RESOLUTION
RE: RIGHT OF FIRST REFUSAL - SCHOOL DISTRICT #6
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado on the 27th day of July, 1983, considered a written
request submitted by Charles Karowsky, Attorney for School District
No. 6, a copy of which is attached hereto and incorporated herein
by reference, regarding County owned land and improvements referred
to as parcels 1 through 4, and
WHEREAS, the Board of County Commissioners are not prepared,
at this time, to negotiate and consummate a sale of the property
and property rights, and
WHEREAS, the Board of County Commissioners has studied said
Right of First Refusal and deems it advisable to approve the same.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the Right of First Refusal
agreement between School District No. 6 and Weld County be, and hereby
is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be,
and hereby is, authorized to sign said Right of First Refusal.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 27th day of
July, A.D. ,1983.

Gentlemen:
Your District has inquired as to whether or not Weld County
would be willing to sell to you the land and improvements shown
in red on the attached plat and referred to as parcels 3 and 4 .
Additionally, your District has made inquiry as to whether or
not the County would be willing to provide you with a permanent
easement and right-of-way for ingress and egress across what
have been designated as parcels 1 and 2 . The lands in question,
and particularly parcels 3 and 4 are adjacent to Billy Martinez
Elementary School.
The undersigned, acting in behalf of Weld County, are not pre-
pared, at this time, to negotiate and consummate a sale of the
property and property rights, but are willing to make certain
commitments based on a request of your counsel .
Although the commitment was made orally to Charles Karowsky,
Attorney for School District No. 6 , both your District and the
undersigned deemed it appropriate to memorialize the commitment
made.
Accordingly, this is to advise that the undersigned, acting in
behalf of Weld County, hereby grant to you the Right of First
Refusal to acquire parcels 1 through 4 as displayed on the
attached plat, for the purposes described above, if, as and
when, it is determined that the same should be sold, exchanged,
or otherwise disposed of separately or in conjunction with dis-
position of adjacent County owned property.

Dear Commissioners :
You will recall that I have spoken to you on several occasions
on behalf of the School District, concerning the potential acqui-
sition of a service building that belongs to the County. The
property I refer to, of course, is the property which is adjacent
to Billy Martinez Elementary School .
You indicated to me that you would have no reluctance in grant-
ing to the District a Right of First Refusal as, if and when
you decided to sell the property.
I have taken the liberty of memorializing the commitment and ask
that, if you find it acceptable in form and content, you sign
the same, execute it and return to me.
