RE: APPROVE AGREEMENT CONCERNING EMS SERVICES IN DESIGNATED AREA
AND FOR PROVIDING MUTUAL AID AND AUTHORIZE CHAIR TO SIGN -
THOMPSON VALLEY EMERGENCY MEDICAL SERVICES, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Agreement Concerning EMS
Services in Designated Area and for Providing Mutual Aid between the County of Weld, State of
Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the
Weld County Paramedic Services, and Thompson Valley Emergency Medical Services, with
terms and conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Agreement Concerning EMS Services in Designated Area and
for Providing Mutual Aid between the County of Weld, State of Colorado, by and through the
Board of County Commissioners of Weld County, on behalf of the Weld County Paramedic
Services, and Thompson Valley Emergency Medical Services be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 25th day of November, A.D., 2002.

AGREEMENT CONCERNING EMS SERVICES
IN DESIGNATED AREA
AND FOR PROVIDING MUTUAL AID
THIS AGREEMENT entered into by and between the Board of County Commissioners
for the County of Weld, State of Colorado, on behalf of the Weld County Paramedic Service
(AWCPS@), located at 1121 M Street, Greeley, Colorado 80631, and Thompson Valley
Emergency Medical Services, Inc. (ATV-EMS@), located at 380 N. Wilson Avenue, Loveland,
Colorado 80537. (Hereinafter referred to jointly as Aagencies,@ or may be individually referred to
as Aagency@).
WHEREAS, the agencies named above are authorized by Colorado statute to enter into
agreements; and
WHEREAS, the agencies maintain paid or volunteer emergency medical services together
with personnel and equipment for such purposes; and
WHEREAS, the agencies desire to set forth their agreement concerning the provision of
emergency medical services (AEMS@)to residents of an area located both within the Thompson
Valley Health Services District and the boundaries of the Town of Windsor; and
WHEREAS, it is also to the mutual benefit of each of the agencies to otherwise assist
each other in appropriate circumstances, and they wish to reduce their agreement to writing.
NOW THEREFORE, in consideration of the premises and the mutual covenants and
agreements herein set forth, the agencies agree as follows:
1. Definitions.
1.1 Answering Agency means the agency responding to a request within the boundaries of
another agency.
1.2 Requesting Agency means the agency requesting aid of an answering agency under
this Agreement.
1.3. Director means the person responsible for the ambulance service at the respective
agencies, or his or her designated representative or successor.
1.4. Designated Area means that area which is located within the boundaries of the
Thompson Valley Health Services District and also located within the boundaries of the Town of
Windsor.

2. Providing EMS Services to the Designated Area. or Providing Such Services
Through Mutual Aid.
2.1. Agreement Concealing Response to Designated Area Each agency agrees to
automatically respond to calls located within the Designated Area. The first ambulance to arrive
at the call will cancel the other agency=s ambulance if the second ambulance is not needed.
Because these calls will be directed to the Weld County Regional Communications Center(Athe
Dispatch Center@), WCPS agrees to work with the Dispatch Center to ensure that TV-EMS is
notified in a timely manner to respond in the Designated Area. Response to the Designated Area
shall be billed directly to the individuals receiving EMS Services by the agency providing services
pursuant to the billing procedures of that agency.
2.2 Agreement for Mutual Aid. Each agency agrees to respond to requests for
assistance within the jurisdictional boundaries of the other agency, and outside of the Designated
Area, upon request of the director of the Requesting Agency, if such request is at all times
consistent with the safety and protection of the citizens and property of the Answering Agency, in
the sole judgment of the director of the Answering Agency. Such mutual aid response shall be
without charge to the Requesting Agency.
2.2. Level of Response and Control in Mutual Aid Response._ In response to a mutual aid
call from the Requesting Agency, the director of the Answering Agency shall have complete
discretion to determine whether or not to respond, and to select the personnel and equipment to
answer the call. The equipment and employees of the Answering Agency shall at all times be
under the supervision and control of the director of the Answering Agency.
3. Mutual Aid Request
3.1. Form of Request for Aid. Any request for mutual aid shall include a statement of
the amount and type of equipment and personnel requested, and shall specify the location to
which the equipment and personnel are to be dispatched. The Director of the Answering
Agency shall determine the amount and type of equipment and number of personnel to be
furnished.
4. Protocol for Mutual Aid.
4.1. Agency First on Scene. The first agency to arrive shall take charge of, and coordinate
patient care. Each agency also agrees to coordinate its efforts with the other as well as with the
first arriving fire and/or law enforcement agency. If Answering Agency units arrive on scene prior
to Requesting Agency units, Answering Agency will assess and triage the scene, initiate any
necessary treatment, and relay this information to the responding Requesting Agency units.
Requesting Agency units may then decide whether to continue their response if a cancellation is
suggested by Answering Agency units. It shall be Answering Agency=s responsibility to remain
on scene until released by the Requesting Agency units.

