres. The 155 acres (lot B) will be retained for agricultural production with no present plans to construct any improvements. Mr. Strong owns nearby lands which also will be farmed in conjunction with this acreage being acquired. There is one existing residence with a barn and corrals on Lot A which are the only improvements on the entire 157.371 acres. Based upon the information submitted and the adopted policies in the County, the Department of Planning Services Staff recommends the request be approved for the following reasons: 1. The proposed split conforms with the recorded exemption intent clause and the Weld County Comprehensive Plan. The proposal would allow the present property owner to remain at his residence and the new property owner to expand his fanning operation. The residential density will not exceed what is currently permitted on the property under the present land use regulations. 2. The proposed use of the property is compatible with the surrounding land uses. 3. The request complies with the provisions of Section 9-4A of the Weld County Subdivision Regulations. To Whom It May Concern: I enclose the Application for Recorded Exemption for the referenced property and a plat and surveyor's certificate in connection therewith. I will forward to you a Certificate of Conveyance when completed. The Application is signed by the contract purchaser and a copy of the contract is included. The purchaser owns nearby lands and in particular lands in Sections 21 and 28 which will be farmed in conjunction with the acreage being acquired. Lot "A" will be retained by Harry Shimon as a personal residence. There are no present plans to construct improvements on Lot B. However, if improvements were necessary, it will be possible to obtain water from a well source for domestic use purposes or perhaps extend the service from a domestic water system which is approximately one mile away. Lot A is served by two water wells, one for the house which was drilled in 1947 and one for the barn and corrals which has been in existence more than 50 years. Neither well has been adjudiciated nor were permits obtained because they predated such requirements. The land use will not change and in fact agricultural land will be retained in production and will be used by Mr. Strong in conjunction with his other agricultural interests in the area.
