RE: APPROVE RESUBDIVISION (LOT LINE ADJUSTMENT ONLY) OF HILL-N-PARK
SUBDIVISION, FIRST FILING, S #1010 - HILL-N-PARK SENIOR CITIZENS,
INC./MILLIKEN FIRE PROTECTION DISTRICT
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 17th day
of July, 2002, at the hour of 9:00 a.m. in the Chambers of the Board for the purpose of hearing
the application of Hill-N-Park Senior Citizens Inc., do Charles J. Connell, 1011 11th Avenue
Greeley, Colorado 80631, and the Milliken Fire Protection District, P.O. Box 41, Milliken,
Colorado 80543, for a Resubdivision (Lot Line Adjustment Only) of Hill-N-Park Subdivision, First
Filing, on the following described real estate, to-wit:
Lot known as "Park" in the Hill-N-Park First Filling,
part of the S1/2 of Section 26, Township 5 North,
Range 66 West of the 6th P.M., Weld County,
Colorado
WHEREAS, said applicants were present at said hearing, and
WHEREAS, Section 24-5-30 of the Weld County Code provides standards for review of
said Resubdivision (Lot Line Adjustment Only), and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Weld County Department of Planning Services staff and all of the exhibits and evidence
presented in this matter and, having been fully informed, finds that this request shall be
approved for the following reasons:
1. The submitted materials are in compliance with the application requirements of
Section 24-5-30.B of the Weld County Code.
2. It is the opinion of the Board of County Commissioners that the applicant has
shown compliance with Section 24-4-30.C.3 of the Weld County Subdivision
Ordinance including specifically:
a. Section 24-4-30.C.3.a -- The lot line revision complies with the approved
recorded final plat.
b. Section 24-4-30.C.3.b -- The application complies with the adopted rules,
regulations, and ordinances currently in force and affecting the
subdivision.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the application of Hill-N-Park Senior Citizens Inc., and the Milliken
Fire Protection District for a Resubdivision (Lot Line Adjustment Only) S #1010, on the
hereinabove described parcel of land be, and hereby is, granted subject to the following
condition:
1. The resubdivision plat shall be submitted to the Weld County Department of
Planning Services for recording within 30 days of approval by the Weld County
Board of Commissioners.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 17th day of July, A.D., 2002.

1. The submitted materials are in compliance with the application requirements of Section 24-5-30 of the
Weld County Code.
2. The request is in conformance with Sections 24-5-30.C.3a and 24-5-30.C.3b of the Weld County Code,
as follows:
Section 24-5-30.C.3a - The lot line revision complies with the approved recorded final plat.
Section 24-5-30.C.3b- The application complies with the adopted rules, regulations, and ordinances
currently in force and affecting the subdivision.
The Department of Planning Services recommends approval with the following
conditions:
1. The resubdivision plat shall be submitted to the Weld County Department of Planning
Services for recording within 30 days of approval by the Weld County Board of County
Commissioners.

Prior to recording the plat:
1. The applicant shall enter into an Improvements Agreement according to policy regarding
collateral for improvements and post adequate collateral for transportation requirements. The
Improvements Agreement shall address an adequate driveway pad (corresponding to County
standards) and an appropriate curb cut (corresponding to County standards). The agreement
and form of collateral shall be reviewed by County Staff and accepted by the Board of County

Re: Resubdivision Lot Line Changes Only
Hill-N-Park First Filing
The Milliken Fire Protection District and the Hill-N-Park Senior Center entered into an
agreement whereby the Senior Center will convey a strip of land 50 feet by 100 feet to the
Milliken Fire Protection District to enable the District to build an addition to it fire station to
better serve the residents of Hill-N-Park.
A lot line change of the Lot 1 and the lot designated as the"park" on the original subdivision plat
is necessary in order for the Senior Center to convey the strip of land to the District.
The lot line change and the subsequent conveyance of the strip of land would not violate any
applicable rules, regulations, or resolutions in force and effect and which affect the subdivision.
No utility easements are affected.
