Long, Pro-Tem Commissioner M. J. Geile Commissioner William H. Jerke Commissioner Robert D. Masden Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Kim Ogle Health Department representative, Trevor Jiricek Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated March 1, 2002, and duly published March 6, 2002, in the Tri-Town Farmer and Miner and the Greeley Tribune, a public hearing was conducted to consider the request of Shawn and Stacey Greathouse for a Site Specific Development Plan and Use by Special Review Permit#1366 for a Use by Right, an Accessory Use, or a Use by Right in the Commercial or Industrial Zone District(Majestic Fence Company) in the A (Agricultural)Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Mr. Ogle gave a brief description of the location of the site and surrounding uses. He stated the parcel is 46 acres, with no improvements. He further stated the site is within the referral areas for the Towns of Johnstown and Milliken, and nine referral agencies responded favorably, with their comments addressed in the Conditions of Approval or Development Standards. Mr.Ogle stated staff received two telephone inquiries from surrounding property owners, who expressed concern with the placement of structures on the property, as well as the potential for additional traffic on Weld County Road 15.5. He stated the site will consist of an office, lab, and warehouse for the fence company, which will be accessed from Weld County Road 15.5. The property will be screened in accordance with Weld County Code requirements, and there will be two employees in addition to the owner, with potential to increase to a total of ten employees. He further stated water is provided by the Little Thompson Water District and sewage disposal will be permitted by a septic system.TrevorJiricek,Weld County Department of Public Health and Environment,stated the Dust Abatement Plan and Waste Handling Plan have been submitted,therefore, Conditions of Approval #2.B and #4.A can be deleted. ) � 11 2002-0693 /J/ NZ / , !)a) PL1591 HEARING CERTIFICATION - SHAWN AND STACEY GREATHOUSE (USR#1366) PAGE 2 Stacey Greathouse, applicant, stated she has no additional comments. In response to Commissioner Geile, Ms. Greathouse stated 35 acres of the site will remain in agricultural production. She explained although this site has no water rights, the land is currently farmed by an individual who does own shares of the Hillsboro Ditch Company, and they have agreed to let him continue farming the land. No public testimony was offered concerning this matter. In response to Chair Vaad, Ms. Greathouse stated she has reviewed and agrees with the Conditions of Approval and Development Standards, with the proposed changes. Commissioner Geile moved to approve the request of Shawn and Stacey Greathouse for a Site Specific Development Plan and Use by Special Review Permit #1366 for a Use by Right, an Accessory Use, or a Use by Right in the Commercial or Industrial Zone District (Majestic Fence Company)in the A(Agricultural)Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion also included deleting Conditions#2.6 and#4.A. The motion was seconded by Commissioner Masden, and it carried unanimously. There being no further discussion, the hearing was completed at 10:40 a.m. This Certification was approved on the 25th day of March 2002.