4.2 Answering Agency Protocols. Any time an Answering Agency responds to a mutual
aid call the Answering Agency will follow their treatment protocols and procedures. Each agency
agrees the nearest hospital, patient choice, trauma destination protocol or on-line medical control,
whichever is appropriate, will determine patient destinations.
4.3. Release. The Answering Agency will be released by the Requesting Agency when
the services of the Answering Agency are no longer required or when the Answering Agency is
needed to provide emergency medical care or other emergency public services in its normal
service jurisdiction.
4.4 Communications. Each agency agrees to notify the other agency when responding
into the other agency=s district on a mutual aid call. Each agency agrees to establish a common
radio frequency as assigned by dispatch and agrees to monitor this frequency when responding
into the other agency=s district on a mutual aid call.
5. Additional Provisions.
5.1. Standard of Care. Each agency agrees that its equipment, and the actions, methods
and practices of its personnel shall conform to the applicable requirements of Colorado law and to
acceptable methods and practices of emergency response services.
5.2. Insurance. At all times that the personnel and equipment of an Answering Agency
are dispatched pursuant hereto, the said personnel and equipment of the Answering Agency shall
be subject only to the liability, worker=s compensation, and other insurance of the Answering
Agency. The equipment and employees of the Answering Agency shall at all times be under the
supervision and control of the Director of said agency, or the Director=s designated assistant.
5.3. Privileges and Immunities. The equipment and personnel of each of the agencies
while engaged in performing any mutual aid service, activity or undertaking under this Agreement
shall have and retain all rights, privileges and immunity of and be deemed to be engaged in the
service and employment of such agency, notwithstanding that such mutual aid service is being
performed in the jurisdiction of or for the other agency.
5.4. Waiver of Claims. Each agency waives all claims against the other agency for
compensation for any loss of or damage to equipment and for any loss, damage, personal injury or
death sustained by its personnel, which occur as a consequence of the performance of this
Agreement.
5.5. Effective Period. This Agreement shall become effective upon the approval and
signature by the last to sign of the authorized representatives of the agencies hereto and shall
continue until such time as either agency terminates this Agreement after having given 60 days
advance written notice to the other agency of its intention to so terminate this Agreement.
5.6. Supplementation. This Agreement may be supplemented with various exhibits to be
alphabetically designated in chronological order of adoption and signed by the respective

agencies. These exhibits may set forth specific areas of first response, additional protocols, and
other communications and procedural matters.
5.7. No Third Party Beneficiaries. Nothing in this Agreement shall be construed to create
a cause of action or civil liability remedy in any person not a party to this Agreement. This
Agreement exists for the sole benefit of the parties to the Agreement. The Agreement shall not be
construed to create a duty by either party to any third party where no such duty otherwise existed.
IN WITNESS WHEREOF, the duly authorized representatives of the respective agencies
hereto have signed on the dates indicated below.
