ARCHIVE BOX MISSING AS OF 12/ 19/2017 391 RESOLUTION RE: APPROVE VACATION OF SPECIAL REVIEW PERMIT#74 - HIGHLAND DAIRY, LLC WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated January 27, 1971, the Board did approve Special Review Permit#74 for a Commercial Dairy Operation for John Andrijeski, Route 4, Box 72, Fort Collins, Colorado, on the following described real estate, to-wit: The SE1/4 NW1/4 SE1/4 and the W1/2 SW1/4 NE1/4 SW1/4 of Section 17, Township 8 North, Range 65 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board has received a request from Highland Dairy, LLC, current owner, to vacate said Special Review Permit#74, pursuant to Condition of Approval #1.F of Use by Special Review Permit#1395, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to approve said vacation. Our comments are as follows: 1 The property owner will apply for separate building permits for each building requiring a permit by Weld County Code. The definition of Ag Exemption building as specified in Section 29-3-20B.13 of the Weld County Code is understood. 2. When a building permit is required, a plan review shall be submitted for each building. Plans shall bear the wet stamp of a Colorado registered architect or engineer and two (2) complete sets of plans will be submitted. 3. Buildings will conform to the requirements of the various code adopted at the time of permit application. 4. Foundations for buildings requiring permits will be designed by a Colorado registered engineer. 5. Maximum building height, wall and opening protection and limitations, and separation of buildings of mixed occupancy classification shall be in accordance with the various tables and chapters as addressed in the Uniform Building Code. 6. Building height shall also comply with the Bulk Requirements from Chapter 27 of the Weld County Code in order to determine compliance with offset and setback requirements. December 11, 2002 Page 2 7. Any buildings constructed within the 100-year floodplain will adhere to the requirements of a Flood Hazard Development Permit.
